60	60	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
61	61	SECTION 1. NEW LAW A new section of law to be codified
62	62	in the Oklahoma Statutes as Section 2-162 of Title 37A, unless there
63	63	is created a duplication in numbering, reads as follows:
64	64	A. An alcoholic beverage gift basket license shall authorize
65	65	the holder thereof to sell and deliver gift baskets that contain
66	66	nonalcoholic items as well as alcoholic beverages including beer ,

93	93	wine, and spirits in sealed containers to consumers located out of
94	94	the State of Oklahoma as follows:
95	95	1. The alcoholic beverage gift basket licensee is subject to
96	96	the recipient state's applicable laws;
97	97	2. The alcoholic beverage gift basket licensee must att ach
98	98	shipping labels to gift baskets containing alcohol that follow the
99	99	state law of the receiving state ;
100	100	3. The alcoholic beverage gift basket licensee must ensure that
101	101	an individual who is at least twenty -one (21) years of age, as shown
102	102	on a driver license or identity card, signs for the delivery ;
103	103	4. The alcoholic beverage gift basket licensee shall not ship
104	104	alcoholic gift baskets to any address in the state where the sale of
105	105	alcoholic liquor is prohibited by local option;
106	106	5. Payment for alcoholic beverage g ift basket delivery by the
107	107	alcoholic beverage gift basket licensee may be made by cash, check,
108	108	transportable credit/debit card processors , or advance online
109	109	payment methods; and
110	110	6. The alcoholic beverage gift basket licensee shall be
111	111	responsible for their delivery employees as provided in Section 2 -
112	112	133 of Title 37A of the Oklahoma Statutes.
113	113	B. The alcoholic beverages containe d in a gift basket shall be
114	114	purchased from an Oklahoma licensed w holesale distributor.

141	141	C. A holder of an alcoholic beverage gift basket l icense shall
142	142	maintain records and submit reports as required by the Alcoholic
143	143	Beverage Laws Enforcement (ABLE) Commission.
144	144	D. The ABLE Commission is authorized to promulgate rules,
145	145	regulations, forms, and procedures necessary to implement and
146	146	enforce the provisions of this section.
147	147	SECTION 2. AMENDATORY 37A O.S. 2021, Section 2 -101, is
148	148	amended to read as follows:
149	149	Section 2-101. A. Except as otherwise provided in this
150	150	section, the licenses issued by the ABLE Commission, and t he annual
151	151	fees therefor, shall be as follows:

306	306	a Mixed Beverage License an administrative fee, which shall not be
307	307	deemed to be a license fee, in the amount of Five Hundred Dollars
308	308	($500.00), which shall be paid at the same time and in the sam e
309	309	manner as the license fees prescribed by para graph 12 of subsection
310	310	A of this section; provided, this fee shall not be assessed against
311	311	service organizations or fraternal beneficiary societies which are
312	312	exempt under Section 501(c)(19), (8) or (10) of the Internal Revenue

340	340	2. There shall be adde d to the fee for a Mixed Beverage/Caterer
341	341	Combination License an administrative fee, which shall not be deemed
342	342	to be a license fee, in the amount of Two Hundred Fifty Dollars
343	343	($250.00), which shall be paid at the same time and in the same
344	344	manner as the license fee prescribed by paragraph 13 of subsection A
345	345	of this section.
346	346	C. Notwithstanding the provisions of subsection A of this
347	347	section:
348	348	1. The license fee for a mixed beverage or bottle club license
349	349	for those service organizations or fraternal beneficiar y societies
350	350	which are exempt under Section 501(c)(19), (8 ) or (10) of the
351	351	Internal Revenue Code shall be Five Hundred Dollars ($500.00) per
352	352	year; and
353	353	2. The renewal fee for an airline/railroad/commercial pass enger
354	354	vessel beverage license held by a railroa d described in 49 U.S.C.,
355	355	Section 24301, shall be One Hun dred Dollars ($100.00).
356	356	D. An applicant may apply for and receive both an on -premises
357	357	beer and wine license and a caterer license.
358	358	E. All licenses, ex cept as otherwise provided, shall be valid
359	359	for one (1) year from date of issuance unless revoked or
360	360	surrendered. Provided, all employee licenses shall be valid for two
361	361	(2) years.
362	362	F. The holder of a license, issued by the ABLE Commission, for
363	363	a bottle club located in a county of this state where the s ale of

391	391	consumption has been authorized, may exchange the bottle club
392	392	license for a mixed beverage license or an on -premises beer and wine
393	393	license and operate the licensed premises as a mixed bever age
394	394	establishment or an on -premises beer and wine establi shment subject
395	395	to the provisions of the Oklahoma Alcoholic Beverage Control Act.
396	396	There shall be no additional fee for such exchange and the mixed
397	397	beverage license or on-premises beer and wine licens e issued shall
398	398	expire one (1) year from the date of issua nce of the original bottle
399	399	club license.
400	400	G. In addition to the applicable licensing fee, the following
401	401	surcharge shall be assessed annually on the foll owing licenses:
402	402	1. Nonresident Seller License ...................... $2,500.00
403	403	2. Manufacturer License:
404	404	a. 50 cases or less sold in Oklahoma in
405	405	last calendar year.......................... $100.00
406	406	b. 51 to 500 cases sold in Oklahoma in

408	408	c. 501 cases or more sold in Oklahoma in
409	409	last calendar year.......................... $450.00

457	457	Governance Revolving Fund established pursuant to Section 5 -128 of
458	458	this title.
459	459	H. Any license issued by the ABLE Commission under this title
460	460	may be relied upon by other licensees as a valid l icense, and no
461	461	other licensee shall have any obligation to independently determine
462	462	the validity of such license or be held liable solely as a
