52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. AMENDATORY 10 O.S. 2021, Section 402, is
54	54	amended to read as follows:
55	55	Section 402. As used in the Oklahoma Child Care Facilities
56	56	Licensing Act:
57	57	1. "Adult" means an individual eighteen (18) years of age or
58	58	older;
59	59	2. "Child" or "minor" means any person who has not attained the
60	60	age of eighteen (18) years;
61	61	3. "Child care center" means a program that operates thirty
62	62	(30) or more hours per week;

89	89	4. "Child care facility" means any public or private child care
90	90	residential facility, child -placing agency, foster family ho me,
91	91	child care center, part -day program, out-of-school time program, day
92	92	camp, drop-in program, program for sick children, community hope
93	93	center, family child care home, or large family child care home
94	94	providing either full -time or part-time care for children away from
95	95	their own homes;
96	96	5. "Child-placing agency" means an agency that arranges for or
97	97	places a child in a foster family home, adoptive hom e, or
98	98	independent living program;
99	99	6. "Foster family home" means the private residence of a family
100	100	which provides foster care services to a child, and includes a
101	101	specialized foster h ome, a therapeutic foste r family home, or a
102	102	kinship care home;
103	103	7. "Foster parent eligibility assessment" includes a criminal
104	104	background investigation, including, but not limited to, a national
105	105	criminal history records search based upon the submission of
106	106	fingerprints, a home asse ssment, and any other assessment required
107	107	by the Department of Human Services, the Office of Juvenile Affairs,
108	108	or any child-placing agency pursuant to the provisions of Section 1 -
109	109	7-106 of Title 10A of the Oklahoma Statutes. A foste r parent
110	110	eligibility assessment shall be similar to the procedures used by
111	111	the Department of Public Safety for determining suitability of an
112	112	individual for employment as a highway patrol officer;

139	139	8. "Department" means the Department of Human Services;
140	140	9. "Division" means the section within the Department that is
141	141	assigned responsibilities pursuant to the provisions of the Oklahoma
142	142	Child Care Facilities Licensing Act;
143	143	10. "Family child care home " means a family home which provides
144	144	care and supervision for seven or fewer children for part of the
145	145	twenty-four-hour day. The term "family child care home" shall not
146	146	include informal arrangements which parents make independently with
147	147	neighbors, friends, and others, or with caretakers in the child 's
148	148	own home;
149	149	11. "Full-time care" means continuous care given to a child
150	150	beyond a minimum period of twenty-four (24) hours;
151	151	12. "Large family child care home " means a residential family
152	152	home which provides care and supervision for eight to twelve
153	153	children for part of the twenty-four-hour day;
154	154	13. "Part-day child care program " means a program that provides
155	155	care and supervision for children and that operates for more than
156	156	fifteen (15) and up to thirty (30) hours per week;
157	157	14. "Program" means the business entity that provid es care,
158	158	supervision, and learning opportunities for children;
159	159	15. "Rap back" means a notification from the Oklahoma State
160	160	Bureau of Investigation to the Department of subsequent criminal
161	161	activity of individuals whose criminal background checks have been

190	190	16. "Residential child care facility " means a twenty-four-hour
191	191	residential facility where children live together with or are
192	192	supervised by adults who are not their parents or relatives;
193	193	17. "Responsible entity" means an individual who i s authorized
194	194	to obligate the business; and
195	195	18. "Specialized service professional " means an individual from
196	196	an academic discipline or field of expertise who provides
197	197	individualized services to a child, such as behavioral or physical
198	198	therapists.
199	199	SECTION 2. This act shall become effective November 1, 2023.
