40	40	An Act relating to public health and safety; amending
41	41	63 O.S. 2021, Section 7100 .2, which relates to
42	42	legislative findings in the Oklahoma Health
43	43	Information Exchange Act; clarifying the purpose to
44	44	include rights afforded under the Health Insurance
45	45	Portability and Accountability Act (HIPAA) and not
46	46	supersede HIPAA; amending 63 O.S. 2021, Section
47	47	7100.3, which relates to definitions in the Oklahoma
48	48	Health Information Exchange Act; adding new
49	49	definitions; and providing an effecti ve date.

54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. AMENDATORY 63 O.S. 2021, Section 7100.2, is
56	56	amended to read as follows:
57	57	Section 7100.2 A. The Legislature finds that the exchange of
58	58	health information in Okla homa has been impeded as a result of:
59	59	1. Confusion about the proper application of federal and s tate
60	60	privacy and privilege l aw; and
61	61	2. Concern regarding potential liability for violations of such
62	62	laws.
63	63	B. The purpose of this act is to:

90	90	1. Set forth a standard process for authorizing the exchange of
91	91	health information in compliance with federal and state law; and
92	92	2. Ensure immunization from liability under state law for
93	93	exchanges of health i nformation in accordance with the standard
94	94	process.
95	95	C. Nothing in this act shall be construed as superseding,
96	96	preempting, or altering rights and protections af forded under the
97	97	Health Insurance Portability and Accou ntability Act of 1996 (H IPAA).
98	98	Nothing in this act shall be construed as affecting the obligations
99	99	of covered entities under existing HIPAA regulations.
100	100	SECTION 2. AMENDATORY 63 O.S. 2021, Section 7100.3, is
101	101	amended to read as follo ws:
102	102	Section 7100.3 As used in the Oklahoma Health Information
103	103	Exchange Act:
104	104	1. "Board" means the State Board of Health;
105	105	2. "Health information" means information, regardless of source
106	106	or form, that:
107	107	a. includes demographic inf ormation collected from an
108	108	individual,
109	109	b. relates to the past, present or future physical or
110	110	mental health or condition of an indi vidual; the
111	111	provision of health care to an individual; or the
112	112	past, present or future payment for the provision of
113	113	health care to an individual, or

140	140	c. identifies the individual or from which there is a
141	141	reasonable basis to believe the information can be
142	142	used to identify the individual; and
143	143	3. "Health care entity" means:
144	144	a. a health plan that, either as an individual or group,
145	145	provides for, or pays the cost of, medical care,
146	146	b. a health care provider that offers or renders medical
147	147	or health services, or
148	148	c. any further individual or association defined as a
149	149	covered entity under 45 C.F.R., Section 160.103 ;
150	150	4. "HIPAA" means the federal Health Insurance Portabi lity and
151	151	Accountability Act of 1996, and any amendments thereto ; and
152	152	5. "HIPAA Privacy Rule" means the privacy rule found at 45 CFR
153	153	Part 160 and subparts A and E of Part 164.
154	154	SECTION 3. This act shall become effective November 1, 2023.
