4040 An Act relating to public health and safety; amending
4141 63 O.S. 2021, Section 7100 .2, which relates to
4242 legislative findings in the Oklahoma Health
4343 Information Exchange Act; clarifying the purpose to
4444 include rights afforded under the Health Insurance
4545 Portability and Accountability Act (HIPAA) and not
4646 supersede HIPAA; amending 63 O.S. 2021, Section
4747 7100.3, which relates to definitions in the Oklahoma
4848 Health Information Exchange Act; adding new
4949 definitions; and providing an effecti ve date.

5454 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5555 SECTION 1. AMENDATORY 63 O.S. 2021, Section 7100.2, is
5656 amended to read as follows:
5757 Section 7100.2 A. The Legislature finds that the exchange of
5858 health information in Okla homa has been impeded as a result of:
5959 1. Confusion about the proper application of federal and s tate
6060 privacy and privilege l aw; and
6161 2. Concern regarding potential liability for violations of such
6262 laws.
6363 B. The purpose of this act is to:

9090 1. Set forth a standard process for authorizing the exchange of
9191 health information in compliance with federal and state law; and
9292 2. Ensure immunization from liability under state law for
9393 exchanges of health i nformation in accordance with the standard
9494 process.
9595 C. Nothing in this act shall be construed as superseding,
9696 preempting, or altering rights and protections af forded under the
9797 Health Insurance Portability and Accou ntability Act of 1996 (H IPAA).
9898 Nothing in this act shall be construed as affecting the obligations
9999 of covered entities under existing HIPAA regulations.
100100 SECTION 2. AMENDATORY 63 O.S. 2021, Section 7100.3, is
101101 amended to read as follo ws:
102102 Section 7100.3 As used in the Oklahoma Health Information
103103 Exchange Act:
104104 1. "Board" means the State Board of Health;
105105 2. "Health information" means information, regardless of source
106106 or form, that:
107107 a. includes demographic inf ormation collected from an
108108 individual,
109109 b. relates to the past, present or future physical or
110110 mental health or condition of an indi vidual; the
111111 provision of health care to an individual; or the
112112 past, present or future payment for the provision of
113113 health care to an individual, or

140140 c. identifies the individual or from which there is a
141141 reasonable basis to believe the information can be
142142 used to identify the individual; and
143143 3. "Health care entity" means:
144144 a. a health plan that, either as an individual or group,
145145 provides for, or pays the cost of, medical care,
146146 b. a health care provider that offers or renders medical
147147 or health services, or
148148 c. any further individual or association defined as a
149149 covered entity under 45 C.F.R., Section 160.103 ;
150150 4. "HIPAA" means the federal Health Insurance Portabi lity and
151151 Accountability Act of 1996, and any amendments thereto ; and
152152 5. "HIPAA Privacy Rule" means the privacy rule found at 45 CFR
153153 Part 160 and subparts A and E of Part 164.
154154 SECTION 3. This act shall become effective November 1, 2023.
