4848 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4949 SECTION 1. AMENDATORY 37A O.S. 2021, Section 2 -109, is
5050 amended to read as follows:
5151 Section 2-109. A. A retail spirits license shall a uthorize the
5252 holder thereof:
5353 1. To purchase wine or spirits from a wine and spirits
5454 wholesaler;
5555 2. To purchase beer from a beer distribu tor or from the holder
5656 of a small brewer self -distribution license;
5757 3. To sell same on the licensed premises i n such containers to
5858 consumers for off-premises consumption only and not for resale;
5959 provided, spirits, wine and beer may be sold to charitable
6060 organizations that are holders of charitable alcoholic beverage
6161 auction or charitable alcoholic beverage event l icenses; and

8888 4. To host alcoholic beverage tastings consistent with
8989 subsections D and E of this section .
9090 B. A retail wine license shall author ize the holder thereof:
9191 1. To purchase wine from a wine and spirits wholesaler;
9292 2. To purchase wine from a small farm winemaker who is
9393 permitted and has elected to self -distribute as provided in Article
9494 XXVIII-A of the Oklahoma Constitution;
9595 3. To sell same on the licensed premises in such containers to
9696 consumers for off-premises consumption only and not for resale;
9797 provided, wine may be sold to charitable organizations that are
9898 holders of charitable alcoholic beverage auction or charitable
9999 alcoholic beverage event licenses ; and
100100 4. To host an alcoholic beverage tasting, consistent with
101101 subsections D and E of this section.
102102 Provided, no holder of a retail wine license may sell wine with
103103 alcohol beverage volume in excess o f fifteen percent (15%).
104104 C. A retail beer license shall authorize the holder thereof:
105105 1. To purchase beer from a beer distributor;
106106 2. To purchase beer from the holder of a small brewer self -
107107 distribution license;
108108 3. To sell same beer, wine, or spirits, refrigerated or non-
109109 refrigerated, on the licensed premises in such containers to
110110 consumers for off-premises consumption only and not for resale;
111111 provided, beer may be so ld to charitable organizations that are

138138 holders of charitable alcoholic beverage auctio n or charitable
139139 alcoholic beverage event licenses ; and
140140 4. To host alcoholic beverage tasting s consistent with
141141 subsections D and E of this section .
142142 Provided, no holder o f a retail beer license may sell a malt
143143 beverage with alcohol beverage volume in excess of fifteen percent
144144 (15%).
145145 D. All tastings conducted under t his section shall:
146146 1. Be conducted under the direct supervision of the licensee
147147 authorized to host the tast ing;
148148 2. Be poured by any ABLE Commission licensee lawfully permitted
149149 to serve alcoholic beverages, provided no wine or spirits
150150 wholesaler, beer dis tributor or employee of a wine o r spirits
151151 wholesaler or beer distributor shall be allowed to pour samples fo r
152152 tastings;
153153 3. Use alcoholic beverages purchased by the licensee authorized
154154 to host the tastings from a licensed wine and spirits wholesaler,
155155 beer distributor, self-distributor, small brewer or self-
156156 distributing winery authorized to sell the same, and the licensee
157157 shall pay the applicable taxes on the alcoholic beverages purchased;
158158 provided, the licensee may only provide samples of alcoholic
159159 beverages that its license is authorized to sell;
160160 4. Be restricted to persons twenty -one (21) years of age or
161161 older;

188188 5. Be limited to no more than one (1) fluid ounce of spirits,
189189 two (2) fluid ounces o f wine or three (3) fluid ounces of beer per
190190 consumer per day; and
191191 6. Be consumed on the lic ensed premises of the licensee
192192 authorized to host the tastings or at a locat ion other than the
193193 licensed premises, provided no samples served on the licensed
194194 premises shall be permitted to be removed from the licensed
195195 premises.
196196 E. All licensees authorized to serve samples pursuant to
197197 subsection D of this section shall ensure that:
198198 1. All samples are poured only from original sealed packaging;
199199 2. Any alcoholic beve rages remaining in unsealed packaging used
200200 to provide samples, excluding spirits, are poured out by the end of
201201 the day;
202202 3. No more than six (6) bottles of alcoholic bev erages are
203203 unsealed at any given time; and
204204 4. No person shall remove any samples from the licensed
205205 premises or location where the tasting has occur red.
206206 SECTION 2. It being immediately necessary for the preservation
207207 of the public peace, he alth or safety, an emergency is hereby
208208 declared to exist, by reason whereof this act sh all take effect and
209209 be in full force from and after its passage an d approval.
