40	40	An Act relating to schools; amending Section 1,
41	41	Chapter 135, O.S.L. 2022 (70 O.S. Supp. 2022, Section
42	42	509.12), which relates to employee associations;
43	43	requiring school employee on certain leave to receive
44	44	pay and maintain certain benefits; directing payment
45	45	or reimbursement from association; providing for
46	46	certain advancement and accrual; authorizing return
47	47	to service upon end of leave; deleting requirement to
48	48	not recognize certain employee asso ciations; and

56	56	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
57	57	SECTION 1. AMENDATORY Section 1, Chapter 135, O.S.L.
58	58	2022 (70 O.S. Supp. 2022, Section 509.12), is amended to read as
59	59	follows:
60	60	Section 509.12 A. A school district board of education may
61	61	approve a request from a school distri ct employee for a leave of
62	62	absence to hold office as an officer, director, trus tee, or agent of
63	63	a national, statewide, or school district employee associa tion. The
64	64	employee requesting the leave shall provide the school district
65	65	superintendent with proof of election and proof of the term of

92	92	office for the national, statewide, or scho ol district employee
93	93	association. Proof of election shall include but not be limited to
94	94	certification by the national, statewide, or school district
95	95	employee association of the date of the election and the results of
96	96	the election. Board of education appr oval for leave requested
97	97	pursuant to this section shall have definitive beginning and end
98	98	dates.
99	99	B. Leave granted pursuant to this section shall be leave
100	100	without pay. The school employee on leave shall not receive pay and
101	101	be entitled to maintain any all benefits and associated service
102	102	credits granted by the school district regardless of whether the
103	103	benefit is which shall be paid or reimbursed by the employee on
104	104	leave or the association for which the person is serving as an
105	105	officer, director, trustee , or agent.
106	106	C. During the leave period, the school employee's position with
107	107	the school district shall be maintained without including
108	108	advancement on the minimum salary schedule adopted pursuant to
109	109	Section 5-141 of Title 70 of the Oklahoma Statutes and with no
110	110	accrual of sick leave, personal business leave, or and personal
111	111	leave. The employee on leave shall not accumulate service credit
112	112	within the Teachers' Retirement System of Oklahoma. Following the
113	113	term of leave granted pursuant to the provisions of this section,
114	114	the employee granted leave may return to his or her former position
115	115	or a comparable position.

142	142	D. A school district employee granted leave pu rsuant to the
143	143	provisions of this section shall be prohibited from accessing school
144	144	district office space .
145	145	E. If a national, statewide, or school district employee
146	146	association that serves as a school district employee organization
147	147	established pursuant to S ection 509.2 of Title 70 of the Oklahoma
148	148	Statutes fails to comply with the provisions of this section , the
149	149	school district board of education shall no long er recognize the
150	150	organization as a representative of employees.
151	151	SECTION 2. This act shall become effective November 1, 2023.
