6868 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6969 SECTION 1. NEW LAW A new section of law to be codified
7070 in the Oklahoma Statutes as Section 61.10 of Title 74, unless there

9898 A. 1. There is hereby created the Department of Central
9999 Services. The Governor shall appoint a Director of Department of
100100 Central Services, by and with the advice and consent of t he Senate,
101101 who shall hold office at the pleasure of the Governor and shall
102102 continue to serve until his or her successor is duly appointed and
103103 is qualified. The salary of the Director of the Department of
104104 Central Services shall be set by the Legislature.
105105 2. The Director of the Department of Central Services , with the
106106 approval of the Governor, shall employ and make the a ppointment of
107107 such experts and assistants as may be necessary in the performance
108108 of the Director's duties as required by law. No appointments to
109109 positions shall be made in excess of the positions authorized by act
110110 of the Legislature for the Office of Manag ement and Enterprise
111111 Services.
112112 3. Beginning on the effective date of this act, the Department
113113 of Central Services shall cease to be part of or a division of the
114114 Office of Management and Enterprise and shall be deemed to be a
115115 separate and distinct agency, to be known as the Department of
116116 Central Services. The Department of Central Services and the
117117 Director of the Department of Central Services shall continue to
118118 exercise their statutory powers, duties, and contractual
119119 responsibilities. All records, property, equipment, assets, monies,
120120 financial interests, liabilities, matters pendi ng, and funds of the
121121 Department of Central Services as a Division of the Office of

148148 Management and Enterprise Services shall be transferred to the
149149 Department of Central Services.
150150 4. The Department shall succeed to any contractual rights or
151151 responsibilities incurred by the Department of Central Services
152152 Division of the Office of Management and Enterprise Services .
153153 5. Rules promulgated by the Department of Central Services
154154 Division of the Office of Management and Enterprise Services that
155155 are in effect on the effective date of this act shall be i mmediately
156156 adopted and enforced by the Department and the Director of the
157157 Department and shall maintain the authority to further promulgate
158158 and enforce rules.
159159 6. The Department and the Office of Management and Enterprise
160160 Services may enter into an agreement for t he transfer of personnel
161161 from the Office of Management and Enterprise Services to the
162162 Department. No employee shall be transferred to the Department
163163 except on the freely given written consent of the employee. All
164164 employees who are transferred to the Department shall not be
165165 required to accept a lesser grade or salary than present ly received.
166166 All employees shall retain leave, sick, and annual time earned, and
167167 any retirement and longevity benefits which have accrued during
168168 their tenure with the Office of Management and Enterprise Services.
169169 The transfer of personnel between the state agencies shall be
170170 coordinated with the Office of Management and Enterprise Services.

198198 7. The expenses incurred by the Department as a result of the
199199 transfer required by this subsection shall b e paid by the Office of
200200 Management and Enterprise Services.
201201 8. The Department of Central Services Division within the
202202 Office of Management and Enterprise Services shall be abolished by
203203 the Office of Management and Enterprise Services after the transfer
204204 has been completed.
205205 9. The Office of Management and En terprise Services shall
206206 coordinate the transfer of records, property, equipment, assets,
207207 funds, allotments, purchase orders, liabilities, outstanding
208208 financial obligations, or encumbrances provided for in this
209209 subsection.
210210 SECTION 2. AMENDATORY 74 O.S. 20 21, Section 61.2, is
211211 amended to read as follows:
212212 Section 61.2 Whenever the terms "Board of Affairs", "State
213213 Board of Public Affairs", "Board" when used in reference to the
214214 Board of Public Affairs, or "Office of Public Affairs ", or
215215 "Department of Central S ervices" appear in the Oklahoma Statutes
216216 they shall mean the Office of Management and Enterprise Services.
217217 Whenever the term "Director of Public Affairs " appears in the
218218 Oklahoma Statutes it shall mean the Director of the Office of
219219 Management and Enterpris e Services. Whenever the term "Director of
220220 Central Services" appears in the Oklahoma Statutes it shall mean the

249249 SECTION 3. AMENDATORY 74 O.S. 2021, Section 85.3, is
250250 amended to read as follows:
251251 Section 85.3 A. There is hereby created and established in the
252252 Office of Management and Enterprise Services Department of Central
253253 Services a Purchasing Division, the administrative he ad of which
254254 shall be the State Pu rchasing Director.
255255 B. The Director of the Office of Management an d Enterprise
256256 Services Department of Central Services shall hire the State
257257 Purchasing Director. The State Purchasing Director shall:
258258 1. Have a thorough knowledge of office practices and b uying
259259 procedures in volume purchasing; and
260260 2. Be a graduate of an a ccredited college or university with at
261261 least five (5) years ' experience in commercial or governmental
262262 purchasing, or, in lieu of such education, have at least ten (10)
263263 years' experience in commercial or governmental purchasing.
264264 C. The State Purchasing Di rector, with the approval of the
265265 Director of the Office of Management and Enterprise Services
266266 Department of Central Services , may employ such personnel as may be
267267 necessary to exercise author ity and perform duties under the
268268 Oklahoma Central Purchasing Act.
269269 D. All activities of any state agency, department, or
270270 institution relating to purchasing shall be under the direction of

297297 the Purchasing Division unless otherwise provided by the Oklahoma
298298 Central Purchasing Act.
299299 E. The Purchasing Division shall provide qu alified personnel to
300300 assist the purchasing activities of state agencies, departments, and
301301 institutions, as required by the Oklahoma Central Purchasing Act.
302302 F. Each state agency, department, and institution shall
303303 designate personnel to coordinate its purch asing functions with the
304304 Purchasing Division.
305305 G. The Purchasing Division may, if the needs of a state agency,
306306 department, or institution are such as to so require, employ, and
307307 establish a buyer within a state agency. The state agency shall pay
308308 all expenses incurred for any buyer required to be placed within its
309309 agency.
310310 H. Except as provided in Section 34.36 of Title 62 of the
311311 Oklahoma Statutes, no state agency subject to the Oklahoma Centr al
312312 Purchasing Act shall have or maintain a purchasing section with out
313313 the prior approval in writing of the Purchasing Division unless
314314 otherwise provided in the Oklahoma Central Purchasing Act nor shall
315315 such purchasing section perform purchasing functions f or another
316316 state agency.
317317 I. The Purchasing Division shall make ac quisitions from
318318 industries operated by the Department of Corrections pursuant to the
319319 provisions of Section 549.1 of Title 57 of the Oklahoma Statutes.
320320 J. None of the personnel authorized by this section shall:

347347 1. Sell to or otherwise provide acquisitions to any state
348348 agency subject to the Oklahoma Central Purchasing Act;
349349 2. Be employees, partners, associates, officers, or
350350 stockholders in or with any business entity that sells to or
351351 otherwise provides acquisitions to any state agency subject to the
352352 Oklahoma Central Purchasing Act;
353353 3. Be employed in any of the positions authorized by this
354354 section if a spouse or child owns any stock in any business entity
355355 which sells to or otherwise provides acquisitions to any agency
356356 subject to the Oklahoma Central Purchas ing Act;
357357 4. Be employed in any of the positions authorized by this
358358 section if a relative within the third degree of consanguinity or
359359 affinity sells to or otherwise provides acquisitions to any state
360360 agency subject to the Oklahoma Central Purchasing Act or is
361361 interested in any business entity which does so, except that such
362362 relative, excluding a spouse or child, may own Twenty -five Thousand
363363 Dollars ($25,000.00) worth or less, or one percent ( 1%) or less,
364364 whichever amount is the lesser amount, of the stock o f a corporation
365365 or any business entity which sells to or otherwise provides
366366 acquisitions to any state agency subject to the Oklahoma Central
367367 Purchasing Act; or
368368 5. Violate applicable rules o f the Ethics Commission
369369 promulgated pursuant to Article XXIX of th e Oklahoma Constitution
370370 that relate to accepting gifts from a vendor or a vendor 's agent.

397397 SECTION 4. AMENDATORY 74 O.S. 2021, Section 85.5, is
398398 amended to read as follows:
399399 Section 85.5 A. Except as otherwise provided in this section,
400400 the State Purchasing Director, under the supervision of the Director
401401 of the Office of Management and Enterprise Services Department of
402402 Central Services, shall have sole and excl usive authority and
403403 responsibility for all acquisitions by state agencies. In order to
404404 carry out the powers and duties of the Chief Information Officer and
405405 the Information Services Division , the Chief Information Officer
406406 shall have sole and exclusive auth ority and responsibility for all
407407 acquisitions of information and telecommunications technology,
408408 equipment, software, products and related peripherals and services
409409 by state agencies. Public construction contracts are awarded
410410 pursuant to Title 61 of the Okl ahoma Statutes and are not subject to
411411 the Oklahoma Central Purchasing Act.
412412 B. Every state agency shall determine its own quantitative
413413 needs for acquisitions and the general class or nature of the
414414 acquisitions. The State Purchasing Director, after consult ation
415415 with the requisitioning state agency, shall have authority to
416416 determine the particular brand, model or other specific
417417 classification of each acquisition and to draft or invoke pursuant
418418 to the Oklahoma Central Purchasing Act specifications establishin g
419419 the requirements for all necessary contracts or purchase orders.

446446 C. The Director of the Office of Management and Enterprise
447447 Services Department of Central Services shall have authority an d
448448 responsibility to promulgate rules in connection with provisions of
449449 the Oklahoma Central Purchasing Act for:
450450 1. The time, manner, authentication and form of making
451451 requisitions for acquisitions;
452452 2. Inspection, analysis and testing of acquisitions or sa mples
453453 bidders submit prior to contract award;
454454 3. The form and manner of s ubmission for bids or proposals a
455455 bidder submits and the manner of accepting and opening bids or
456456 proposals;
457457 4. The conditions under which the Office of Management and
458458 Enterprise Services Department of Central Services shall require
459459 written contracts for a cquisitions, the conditions under which
460460 acquisitions may be made on an open account basis, and the
461461 conditions and manner of negotiating such contracts;
462462 5. Obtaining acquisitions pro duced by state institutions;
463463 6. Conditions under which any of the rules h erein authorized
464464 may be waived;
465465 7. The amounts of and deposits on any bond or other surety
466466 required to be submitted with a bid or contract for the furnishing
467467 of acquisitions and the conditions under which such bond or other
468468 surety shall be required;

495495 8. The manner and conditions of delivery, which shall incl ude
496496 the designation of the common carrier of property to be used to
497497 transport acquisitions whenever a common carrier is used, an d the
498498 acceptance, or rejection, including check of quantities, of any
499499 acquisitions;
500500 9. The form of any estimate, order or other information
501501 required in connection with an acquisition;
502502 10. State agency acquisitions not exceeding the acquisition
503503 threshold amount requiring competitive bid to ensure
504504 competitiveness, fairness, comp liance with the Oklahoma Central
505505 Purchasing Act and Se ction 3001 et seq. of this title, which relates
506506 to the State Use Committee. The rules shall include separate
507507 provisions based on acquisition amounts as follows:
508508 a. state agencies shall make acquisition s not exceeding
509509 Twenty-five Thousand Dollars ($25,000. 00), provided
510510 the acquisition process is fair and reasonable and is
511511 conducted pursuant to rules authorized pursuant to
512512 this section, and
513513 b. state agencies with certified procurement officers and
514514 internal purchasing procedures found compliant by the
515515 State Purchasing Director may make acquisitions in
516516 excess of the fair and reasonable acquisition
517517 threshold amount provided for in this section and not
518518 exceeding Two Hundred Fifty Thousand Dollars

547547 11. Training by the State Purchasing Director of state agency
548548 procurement officers;
549549 12. Review and audit by the State Purchasing Dir ector of state
550550 agency acquisitions;
551551 13. The conditions for increasing acq uisition limits for state
552552 agencies which have had a pr ior reduction in acquisition limit by
553553 the Director of the Office of Management and Enterprise Services
554554 Department of Central Ser vices;
555555 14. Use of a state purchase card to make acquisitions;
556556 15. Any other matter or practice which relates to the
557557 responsibilities of the State Purchasing Director;
558558 16. Conditions for determination and authorization of
559559 acquisition threshold amounts of state agencies;
560560 17. The form and manner of verification by suppliers tha t the
561561 supplier is eligible to do business in the State of Oklahoma and has
562562 obtained all necessary permits and licenses, pursuant to applicable
563563 provisions of law; and
564564 18. Payment procedure rules for state agencies to adhere to
565565 regarding statewide contracts .
566566 D. The State Purchasing Director shall provide training for
567567 state agency procureme nt officials, and other procurement staff, and
568568 is authorized to require retraining of such procur ement personnel

595595 found not to be in compliance with provisions of the Oklah oma
596596 Central Purchasing Act or associated rules. The training may
597597 include any matters related to state procurement practices. State
598598 agency purchasing officials that demonstrate prof iciency shall be
599599 certified as "certified procurement officers " by the State
600600 Purchasing Director and shall be authorized to make acquisitions
601601 pursuant to provisions of the Oklahoma Central Purchasing Act and
602602 associated rules. The State Purchasing Director may assess a fee to
603603 state agencies for the training that does not exceed e ach state
604604 agency's pro rata share of the costs the State Purchasing Director
605605 incurs to provide the training.
606606 E. The State Purchasing Director shall review state agency
607607 acquisitions for the purposes of:
608608 1. Ensuring state agency compliance with provisions of the
609609 Oklahoma Central Purchasing Act;
610610 2. Ensuring state agency compliance with rul es promulgated by
611611 the Office of Management and Enterprise Services Department of
612612 Central Services pursuant to the Oklahoma Central Purchasing Act;
613613 3. Ensuring state agenc y compliance with provisions of Section
614614 3001 et seq. of this title pertaining to the State Use Committee;
615615 4. Reporting any acquisition by any state agency found not to
616616 be in compliance with those sections or rules to the Director of the
617617 Office of Management and Enterprise Services Department of Central
618618 Services;

645645 5. A determination by the State Purchasing Director to reduce a
646646 state agency's acquisition authority amount when the state agency is
647647 found not to be in compliance with the Oklahoma Central Purchas ing
648648 Act or associated rules or requirements of the State Purchasing
649649 Director pursuant to this section; and
650650 6. A determination by the State Purchas ing Director to increase
651651 a state agency's acquisition authority amount after the agency cures
652652 deficiencies in connection with a prior reduction in the authority
653653 amount by the State Purchasing Director.
654654 F. Based on written findings and when recommended by the State
655655 Purchasing Director, the Director of the Office of Management and
656656 Enterprise Services Department of Central Services may:
657657 1. Transmit written findings by the State Purchasing Director
658658 to the State Auditor and Inspector for further investigation,
659659 indicating purchasing procedur es that do not conform to the Oklahoma
660660 Central Purchasing Act or associated ru les; or
661661 2. Transmit to the Attorney General or the State Auditor and
662662 Inspector for further investigation a report made by the State
663663 Purchasing Director that the Director of the Office of Management
664664 and Enterprise Services Department of Central Services reasonably
665665 believes indicates that an action that constitutes a criminal
666666 violation pursuant to the Oklahoma Central Purchasing Act or other
667667 laws has been taken by any state agency, sta te agency official,
668668 bidder or supplier.

695695 G. 1. Pursuant to the requiremen ts of the Oklahoma Central
696696 Purchasing Act, the State Purchasing Director shall have authority
697697 to enter into any statewide, multistate or multigovernmental
698698 contract. The state entity designated by law, as spec ified in
699699 Section 1010.3 of Title 56 of the Okla homa Statutes, shall
700700 participate in the purchase of pharmaceuticals available through
701701 such multistate or multigovernmental contracts entered into by the
702702 State Purchasing Director.
703703 2. Whenever it appears advan tageous to the state or to any
704704 state agency to purchase or otherwise acquire any acquisition which
705705 may be offered for sale by the United States government or any
706706 agency thereof, the State Purchasing Director may execute a contrac t
707707 for the acquisition with the federal government or federal agency
708708 and may also utilize contracts awarded by other governmental
709709 agencies including, but not limited to, agencies of the United
710710 States of America.
711711 3. The State Purchasing Director may designa te, for use by
712712 state agencies, contracts described in this subsection and contracts
713713 awarded on behalf of one or more state agencies.
714714 4. Prior to exercising the authority to cancel a contract, the
715715 State Purchasing Director may authorize renegotiation of an existing
716716 contract with an incumbent supplier for the purposes of obtainin g
717717 more favorable terms for the state.

744744 5. The State Purchasing Director shall have the authority to
745745 designate certain contracts for state agencies as statewide
746746 contracts and mandator y statewide contracts. In order to carry out
747747 the powers and duties of the Chief Information Officer and
748748 Information Services Division, the Chief Information Officer shall
749749 have the authority to designate certain information technology and
750750 telecommunication contracts as statewide con tracts and mandatory
751751 statewide contracts and ma y negotiate consolidation contracts,
752752 enterprise agreements and high technology system contracts in lieu
753753 of or in conjunction with competitive bidding procedures to reduce
754754 acquisition cost.
755755 6. The State Purcha sing Director may publish such
756756 specifications relating to materials, supplies, equipment and
757757 services to be acquired for the state as may best promote
758758 competition and apprise potential suppliers of the type of product
759759 desired.
760760 H. 1. The State Purchasing Director may develop and test new
761761 contracting policies, procedures and innovations that hold potential
762762 for making state procurement more effective and efficient and
763763 identify, and make recommendations to the Legislature of, any
764764 appropriate changes in law. Such development and testing, proof of
765765 concept, pilot project or other similar test shall not be considered
766766 an acquisition subject to the Oklahoma Central Purchasing Act.

793793 2. The State Purchasing Director is authorized to explore and
794794 investigate cost savin gs in energy, resource usage and maintenance
795795 contracts and to identify and negotiate contract solutions

798798 I. The State Purchasing Director shall endeavor to satisfy
799799 state agencies in terms of cost, quality and timeline ss of the
800800 delivery of acquisitions by using bidders who have a record of
801801 successful past performance, promoting competition, minimizing
802802 administrative operating costs and conducting business with
803803 integrity, fairness and openness.
804804 J. The State Purchasing D irector shall undertake the following:
805805 1. The use of electronic commerce pursuant to the Oklahoma
806806 Online Bidding Act for solicitation, notification and other
807807 purchasing processes;
808808 2. Monitoring rules promulg ated pursuant to the Oklahoma
809809 Central Purchasing Act to ensure that the rules satisfy the
810810 interests of the state, are clear and succinct and encourage
811811 efficiency in purchasing processes;
812812 3. A program to identify suppliers ' performance records;
813813 4. Development of criteria for the use of sealed bid
814814 contracting procedures, negotiated contracting procedures, selection
815815 of types of contracts, postaward administration of purchase orders

844844 5. Continual improvement in the quality of the per formance of
845845 the Purchasing Division through training programs, management
846846 seminars, development of benchmarks and key management indicators,
847847 and development of standard provisions, c lauses and forms;
848848 6. The State Purchasing Director shall prescribe standa rdized
849849 contract forms and all other forms or certifications requisite or
850850 deemed necessary by the State Purchasing Director to effectuate the
851851 provisions of the Oklahoma Central Purcha sing Act and associated
852852 rules;
853853 7. Development of programs to improve cust omer relations
854854 through training, improved communications and appointment of
855855 technical representatives;
856856 8. Provide for public two -way communication between procurement
857857 officers and potential bidders who have q uestions regarding a
858858 request for proposal or in vitation to bid; and
859859 9. Determine whether and to what extent information included in
860860 a bid or similar offer is confidential and reject all requests to
861861 disclose the information so de signated.
862862 K. The State Purchasing Director may utilize and authorize
863863 state agencies to utilize reverse auctions to obtain acquisitions.
864864 L. Prior to the award of a contract to a supplier, the State
865865 Purchasing Director shall verify, pursuant to applicable provisions

892892 of law, that the supplier is eligible to do business in this st ate
893893 by confirming registration with the Secretary of State and franchise
894894 tax payment status pursuant to Sections 1203 and 1204 of Title 68 of
895895 the Oklahoma Statutes. The provisions o f this subsection shall be
896896 applicable only if the contract amount is Two H undred Fifty Thousand
897897 Dollars ($250,000.00) or greater.
898898 M. On an annual basis, the State Purchasing Director shall
899899 transmit to the Governor, Speaker of the House of Representatives
900900 and President Pro Tempore o f the Senate a report documenting the
901901 savings realized by each agency through the application of best
902902 spend practices including the collection and tracking of spend data,
903903 strategic sourcing programs and implementation of managed and
904904 mandatory statewide con tracts and include in the report information
905905 regarding emergency acquisitions.
906906 N. The acquisition threshold amount applicable to an
907907 acquisition made pursuant to this act or associated rules shall not
908908 apply to state agency purcha ses; provided, the State Pu rchasing
909909 Director determines the agency has sub ject matter experts on staff
910910 having the specialized expertise to purchase goods or services, the
911911 agency possesses the necessary legal and procurement staff to
912912 procure and monitor the contracts and provided the Director of the
913913 Office of Management and Enter prise Services Department of Central
914914 Services shall certify that the proposed purchase does not conflict
915915 with consolidated statewide spend initiatives.

942942 1. Nothing in this subsection shall give an agency authority to
943943 issue statewide, multis tate or multigovernmental contracts.
944944 2. Agencies making purchases pursuant to this subsection shall:
945945 a. be responsible for contracts awarded pursuant to this
946946 subsection, which includes, but may not be limited to,
947947 contract management, protest costs, all co sts
948948 connected with or incurred as a result of the
949949 contract, including legal representation,
950950 b. comply with rules and policies of the Office of
951951 Management and Enterprise Services Department of
952952 Central Services, and
953953 c. report contracts issued pursuant to this subsection to
954954 the Office of Management and Enterprise Services,
955955 Central Purchasing Division Department of Central
956956 Services, on a quarterly basis.
957957 3. Purchases made in accordance with this subsect ion shall be
958958 made pursuant to rules authorized by this section.
959959 O. The State Purchasing Director, with approval by the Director
960960 of the Office of Management and Enterprise Services Department of
961961 Central Services, is authorized to make use of any state
962962 laboratories for the tests and analyses authorized in this section
963963 wherever practicable and to use private laboratories or the
964964 laboratories of another gove rnment agency if it is impracticable to
965965 use state laboratories. The State Purchasing Director is further

993993 with other states or the United States government and to accept
994994 federal funds and funds donated by private endowments or foundations
995995 for the purpose of participation in such testing progr ams.
996996 SECTION 5. AMENDATORY 62 O.S. 2021, Section 34.3.1, is
997997 amended to read as follows:
998998 Section 34.3.1 A. The Department of Central Services, Office
999999 of Personnel Management, Oklahoma Stat e Employees Benefits Council
10001000 and the State and Education Employees Group Insurance Board are
10011001 consolidated into the Office of Management and Enterprise Services.
10021002 The Director of the Office of Management and Enterprise Services
10031003 shall assume all executive -level responsibilities for each agency
10041004 and shall function as and possess the powers of the agency director
10051005 for each consolidated agency as enumerated by existing statute. For
10061006 the purposes of this section the term "consolidated agencies " shall
10071007 mean the Department of Central Services, Office of Personnel
10081008 Management, Oklahoma State Employees Benefits Council and the State
10091009 and Education Employees Group Insurance Board. Any funds
10101010 appropriated to, in the possession of or allocated to any of the
10111011 consolidated agencies shall be deemed to be funds of the Office of
10121012 Management and Enterprise Services.
10131013 B. Upon request of the Direct or of the Office of Management and
10141014 Enterprise Services, the personnel of the consolidated agencies
10151015 shall deliver to the Office of Management and Enterprise Services

10441044 C. All functions, po wers, duties and obligations previously
10451045 assigned to each of the consolidated agencies are hereby transferred
10461046 to the Office of Management and Enterprise Services.
10471047 D. All rules, regulations, acts, orders, determinations and
10481048 decisions of the consolidated age ncies pertaining to the functions
10491049 and powers herein transferred and assigned to the Office of
10501050 Management and Enterprise Services, in force at the time of such
10511051 transfer, assignment, assumption or devolution shall continue in
10521052 force and effect as rules, regul ations, acts, orders, determinations
10531053 and decisions of the consolidated agencies until duly modified or
10541054 abrogated by the appropriate body or u ntil otherwise provided by
10551055 law.
10561056 SECTION 6. This act shall become effective November 1, 2023.
