4040 An Act relating to firearms; amending 21 O.S. 2021,
4141 Section 1277, which relates to the unlawful carry of
4242 firearms in certain places; removing references to
4343 federally owned buildings and properties; authorizing

5656 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5757 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1277, is
5858 amended to read as follows:
5959 Section 1277. A. It shall be unlawful for any person,
6060 including a person in possession of a valid handgun licens e issued
6161 pursuant to the provisions of the Oklahoma Self-Defense Act, to
6262 carry any concealed or unconceale d firearm into any of the follo wing

9090 1. Any structure, building, or office space which is owned or
9191 leased by a city, town, county , or state or federal governmental
9292 authority for the purpose of conducting business with the p ublic;
9393 2. Any courthouse, courtroom, prison, jail, deten tion facility
9494 or any facility used to process, hold or house arrested persons,
9595 prisoners or persons alleged delinquent or adjudicated delinquent,
9696 except as provided in Section 21 of Title 57 of the O klahoma
9797 Statutes;
9898 3. Any public or private elementary o r public or private
9999 secondary school, except as provided in subsections C and D of this
100100 section;
101101 4. Any publicly owned or operated sports arena or venue duri ng
102102 a professional sporting event, unless a llowed by the event holder;
103103 5. Any place where gambli ng is authorized by law, unless
104104 allowed by the property owner;
105105 6. Any other place specifically prohibited by law ; and
106106 7. Any property set aside by a county, c ity, town, public trust
107107 with a county, city or town as a beneficiary, or state governmental
108108 authority for an event that is secured with minimum -security
109109 provisions. For purposes of this paragraph, a minimum -security
110110 provision consists of a location that i s secured utilizing the
111111 following:
112112 a. a metallic-style security fence that is at least eight
113113 (8) feet in height that encompasses the property and

140140 is secured in such a way as to deter unauthorized
141141 entry,
142142 b. controlled access points staffed by a uniformed,
143143 commissioned peace officer, and
144144 c. a metal detector whereby persons walk or otherwise
145145 travel with their property through or by the metal
146146 detector.
147147 B. It shall be lawful for a person to carry a concealed or
148148 unconcealed firearm on the following properties:
149149 1. Any property set aside for the use or parking of any
150150 vehicle, whether attended or una ttended, by a city, town, county , or
151151 state or federal governmental authority;
152152 2. Any property set aside for the use or parking of any
153153 vehicle, whether attended or unat tended, which is open to the
154154 public, or by any entity engaged in gambling authorized by la w;
155155 3. Any property adjacent to a structure, building or office
156156 space in which concealed or unconcealed weapons are prohibited by
157157 the provisions of this section;
158158 4. Any property designated by a city, town, cou nty or state
159159 governmental authority as a par k, recreational area, wildlife
160160 refuge, wildlife management area or fairgrounds; provided, nothing
161161 in this paragraph shall be con strued to authorize any entry by a
162162 person in possession of a concealed or unconceale d firearm into any

189189 structure, building, office space or event which is specifically
190190 prohibited by the provisions of subsection A of this section;
191191 5. Any property set asid e by a public or private elementary or
192192 secondary school for the use or parking of an y vehicle, whether
193193 attended or unattended; provided, however, the firearm shall be
194194 stored and hidden from view in a locked motor vehicle when the motor
195195 vehicle is left unat tended on school property ; and
196196 6. Any public property set aside temporarily by a co unty, city,
197197 town, public trust with a coun ty, city or town as a beneficiary, or
198198 state governmental authority for the holder of an event permit that
199199 is without minimum-security provisions, as such term is defined i n
200200 paragraph 7 of subsection A of this secti on; provided, the carry of
201201 firearms within said permitted event area shall be limited to
202202 concealed carry of a handgun unless otherwise authorized by the
203203 holder of the event permit.
204204 Nothing contained in any provisi on of this subsection or
205205 subsection C of this section shall be construed to authoriz e or
206206 allow any person in control of any place described in subsection A
207207 of this section to establish any policy or rule that has th e effect
208208 of prohibiting any person in law ful possession of a handgun license
209209 or otherwise in lawful possession of a firearm f rom carrying or
210210 possessing the firearm on the property described in this subsection.
211211 C. A concealed or unconcealed weapon may be c arried onto
212212 private school property or in any school bus or vehicle used by any

239239 private school for transportation of student s or teachers by a
240240 person who is licensed pursuant to the Oklahoma Self -Defense Act,;
241241 provided, a policy has been adopted by the gov erning entity of the
242242 private school that authorizes the carrying and possession of a
243243 weapon on private school property or in a ny school bus or vehicle
244244 used by a private school . Except for acts of gross negligence or
245245 willful or wanton misconduct, a governi ng entity of a private school
246246 that adopts a policy which authorizes the possession of a weapon on
247247 private school property, a s chool bus or vehicle used by the private
248248 school shall not be subject to liability for any injuries arising
249249 from the adoption of th e policy. The provisions of this subsect ion
250250 shall not apply to claims pursuant to the Administrative Workers '
251251 Compensation Act.
252252 D. Notwithstanding paragraph 3 of subsection A of this section,
253253 a board of education of a school district may adopt a policy
254254 pursuant to Section 5 -149.2 of Title 70 of the Oklahoma Statutes to
255255 authorize the carrying of a handgun onto school property b y school
256256 personnel specifically designated by the board of education,
257257 provided such personnel either:
258258 1. Possess a valid armed sec urity guard license as provided for
259259 in Section 1750.1 et seq. of Title 59 of the Oklah oma Statutes; or
260260 2. Hold a valid reserve peace officer certification as provided
261261 for in Section 3311 of Title 70 of the Oklahoma Statutes.

288288 Nothing in this subsection sha ll be construed to restrict authority
289289 granted elsewhere in law to carry firearms.
290290 E. Notwithstanding the provisions of s ubsection A of this
291291 section, on any property designated as a municipal zoo or park of
292292 any size that is owned, leased, operated or manag ed by:
293293 1. A public trust created pursuan t to the provisions of Section
294294 176 of Title 60 of the Oklahoma Statutes; or
295295 2. A nonprofit entity,
296296 an individual shall be allowed to carry a concealed handgun but not
297297 openly carry a handgun on the property.
298298 F. Any person violating the provisions of parag raph 2 or 3 of
299299 subsection A of this section s hall, upon conviction, be guilt y of a
300300 misdemeanor punishable by a fine not to exceed Two Hundred Fifty
301301 Dollars ($250.00). A person violating any other provision of
302302 subsection A of this section may be denied ent rance onto the
303303 property or removed from the p roperty. If the person refuses to
304304 leave the property and a peace officer is summoned, the person may
305305 be issued a citation for an amount not to exceed Two Hundred Fifty
306306 Dollars ($250.00).
307307 G. No person in possession of a valid handgun license issued
308308 pursuant to the provisions of the Ok lahoma Self-Defense Act or who
309309 is carrying or in possession of a firearm as otherwise permitted by
310310 law or who is carrying or in possession o f a machete, blackjack,
311311 loaded cane, hand chain or metal knuckles shall be authorized to

338338 carry the firearm, machete, blackjack, loaded cane, hand chain or
339339 metal knuckles into or upon any college, university or technology
340340 center school property, except as p rovided in this subsection . For
341341 purposes of this subsection, the following property s hall not be
342342 construed to be college, university or technology center school
343343 property:
344344 1. Any property set aside for the use or parking of any motor
345345 vehicle, whether atte nded or unattended, provided the firearm,
346346 machete, blackjack, loaded cane, hand chain or metal knuckles are
347347 carried or stored as required by law and the firearm, machete,
348348 blackjack, loaded cane, hand chain or metal knuckles are not removed
349349 from the motor vehicle without the prior consent of the c ollege or
350350 university president or technology center school administrator w hile
351351 the vehicle is on any college, university or technology center
352352 school property;
353353 2. Any property authorized for possession or use of fir earms,
354354 machetes, blackjacks, loaded canes , hand chains or metal knuckles by
355355 college, university or technology cent er school policy; and
356356 3. Any property authorized by the written consent of the
357357 college or university president or technology center school
358358 administrator,; provided, the written consent is carried with the
359359 firearm, machete, blackj ack, loaded cane, hand chai n or metal
360360 knuckles and the valid handgun license while on college, university
361361 or technology center school property.

388388 The college, university or technology center school may notify
389389 the Oklahoma State Bureau of Investigation within ten (10) days of a
390390 violation of any provision of this subsection by a licensee . Upon
391391 receipt of a written notification of violation, the Bureau shall
392392 give a reasonable notice to the licensee and hold a heari ng. At the
393393 hearing, upon a determination that the licensee has violated any
394394 provision of this subsection, the licensee may be subject to an
395395 administrative fine of Two Hundred Fifty Dollars ($250.00) and may
396396 have the handgun license suspended for three (3) months.
397397 Nothing contained in any provision of this subsection shall be
398398 construed to authorize or allow any college, university or
399399 technology center school to establish any policy or rule that has
400400 the effect of prohibiting any person in lawful possession o f a
401401 handgun license or any person in lawful pos session of a firearm,
402402 machete, blackjack, loaded cane, hand chain or metal knuckles from
403403 possession of a firearm, machete, blackjack, loaded cane, hand chain
404404 or metal knuckles in places described in paragraphs 1, 2 and 3 of
405405 this subsection. Nothing contained in any provision of t his
406406 subsection shall be construed to limit the authority of any college,
407407 university or technology center school in this state from taking
408408 administrative action against any student for any violation of any
409409 provision of this subsecti on.
410410 H. The provisions of this section shall not apply to the
411411 following:

438438 1. Any peace officer or any person authorized by law to carry a
439439 firearm in the course of emplo yment;
440440 2. District judges, associate dis trict judges and special
441441 district judges, who a re in possession of a valid handgun license
442442 issued pursuant to the provisions of the Oklahoma Self -Defense Act
443443 and whose names appear on a list maintained by the Admini strative
444444 Director of the Courts, when act ing in the course and scope of
445445 employment within the courthouses of t his state;
446446 3. Private investigators with a firearms authorization when
447447 acting in the course and scope of employment;
448448 4. Elected officials of a c ounty, who are in possession of a
449449 valid handgun license issued pursuant to the provision s of the
450450 Oklahoma Self-Defense Act, may carry a concealed handgun when acting
451451 in the performance o f his or her duties within the courthouses of
452452 the county in which he o r she was elected. The provisions of thi s
453453 paragraph shall not allow the elected county official to carry th e
454454 handgun into a courtroom;
455455 5. The sheriff of any county may authorize certain employees of
456456 the county, who possess a valid handgun license issued pursuant to
457457 the provisions of the Oklahom a Self-Defense Act, to carry a
458458 concealed handgun when acting in the course and scope of employment
459459 within the courthouse in the county in which the person is employed .
460460 Nothing in the Oklahoma Self -Defense Act shall prohibit the sheriff
461461 from requiring additional instruction or training befor e granting

488488 authorization to carry a concealed handgun within the courthouse .
489489 The provisions of this paragraph and of paragraph 6 of this
490490 subsection shall not allow the county emp loyee to carry the handgun
491491 into a courtroom, sheriff's office, adult or juvenile jail or any
492492 other prisoner detention area; and
493493 6. The board of county commissioners of any county may
494494 authorize certain employees of the county, who possess a valid
495495 handgun license issued pursuant to the provisions of the Oklahoma
496496 Self-Defense Act, to carry a co ncealed handgun when acting in the
497497 course and scope of employment on county annex facilities or grounds
498498 surrounding the county courthouse.
499499 I. 1. Municipalities may authorize certain employees or public
500500 officials of the municipality, municipal public trust, or municipal
501501 authority, who possess a valid hand gun license issued pursuant to
502502 the provisions of the Oklahoma Self-Defense Act and who hav e
503503 successfully completed any additional training or requirements as
504504 established by ordinance or resolution to carry a concealed handgun
505505 when acting in the scope and course of employment.
506506 2. For purposes of this subsection, firearms may not be present
507507 in a location that is a firearm -prohibited location. As used in
508508 this paragraph, "firearm-prohibited locations " shall include the
509509 following locations:

536536 a. any room, location, or other place on muni cipally-
537537 owned, leased, or maintained property designated as a
538538 firearm-prohibited location by the municipality, and
539539 b. any police department, courthouse, courtroom, prison,
540540 jail, detention facility, or any facility used to
541541 process, hold, or house arrested p ersons, prisoners,
542542 or persons alleged delinquent or adjudica ted
543543 delinquent.
544544 3. Nothing in this section shall be construed as a mechanism to
545545 allow municipal employees to carry a firearm as a duty or function
546546 of their employment with the municipality, municipal public trust,
547547 or municipal authority.
548548 J. For the purposes of this section, "motor vehicle" means any
549549 automobile, truck, miniva n, sports utility vehicle, or motorcycle,
550550 as defined in Section 1 -135 of Title 47 of the Oklahoma Statutes,
551551 equipped with a locked accessory container within or affixed to the
552552 motorcycle.
553553 SECTION 2. This act shall become effective November 1, 2023.
