40	40	An Act relating to schools; defining terms;
41	41	prohibiting sensitive materials in the school
42	42	setting; requiring inclusion of certain parents when
43	43	determining if an instruction al material is sensitive
44	44	material; assigning training and reporting duties to
45	45	State Board of Education; authorizing promulgation of
46	46	rules; providing for codification; and providing an
47	47	effective date.

54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. NEW LAW A new section of law to be codified
56	56	in the Oklahoma Statutes as Section 11-106.2 of Title 70, unless
57	57	there is created a duplication in numbering, reads as follows:
58	58	A. As provided in this section:
59	59	1. "Instructional material " means a material, regardless of
60	60	format, used:
61	61	a. as or in place of textbooks to del iver curriculum for
62	62	courses of study by students , or
63	63	b. to support a student 's learning in the school setting.

90	90	Instructional material includes reading materials, handouts,
91	91	videos, digital materials, websites, online applications, and live
92	92	presentations;
93	93	2. "Governing board" means:
94	94	a. for a school district, the school district board of
95	95	education,
96	96	b. for a charter school or virtual charter school , the
97	97	charter school or virtual charter school governing
98	98	board, or
99	99	c. for the Oklahoma School for the Deaf and the Oklahoma
100	100	School for the Blind, the Department of Rehabilitation
101	101	Services;
102	102	3. "Minor" means any person who is younger than eighteen (18)
103	103	years of age;
104	104	4. "Public school" means a school district school, charter
105	105	school, virtual charter school , the Oklahoma School for the Deaf, or
106	106	the Oklahoma School for the Blind;
107	107	5. "School setting" means in a classroom, in a school library,
108	108	or on school property. School setting includes the following
109	109	activities that an organizatio n or individual or organization
110	110	outside of a public school conducts, if a public school sponsors or
111	111	requires the activity:
112	112	a. an assembly,
113	113	b. a guest lecture,

141	141	d. an event; and
142	142	6. "Sensitive material" means an instructional mater ial that is
143	143	child pornography or obscene material as both are defined in Section
144	144	1024.1 of Title 21 of the Oklahoma Statutes. Sensitive material
145	145	shall not include instructional material:
146	146	a. for medical courses,
147	147	b. for family and consumer sc ience courses, or
148	148	c. for another course the State Board of Education
149	149	exempts by rule.
150	150	B. Sensitive materials shall be prohibited in the school
151	151	setting. A public school shall not:
152	152	1. Adopt, use, distribute, provide a student access to, or
153	153	maintain in the school setting, sensitive materials; or
154	154	2. Permit a speaker or presenter in the school setting to
155	155	display or distribute sensitive materials.
156	156	C. A governing board shall include parents who are reflective
157	157	of the members of the school 's community when determining if an
158	158	instructional material is sensitive mater ial.
159	159	D. The State Board of Education shall:
160	160	1. Provide guidance and training to support public schools in
161	161	identifying instructional materials ; and

188	188	2. Report to the Speaker of the House of Representatives and
189	189	the President Pro Tempore of the Senate, on or before February 1,
190	190	2024, on implementation and compliance with this section, including:
191	191	a. any policy the Board or a governing board adopts to
192	192	implement or comply with this section,
193	193	b. any rule the Board promulgates to implement or comply
194	194	with this section, and
195	195	c. any complaints a governing board or the Board receives
196	196	regarding a violation of this section, including:
197	197	(1) action taken in response to a complaint , and
198	198	(2) if a governing board retains an instructional
199	199	material for which the governing board or the
200	200	Board receives a complaint, the rationale for
201	201	retaining the instructional material .
202	202	E. The Board may promulgate rules to implement the provisions
203	203	of this section.
204	204	SECTION 2. This act shall become effective November 1, 2023.
