4040 An Act relating to schools; defining terms;
4141 prohibiting sensitive materials in the school
4242 setting; requiring inclusion of certain parents when
4343 determining if an instruction al material is sensitive
4444 material; assigning training and reporting duties to
4545 State Board of Education; authorizing promulgation of
4646 rules; providing for codification; and providing an

5454 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5555 SECTION 1. NEW LAW A new section of law to be codified
5656 in the Oklahoma Statutes as Section 11-106.2 of Title 70, unless
5757 there is created a duplication in numbering, reads as follows:
5858 A. As provided in this section:
5959 1. "Instructional material " means a material, regardless of
6060 format, used:
6161 a. as or in place of textbooks to del iver curriculum for
6262 courses of study by students , or
6363 b. to support a student 's learning in the school setting.

9090 Instructional material includes reading materials, handouts,
9191 videos, digital materials, websites, online applications, and live
9292 presentations;
9393 2. "Governing board" means:
9494 a. for a school district, the school district board of
9595 education,
9696 b. for a charter school or virtual charter school , the
9797 charter school or virtual charter school governing
9898 board, or
9999 c. for the Oklahoma School for the Deaf and the Oklahoma
100100 School for the Blind, the Department of Rehabilitation
101101 Services;
102102 3. "Minor" means any person who is younger than eighteen (18)
103103 years of age;
104104 4. "Public school" means a school district school, charter
105105 school, virtual charter school , the Oklahoma School for the Deaf, or
106106 the Oklahoma School for the Blind;
107107 5. "School setting" means in a classroom, in a school library,
108108 or on school property. School setting includes the following
109109 activities that an organizatio n or individual or organization
110110 outside of a public school conducts, if a public school sponsors or
111111 requires the activity:
112112 a. an assembly,
113113 b. a guest lecture,

140140 c. a live presentation, or
141141 d. an event; and
142142 6. "Sensitive material" means an instructional mater ial that is
143143 child pornography or obscene material as both are defined in Section
144144 1024.1 of Title 21 of the Oklahoma Statutes. Sensitive material
145145 shall not include instructional material:
146146 a. for medical courses,
147147 b. for family and consumer sc ience courses, or
148148 c. for another course the State Board of Education
149149 exempts by rule.
150150 B. Sensitive materials shall be prohibited in the school
151151 setting. A public school shall not:
152152 1. Adopt, use, distribute, provide a student access to, or
153153 maintain in the school setting, sensitive materials; or
154154 2. Permit a speaker or presenter in the school setting to
155155 display or distribute sensitive materials.
156156 C. A governing board shall include parents who are reflective
157157 of the members of the school 's community when determining if an
158158 instructional material is sensitive mater ial.
159159 D. The State Board of Education shall:
160160 1. Provide guidance and training to support public schools in
161161 identifying instructional materials ; and

188188 2. Report to the Speaker of the House of Representatives and
189189 the President Pro Tempore of the Senate, on or before February 1,
190190 2024, on implementation and compliance with this section, including:
191191 a. any policy the Board or a governing board adopts to
192192 implement or comply with this section,
193193 b. any rule the Board promulgates to implement or comply
194194 with this section, and
195195 c. any complaints a governing board or the Board receives
196196 regarding a violation of this section, including:
197197 (1) action taken in response to a complaint , and
198198 (2) if a governing board retains an instructional
199199 material for which the governing board or the
200200 Board receives a complaint, the rationale for
201201 retaining the instructional material .
202202 E. The Board may promulgate rules to implement the provisions
203203 of this section.
204204 SECTION 2. This act shall become effective November 1, 2023.
