1616 An Act relating to teacher certification; requiring

2222 prescribing frequency of meetings; set ting meeting

2525 Council; subjecting Council to the Oklahoma Open
2626 Meeting Act and Oklahoma Open Records Act; providing
2727 exemption from dual office-holding prohibitions;

3434 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
3535 SECTION 1. NEW LAW A new section of law to be codified
3636 in the Oklahoma Statutes as Section 6 -188.1 of Title 70, unless
3737 there is created a duplication in numberi ng, reads as follows:
3838 The State Department of Education shall develop a syst em to code
3939 initial teacher certificatio n in order to report data on the
4040 pathways for initial teacher certification, inclu ding emergency
4141 certification and full-time adjunct certification. Req. No. 6652 Page 2
4242 SECTION 2. NEW LAW A new section of law to be codified
4343 in the Oklahoma Statutes a s Section 6-188.2 of Title 70, unless
4444 there is created a duplication in numbering, reads as follows:
4545 A. There is hereby created the Data Governance Council.
4646 B. The Council shall:
4747 1. Monitor and evaluate the impact of each teacher
4848 certification pathway, including emergency certification and full-
4949 time adjunct certification, as reported by the State Department of
5050 Education pursuant to Section 1 of this act, on education outcomes
5151 in the state;
5252 2. Identify essential data e lements indicative of teache r
5353 workforce quality and ensure these element s are appropriately
5454 defined and standardized for acceptable uses across certification
5555 pathways; and
5656 3. Establish best practices in data management and storage
5757 processes to ensure security, privacy, and appropriate integration.
5858 C. The Council shall be c omprised of thirteen (13) members as
5959 follows:
6060 1. The Chancellor of the Oklahoma State Regents for Higher
6161 Education, or designee;
6262 2. The State Superintendent of Public Instruction, or d esignee;
6363 3. The Secretary of Education, or designee;
6464 4. The Executive Director of the Office of Educational Quality
6565 and Accountability, or designee; Req. No. 6652 Page 3
6666 5. One member who is an empl oyee of the State Department of
6767 Education, designated by the State Superinte ndent of Public
6868 Instruction;
6969 6. One member who is part of an organiza tion or association
7070 representing school district boards of education in the state,
7171 appointed by the Speaker of the Oklahoma House of Representatives;
7272 7. One member who is part of an org anization or association
7373 representing school administrators in the sta te, appointed by the
7474 President Pro Tempore of the Oklahoma State Senate;
7575 8. One member who is an elementary o r secondary public school
7676 teacher in the state, appointed by the Governor; a nd
7777 9. Five members representing deans, directors, or coordinators
7878 from accredited, university-based educator preparation programs in
7979 the state, appointed as follows:
8080 a. two members appointed by the Speaker of the Oklahoma
8181 House of Representatives,
8282 b. two members appointed by the P resident Pro Tempore of
8383 the Oklahoma State S enate, and
8484 c. one member appointed by the Governor.
8585 D. Appointments to the Council shall be made by no later than
8686 December 1, 2023. The first meeting of the Council shall be called
8787 by the State Superintendent of Public Instruction no later than
8888 February 1, 2024. At the first meeting, the mem bers of the Council
8989 shall elect a chair and vice -chair from among the m embers. Meetings Req. No. 6652 Page 4
9090 of the Council shall be held at least quarterly at the cal l of the
9191 chair. Members shall serve at the pleasure of their appointi ng
9292 authorities. A majority of the memb ers of the Council shall
9393 constitute a quorum to transact business, but no vacancy shall
9494 impair the right of the remaining members to exercise all o f the
9595 powers of the Counci l. A vacancy on the Council shall be filled by
9696 the original appointing authority. The State Department of
9797 Education, Office of Educational Quality and A ccountability, and the
9898 Oklahoma State Regents for Higher Education shall pro vide staff,
9999 support, and information as requested by the Council.
100100 E. Members of the Council shall receive no compensation for
101101 serving on the Council.
102102 F. The Council shall act in accordance with the provisions of
103103 the Oklahoma Open Meeting Act and the Okla homa Open Records Act.
104104 G. Members who serve on the Council shall be e xempt from the
105105 dual office-holding prohibitions of Section 6 of Title 51 of the
106106 Oklahoma Statutes.
107107 SECTION 3. This act shall become effective November 1, 202 3.
