4040 An Act relating to medical marijuana; directing

5656 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5757 SECTION 1. NEW LAW A new section of law to be codified
5858 in the Oklahoma Statutes as Section 427.26 of Title 12A, unless
5959 there is created a duplication in numbering, reads as follows:
6060 A. Upon the effective date of this act an d annually thereafter,
6161 every licensed medical marijuana commercial grower and medical
6262 marijuana processor in this state shall pay to the Oklahoma Medical
6363 Marijuana Authority an environmental cleanup fee of One Thousand
6464 Dollars ($1,000.00).

9191 B. The fee imposed pursuant to the provisions of this section
9292 shall be used for those expenses incurred by counties in the
9393 investigation, evaluation, monitoring, testing, removal,
9494 containment, treatment, disposal, remediation, detoxification or
9595 neutralization of smoke, soot, fumes, acids, alkalis, t oxic
9696 chemicals, asbestos, liquids or gases, waste materia ls or other
9797 irritants, contaminants or pollutants as a direct result of a
9898 pollution incident caused by a medical marijuana commercial grower
9999 or medical marijuana processor .
100100 C. Payment of the annual fee required by this section shall be
101101 due no later than the last day of the month of expiration of the
102102 current medical marijuana business license.
103103 D. All fees received by the Authority pursuant to the
104104 provisions of this se ction shall be credited to the County
105105 Environmental Cleanup Revolving Fund created in subsection E of this
106106 section.
107107 E. There is hereby created in the State Treasury a revolving
108108 fund for the Oklahoma Medical Marijuana Authority to be designated
109109 the "County Environmental Cleanu p Revolving Fund". The fund shall
110110 be a continuing fund, not subject to fiscal year limitatio ns, and
111111 shall consist of all fees collected by the Oklahoma Medical
112112 Marijuana Authority pursuant to the provisions of subsection A of
113113 this section. All monies accruing to the credi t of the fund are
114114 hereby appropriated and may be bu dgeted and expended by the Oklahoma

141141 Medical Marijuana Authority for the purpose s of providing financial
142142 assistance and support to any county of the state that is responding
143143 to an environmental pollution incident caused by a medical marijuana
144144 commercial grower or medical marijuana processor . Expenditures from
145145 the fund shall be made upon warrants issued by the State Treasurer
146146 against claims filed as prescribed by law with the Director of the
147147 Office of Management and Enterprise Services for approval and
148148 payment.
149149 SECTION 2. This act shall become effective November 1, 2023.
