40	40	An Act relating to medical marijuana; directing
41	41	certain medical marijuana business licens ees to pay
42	42	an environmental cleanup fee; stating amount of fee;
43	43	stating purpose of fee; requiring payment of fee by
44	44	certain date; requiring fees collected to be credited
45	45	to certain revolving fund; creating the County
46	46	Environmental Cleanup Revolving Fund; providing
47	47	sources of funds; providing for use of funds;
48	48	prescribing procedures for expenditures; providing
49	49	for codification; and providing an effective date.

56	56	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
57	57	SECTION 1. NEW LAW A new section of law to be codified
58	58	in the Oklahoma Statutes as Section 427.26 of Title 12A, unless
59	59	there is created a duplication in numbering, reads as follows:
60	60	A. Upon the effective date of this act an d annually thereafter,
61	61	every licensed medical marijuana commercial grower and medical
62	62	marijuana processor in this state shall pay to the Oklahoma Medical
63	63	Marijuana Authority an environmental cleanup fee of One Thousand
64	64	Dollars ($1,000.00).

91	91	B. The fee imposed pursuant to the provisions of this section
92	92	shall be used for those expenses incurred by counties in the
93	93	investigation, evaluation, monitoring, testing, removal,
94	94	containment, treatment, disposal, remediation, detoxification or
95	95	neutralization of smoke, soot, fumes, acids, alkalis, t oxic
96	96	chemicals, asbestos, liquids or gases, waste materia ls or other
97	97	irritants, contaminants or pollutants as a direct result of a
98	98	pollution incident caused by a medical marijuana commercial grower
99	99	or medical marijuana processor .
100	100	C. Payment of the annual fee required by this section shall be
101	101	due no later than the last day of the month of expiration of the
102	102	current medical marijuana business license.
103	103	D. All fees received by the Authority pursuant to the
104	104	provisions of this se ction shall be credited to the County
105	105	Environmental Cleanup Revolving Fund created in subsection E of this
106	106	section.
107	107	E. There is hereby created in the State Treasury a revolving
108	108	fund for the Oklahoma Medical Marijuana Authority to be designated
109	109	the "County Environmental Cleanu p Revolving Fund". The fund shall
110	110	be a continuing fund, not subject to fiscal year limitatio ns, and
111	111	shall consist of all fees collected by the Oklahoma Medical
112	112	Marijuana Authority pursuant to the provisions of subsection A of
113	113	this section. All monies accruing to the credi t of the fund are
114	114	hereby appropriated and may be bu dgeted and expended by the Oklahoma

141	141	Medical Marijuana Authority for the purpose s of providing financial
142	142	assistance and support to any county of the state that is responding
143	143	to an environmental pollution incident caused by a medical marijuana
144	144	commercial grower or medical marijuana processor . Expenditures from
145	145	the fund shall be made upon warrants issued by the State Treasurer
146	146	against claims filed as prescribed by law with the Director of the
147	147	Office of Management and Enterprise Services for approval and
148	148	payment.
149	149	SECTION 2. This act shall become effective November 1, 2023.
