4040 An Act relating to counties; directing that count ies

4242 directing that counties shall provide certain
4343 utilities; placing limitations; exempting certain
4444 properties; providing for codification; and providing
4545 an effective date.

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. NEW LAW A new se ction of law to be codified
5252 in the Oklahoma Statutes as Section 440 of Title 19, unless there is
5353 created a duplication in numbering, reads as follows:
5454 A. It shall be the duty of the board of county commissioners of
5555 each county, with regard to the premises of county property under
5656 their respective juri sdictions or the premises of prop erty leased by
5757 them in whole or in part, to give priority to vending facilities
5858 operated by business entities whose majority equity ownership is
5959 owned by one or more veterans . Proof of veteran status and business
6060 ownership shall be provided to the board of county commissioners.
6161 B. Counties shall make available free of any charge, fee,
6262 assessment, or commission on sales adequate space with sufficient

8989 electrical, plumbing, heati ng, and ventilation outlets for the
9090 operation of a vending facility on satisfac tory sites. Counties
9191 shall provide free of any charge, fee, assessment , or commission on
9292 sales of the use of utilities needed to operate a vending facility.
9393 C. The provisions of this section shall not apply to the
9494 operation of fairgrounds, exposition centers , trade/consumer show
9595 facilities, parks, golf courses, hospitals operated by county trust
9696 authorities, or commissaries for the benefit of persons lawfully
9797 confined in the county jail under the custody of the county sheriff.
9898 D. The provisions of this section shall not prohibit counties
9999 from deciding to grant licensed blind operators priority p ursuant to
100100 Section 73 of Title 7 of the Oklahoma Statutes .
101101 SECTION 2. This act shall become effective November 1, 2023.
