65	54		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
66	55		SECTION 1. AMENDATORY 15 O.S. 2021, Section 777.4, is
67	56		amended to read as follows:
68	57		Section 777.4 A. No person for the duration of a declaration
69	58		of emergency by the Governo r of this state or by the President of
70	59		the United States and for thirty (30) days t hereafter shall sell,
	60	+	rent, or lease, or offer to sell, re nt, or lease, for delivery in
	61	+	the emergency area, any goods, s ervices, dwelling units, or storage
	62	+	space in the emergency area at a rate or price which is more than
	63	+	ten percent (10%) above the rate o r price charged by th e person for
	64	+	the same or similar good s, services, dwelling unit s, or storage

99		-	the emergency area, any goods, s ervices, dwelling units, or storage

104	92		increase in the rate or price is attributable to:
105	93		1. To price Price increases in applicab le regional, national or
106	94		international petroleum and natural gas or other commodity markets;

108	96		2. Only to factors Factors unrelated to the emergency a nd does
109	97		not include any increase in p rofit to the seller or owner.
110	98		As used in this section, the term "commodity markets" shall
111	99		refer to marketplaces for buying, selling, or tradi ng raw materials,
112	100		products, or resources, incl uding, but not limited to, petroleum and
113	101		natural gas products, raw or processed food products, and natural
114	102		resources.
115	103		B. Upon the expiration of t he period described in s ubsection A
116	104		of this section and for one hundred eigh ty (180) days thereafter, no
117	105		person shall, within the emergency ar ea, rent or lease or o ffer to
118	106		rent or lease any dwelling unit or storage space or sell or offer to
119	107		sell goods for use within the emergency area to repair, rest ore,
120	108		remodel, or construct any dwelling unit for a price of more than ten
121	109		percent (10%) above the price charged by that person for the
	110	+	dwelling unit, storage space, or goods immediately prior to the
	111	+	declaration of emergency unless the increase in the price is
	112	+	attributable to:

149		-	dwelling unit, storage space, or goods immediately prior to the
150		-	declaration of emergency unless the increase in the price is
151		-	attributable to:
152	139		1. Price increases in applicable regional, national, or
153	140		international petroleum and natural gas or other commodity markets;
154	141		or
155	142		2. Factors unrelated to the emergency and does not include any
156	143		increase in profit to t he seller or owner.
157	144		C. A rate or price increase approved by the appropri ate
158	145		governmental agency is not a violation o f this act.
159	146		D. This section shall not apply to growers, producers, or
160	147		processors of raw or processed food products, except for retail
161	148		sales of such products to a consumer.
162	149		E. This section shall not apply to sal es, rentals, or leases of
163	150		goods from a catalog when the catalog is made available in the
164	151		normal course of business both prior to and after the declaration of
165	152		emergency to all persons regardless of location in the emerge ncy
166	153		area.
167	154		F. This section shall not apply to advertised rates and prices
168	155		which are subject to a published expiration d ate within or
169	156		immediately prior to the declaration of emergency.
170	157		G. This section shall not apply t o the resale of goods, as long
171	158		as the price increase of the goods for resal e is not more than ten
172	159		percent (10%) above t he acquisition cost of the goods for r esale.
	160	+	SECTION 2. This act shall become effective November 1, 2023.
