54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. AMENDATORY 47 O.S. 2021, Section 11 -202, is
56	56	amended to read as follows:
57	57	Whenever traffic is controlled b y traffic-control signals
58	58	exhibiting different colored lights or colored lighted arrows
59	59	successively one at a time, or in combination, only the colors
60	60	green, red and yellow shall be used, except for special pedestrian
61	61	signals carrying a word legend, and the lights shall indicate and
62	62	apply to drivers of vehicle s and pedestrians as follows:

90	90	a. vehicular traffic facing a circular green signal,
91	91	except when prohibited under Section 11 -1302 of this
92	92	title, may proceed straight through or turn right or
93	93	left unless a sign at such place prohibits ei ther such
94	94	turn. But vehicular traffic, including vehicles
95	95	turning right or left, shall yield the right -of-way to
96	96	other vehicles and to pedestrians lawfully within the
97	97	intersection or an adjacent crosswalk at the time such
98	98	signal is exhibited,
99	99	b. vehicular traffic facing a green arrow signal, s hown
100	100	alone or in combination with another indication, may
101	101	cautiously enter the inter section only to make the
102	102	movement indicated by such arrow, or such other
103	103	movement as is permitted by other in dications shown at
104	104	the same time. Such vehicular traffic shall yield the
105	105	right-of-way to pedestrians lawfully within an
106	106	adjacent crosswalk and to other traffic lawfully using
107	107	the intersection, and
108	108	c. unless otherwise directed by a pedestrian -control
109	109	signal, as provided in Sectio n 11-203 of this title,
110	110	pedestrians facing any green signal, except when the
111	111	sole green signal is a turn arrow, may proceed across
112	112	the roadway within any marked or unmarked crosswalk;

140	140	a. vehicular traffic facing a steady circu lar yellow or
141	141	yellow arrow signal is th ereby warned that the related
142	142	green movement is being terminated or that a red
143	143	indication will be exhibited immediately thereafter,
144	144	and
145	145	b. pedestrians facing a steady circular yellow or yellow
146	146	arrow signal, unless oth erwise directed by a
147	147	pedestrian-control signal as provided in Section 11 -
148	148	203 of this title, are thereby advised that there is
149	149	insufficient time to cross the roadway before a red
150	150	indication is shown, and no pedestrian shall then
151	151	start to cross the roadway; and
152	152	3. Steady red indication:
153	153	a. vehicular traffic facing a steady circular red signal
154	154	alone shall stop at a clearly marke d stop line, but if
155	155	none, before entering the crosswalk on the near side
156	156	of the intersection or, if none, the n before entering
157	157	the intersection and shall remain standing un til an
158	158	indication to proceed is shown except as provided in
159	159	subparagraphs b and, d and f of this paragraph,
160	160	b. except when a sign is in place prohibiting a turn,
161	161	vehicular traffic facing any st eady red signal may
162	162	cautiously enter the intersection to turn r ight or to
163	163	turn left from a one -way street into a one -way street

191	191	paragraph. Such vehicular traffic shall yield the
192	192	right-of-way to pedestrians lawfully within an
193	193	adjacent crosswalk and to other traffic lawfully using
194	194	the intersection,
195	195	c. in order to prohibit right turns or left turns as
196	196	prescribed in subparagraph b of this paragraph, on the
197	197	red signal after the required stop, a municipality
198	198	must erect clear, concise signs informing drivers that
199	199	such turns are prohibited. The Highway Department
200	200	shall specify the design of the sign to be used f or
201	201	this purpose, and it shall be used uniformly
202	202	throughout the state,
203	203	d. notwithstanding any other pro vision of law, the drive r
204	204	of a motorcycle facing any steady red signal may
205	205	cautiously proceed through the intersection only if:
206	206	(1) the motorcycle has been brought to a complete
207	207	stop as required by subparagraph a of this
208	208	paragraph,
209	209	(2) the traffic-control signal is programmed or
210	210	engineered to change to a green signal only after
211	211	detecting the approach of a motor vehicle and has
212	212	failed to detect the arrival o f the motorcycle
213	213	because of its size or weight, and

241	241	roadway to be crossed or entered, or the motor
242	242	vehicle or person is at a distance from the
243	243	intersection that does not constitute an
244	244	immediate hazard.
245	245	The driver of any vehicle approaching the
246	246	intersection, which lawfully may enter the
247	247	intersection, shall have the right-of-way over any
248	248	motorcycle operator proceeding through a red light
249	249	and, in no event where an accident results from the
250	250	driver of the motorcycle proceeding into the
251	251	intersection on a red light, shall such driver of the
252	252	vehicle be charged wi th any violation pursuan t to
253	253	Sections 11-401 and 11-403 of this title relating to
254	254	failure to yield right -of-way, Section 11-310 of this
255	255	title relating to following too closely, or Section
256	256	11-801 of this title relating to driving too fast for
257	257	conditions, and
258	258	e. unless otherwise directed by a pedestrian -control
259	259	signal as provided in Section 11 -203 of this title,
260	260	pedestrians facing a steady circular red signal alone
261	261	shall not enter the roadway.
262	262	f. between the hours of 10:00 p.m. to 6:00 a.m., the
263	263	driver of a motor vehicle facing any steady red signal

295	295	(2) no motor vehicle or person is approaching on the
296	296	roadway to be crossed o r entered, or the motor
297	297	vehicle or person is at a distance from the
298	298	intersection that does not constitute an
299	299	immediate hazard.
300	300	The driver of any vehicle approaching the
301	301	intersection, which lawfully may enter the
302	302	intersection, shall have the right-of-way over any

339	339	In the event an official traffic -control signal is erected and
340	340	maintained at a place othe r than an intersection, the provisions of
341	341	this section shall be applicable except as to tho se provisions which
342	342	by their nature can have no application. Any stop required shall be
343	343	made at a sign or marking on the pavement indicating where the stop
344	344	shall be made, but in the absence of any such sign or marking the
345	345	stop shall be made at the signal.
346	346	SECTION 2. This act shall become effective November 1, 2023.
