4040 An Act relating to motor vehicles; amending 47 O.S.
4141 2021, Section 11-202, which relates to traffic -
4242 control signals; modifying internal st atutory
4343 references; establishing condi tions under which motor

4646 operators may not have a defense for certain

5454 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5555 SECTION 1. AMENDATORY 47 O.S. 2021, Section 11 -202, is
5656 amended to read as follows:
5757 Whenever traffic is controlled b y traffic-control signals
5858 exhibiting different colored lights or colored lighted arrows
5959 successively one at a time, or in combination, only the colors
6060 green, red and yellow shall be used, except for special pedestrian
6161 signals carrying a word legend, and the lights shall indicate and
6262 apply to drivers of vehicle s and pedestrians as follows:

9090 a. vehicular traffic facing a circular green signal,
9191 except when prohibited under Section 11 -1302 of this
9292 title, may proceed straight through or turn right or
9393 left unless a sign at such place prohibits ei ther such
9494 turn. But vehicular traffic, including vehicles
9595 turning right or left, shall yield the right -of-way to
9696 other vehicles and to pedestrians lawfully within the
9797 intersection or an adjacent crosswalk at the time such
9898 signal is exhibited,
9999 b. vehicular traffic facing a green arrow signal, s hown
100100 alone or in combination with another indication, may
101101 cautiously enter the inter section only to make the
102102 movement indicated by such arrow, or such other
103103 movement as is permitted by other in dications shown at
104104 the same time. Such vehicular traffic shall yield the
105105 right-of-way to pedestrians lawfully within an
106106 adjacent crosswalk and to other traffic lawfully using
107107 the intersection, and
108108 c. unless otherwise directed by a pedestrian -control
109109 signal, as provided in Sectio n 11-203 of this title,
110110 pedestrians facing any green signal, except when the
111111 sole green signal is a turn arrow, may proceed across
112112 the roadway within any marked or unmarked crosswalk;

140140 a. vehicular traffic facing a steady circu lar yellow or
141141 yellow arrow signal is th ereby warned that the related
142142 green movement is being terminated or that a red
143143 indication will be exhibited immediately thereafter,
144144 and
145145 b. pedestrians facing a steady circular yellow or yellow
146146 arrow signal, unless oth erwise directed by a
147147 pedestrian-control signal as provided in Section 11 -
148148 203 of this title, are thereby advised that there is
149149 insufficient time to cross the roadway before a red
150150 indication is shown, and no pedestrian shall then
151151 start to cross the roadway; and
152152 3. Steady red indication:
153153 a. vehicular traffic facing a steady circular red signal
154154 alone shall stop at a clearly marke d stop line, but if
155155 none, before entering the crosswalk on the near side
156156 of the intersection or, if none, the n before entering
157157 the intersection and shall remain standing un til an
158158 indication to proceed is shown except as provided in
159159 subparagraphs b and, d and f of this paragraph,
160160 b. except when a sign is in place prohibiting a turn,
161161 vehicular traffic facing any st eady red signal may
162162 cautiously enter the intersection to turn r ight or to

190190 after stopping as required by subparagraph a of this
191191 paragraph. Such vehicular traffic shall yield the
192192 right-of-way to pedestrians lawfully within an
193193 adjacent crosswalk and to other traffic lawfully using
194194 the intersection,
195195 c. in order to prohibit right turns or left turns as
196196 prescribed in subparagraph b of this paragraph, on the
197197 red signal after the required stop, a municipality
198198 must erect clear, concise signs informing drivers that
199199 such turns are prohibited. The Highway Department
200200 shall specify the design of the sign to be used f or
201201 this purpose, and it shall be used uniformly
202202 throughout the state,
203203 d. notwithstanding any other pro vision of law, the drive r
204204 of a motorcycle facing any steady red signal may
205205 cautiously proceed through the intersection only if:
206206 (1) the motorcycle has been brought to a complete
207207 stop as required by subparagraph a of this
208208 paragraph,
209209 (2) the traffic-control signal is programmed or
210210 engineered to change to a green signal only after
211211 detecting the approach of a motor vehicle and has
212212 failed to detect the arrival o f the motorcycle
213213 because of its size or weight, and

240240 (3) no motor vehicle or person is approaching on t he
241241 roadway to be crossed or entered, or the motor
242242 vehicle or person is at a distance from the
243243 intersection that does not constitute an
244244 immediate hazard.
245245 The driver of any vehicle approaching the
246246 intersection, which lawfully may enter the
247247 intersection, shall have the right-of-way over any
248248 motorcycle operator proceeding through a red light
249249 and, in no event where an accident results from the
250250 driver of the motorcycle proceeding into the
251251 intersection on a red light, shall such driver of the
252252 vehicle be charged wi th any violation pursuan t to
253253 Sections 11-401 and 11-403 of this title relating to
254254 failure to yield right -of-way, Section 11-310 of this
255255 title relating to following too closely, or Section
256256 11-801 of this title relating to driving too fast for
257257 conditions, and
258258 e. unless otherwise directed by a pedestrian -control
259259 signal as provided in Section 11 -203 of this title,
260260 pedestrians facing a steady circular red signal alone
261261 shall not enter the roadway.
262262 f. between the hours of 10:00 p.m. to 6:00 a.m., the
263263 driver of a motor vehicle facing any steady red signal

290290 may cautiously proceed through the intersection only
291291 if:
292292 (1) the vehicle has been brought to a complete stop
293293 as required by subparagraph a of this paragraph,
294294 and
295295 (2) no motor vehicle or person is approaching on the
296296 roadway to be crossed o r entered, or the motor
297297 vehicle or person is at a distance from the
298298 intersection that does not constitute an
299299 immediate hazard.
300300 The driver of any vehicle approaching the
301301 intersection, which lawfully may enter the
302302 intersection, shall have the right-of-way over any
303303 motor vehicle operator proceeding through a red light
304304 and, in no event where an accident results from the
305305 driver of the motor vehicle proceeding into the
306306 intersection on a red light, shall such driver of the

339339 In the event an official traffic -control signal is erected and
340340 maintained at a place othe r than an intersection, the provisions of
341341 this section shall be applicable except as to tho se provisions which
342342 by their nature can have no application. Any stop required shall be
343343 made at a sign or marking on the pavement indicating where the stop
344344 shall be made, but in the absence of any such sign or marking the
345345 stop shall be made at the signal.
346346 SECTION 2. This act shall become effective November 1, 2023.
