56	56	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
57	57	SECTION 1. AMENDATORY 74 O.S. 2021, Section 2203, is
58	58	amended to read as follows:
59	59	Section 2203. A. The Oklahoma Tourism and Recreation
60	60	Commission shall be an advisory body to the Executive Director of
61	61	the Oklahoma Tourism and Recreation Department and shall consist of
62	62	eight (8) members who shall serve a term of six (6) years.
63	63	Effective January 14, 2019, all duties and powers of the Commission
64	64	shall be transferred to the Executive Director. Any provision in
65	65	statute that provides to the Commission authority that is not

92	92	advisory in nature sha ll be deemed to grant the duty or power to the
93	93	Executive Director. No more than one Commission member shall be
94	94	from any one county. The Lieutenant Governor shall serv e as an ex
95	95	officio voting member of the Commission.
96	96	B. One member shall be appointed fr om each congressional
97	97	district, who shall be a resident and a qualified elector in the
98	98	district from which appointed, and the remaining members shall be
99	99	appointed from the state at large. If congressional districts are
100	100	redrawn each member appointed shall complete the current term of
101	101	office at which time a new app ointment shall be made in compliance
102	102	with the redrawn congressional district.
103	103	C. Commission members shall be appointed by the Governor, with
104	104	the advice and consent of the Senate , and shall serve at the
105	105	pleasure of the Governor . Commission members shall only be removed
106	106	from the Board by the Governor with cause. Whenever a vacancy on
107	107	the Commission occurs by dea th, resignation, or otherwise, the
108	108	Governor shall fill the same by appointment, with the advice and
109	109	consent of the Senate, and the appointee shall hold office during
110	110	the unexpired term. Each member shall hold office until a successor
111	111	has been appointed an d qualified. Five members of the Commission
112	112	shall constitute a quorum, and the vote of the majority of members
113	113	present shall be necessary for any action to be taken by the
114	114	Commission. No vacancy in the membership of the Commission shall

141	141	impair the rights of a quorum to exercise and perform all the rights
142	142	and duties of the Commission.
143	143	D. With the exception of the ex officio, no member of the
144	144	Commission shall seek election to a federal, state, or county office
145	145	while serving on the Commission.
146	146	E. Each member of the Commission, before serving on the
147	147	Commission, shall take and subscribe to the constitutional and
148	148	statutory oaths of office and file said oaths with the Secretary of
149	149	State. Members of the Commission shall be reimbursed for travel
150	150	expenses to Commission meetings as provided in the State Travel
151	151	Reimbursement Act.
152	152	F. The Commission shall be organized by the Governor , who shall
153	153	appoint from the Commission the chair, the vice-chair, and the
154	154	secretary. The Commission is authorized and directed to adop t rules
155	155	pursuant to the provisions of the Administrativ e Procedures Act to
156	156	execute the powers and duties of the Commission and Department.
157	157	G. The Commission may meet monthly and shall meet at least
158	158	quarterly. The Commission may meet at such other times a s it deems
159	159	necessary for effectively performing its du ties and
160	160	responsibilities. Special meetings may be called by the Chair or by
161	161	any three members of the Commission. The meetings of the Commission
162	162	shall be subject to the Oklahoma Open Meeting Act.
163	163	H. The Commission is hereby declared to be a governmenta l
164	164	agency and instrumentality of the State of Oklahoma with authority

192	192	rights, privileges, and functions hereinafter specified.
193	193	SECTION 2. AMENDATORY 74 O.S. 2021, Section 2204, is
194	194	amended to read as follows:
195	195	Section 2204. There are hereby granted to and imposed in the
196	196	Oklahoma Tourism and Recreation Department Commission, and in any
197	197	commission or body which may hereaf ter succeed to the powers,
198	198	rights, and duties of the Commission, the following additional
199	199	powers, rights and duties:
200	200	1. Sue and be sued;
201	201	2. Adopt, use, and alter an official se al;
202	202	3. Make bylaws for the management and regulation of its
203	203	affairs;
204	204	4. Appoint, prescribe the duties, and fix the compensation for
205	205	officers, agents, and employees;
206	206	5. Make contracts and execute instruments as in the judgm ent of
207	207	the Department Commission are necessary or convenient to the
208	208	exercise of the powers conferred upon it by law; and
209	209	6. Promulgate rules and policies necessary and convenient to
210	210	the exercise of the powers conferred upon it by law.
211	211	SECTION 3. AMENDATORY 74 O.S. 2021, Section 2206, is
212	212	amended to read as follows:
213	213	Section 2206. The chief executive officer of the Oklahoma
214	214	Tourism and Recreation Department Commission shall be the Executive
