4040 An Act relating to professions and occupations;

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. AMENDATORY 59 O.S. 2021, Section 161.10a, is
5252 amended to read as fol lows:
5353 Section 161.10a A. At least ninety (90) calendar days prior to
5454 the date of a proposed continuing education course, an Applications
5555 to provide chiropractic continuing education seminars shall be
5656 submitted for review a nd approval by the Board of Chiropractic
5757 Examiners. An applicant, association or entity shall submit to the
5858 Board for approval:
5959 1. An application to provide continuing ed ucation in this
6060 state;
6161 2. The agenda for the continuing education seminar;
6262 3. The professional background of the i nstructors; and

8989 4. A summary of the courses to be taught at the continuing
9090 education seminar.
9191 B. No later than sixty (60) calendar days af ter submission of
9292 the application, the Board of Chiropractic Examiners shall either
9393 approve or reject the continuing education seminar Prior to approval
9494 of an application, the Board may authorize the Executive Director to
9595 temporarily approve applications, or amendments to an application,
9696 pursuant to the requirem ents specified by this stat ute and the rules
9797 approved by the Board for continuing education programs. Continuing
9898 education credits may only be counted for seminars receiving final
9999 Board approval.
100100 C. A continuing education program shall offer seminars
101101 providing continuing education on those subjects within the sc ope of
102102 practice of chiropractic as well as those technical, professional,
103103 and practical subjects that relate to the practice of chiropractic
104104 as included in Section 161.8 of Title 59 of the Oklahoma Statutes
105105 this title. Instructors at continuing education seminars may sell
106106 products as long as the sale of such products is ancillary to the
107107 purpose of the seminar.
108108 D. Each year a chiropractic physician must attend sixteen (16)
109109 hours of continuing education. Twelve (12) hours must be withi n the
110110 scope of practice of chiropractic as well as those technical,
111111 professional, and practical subjects that relate to the practice of

138138 chiropractic as included in Section 161.8 of this title. A maximum
139139 of four (4) hours may be non -clinical in nature.
140140 E. Beginning January 1, 2006, a A maximum of eight (8) hours of
141141 the annual Oklahoma continuing education requirements may be
142142 obtained by a continuing education program outside this state if the
143143 out-of-state continuing education program is approved by the Boa rd.
144144 F. Chiropractic physicians who have not been in active practice
145145 during the previous year shall be exempt from that calendar year 's
146146 continuing education requirements. However, prior to returning to
147147 active practice, the chiropractor must have attended the required
148148 continuing education during the previous calendar year.
149149 G. All licensed chiropractic physicians must attend a minimum
150150 of eight (8) hours of in -state continuing education programs
151151 approved by the Board of Chiropractic Examiners.
152152 H. The Board may waive the requirements for continuing
153153 education, if the licensee was prevented from attending by illness
154154 or extenuating circumstances, as determined by the Board. In
155155 waiving the continuing education requirements for any given year,
156156 the Board may require the licensee to make up the hours in the
157157 succeeding year as a condition for license renewal.
158158 SECTION 2. This act shall become effective November 1, 2023.
