101-BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
102-SECTION 1. NEW LAW A new section of law to b e codified
103-in the Oklahoma Stat utes as Section 2-105.9 of Title 47, unless
104-there is created a duplication in numbering, reads as follows:
105-A. The Commissioner of Public Safety m ay assign personnel
106-within the Department of Public Safety to:
10798 1. Collect information concerning the activity and identity of
10899 individuals reasonably believed to be engaged in terrorism , threats
109100 to public safety, organized crime , criminal conspiracies , or any
110101 other threats of violent crime ;
111102 2. Analyze collected information and disseminate such
112103 information to other law enforcement agencies ;
113104 3. Coordinate the effort of this state with local, state, and
114105 federal agencies to protect citizens from terrorism, th reats to
115106 public safety, organized crime, crimin al conspiracies, or any other
116107 threats of violent crime by creating a clearinghous e of crime-
117108 related information for use by lo cal, state, and federal law
118109 enforcement agencies; and
119110 4. Provide training to peace officers of this state concerning
120111 the legal collection, preservation, and dissemination of crime -
121112 related information.
122113 B. The Commissioner may assign attorneys of the Depar tment of
123114 Public Safety to support s uch criminal analysis and investigative
124115 functions, including providing assistance to the d istrict attorney

151-in pursuing search warrants, arrest warrants, and other forms of
152-court orders and process in connection with criminal investigations
153-of the Department of Public Safety. With written authorization f rom
154-the Commissioner, Department attorneys assigned to these duties, who
155-have been certified by the Council on Law Enforcement E ducation and
156-Training to carry a weapon or have been issued a handgun license
157-pursuant to the provisions of the Oklahoma Self -Defense Act, shall
158-be authorized to carry a firearm on his or her person, whether on
159-duty or off duty, anywhere in the state pursuant to paragraph 3 of
160-subsection A of Section 1272 and paragraph 1 of subsectio n H of
161-Section 1277 of Title 21 of the Oklahoma S tatutes.
162-C. Release of information compiled pursuant to this section
163-shall be prohibited except for release of information to l aw
164-enforcement agencies and prosecutorial authorities for the purpose
165-of crime prevention, criminal investigation, or criminal
166-prosecution. If the Commissioner determines it necessary to do so
167-in the interest of public safety or crime prevention, the
168-Commissioner may authorize the release of information compiled
169-pursuant to this sec tion to leadership of the state or any political
170-subdivision, critical infrastructure personnel, the target of any
171-threat, or any segment of the public. Unauthorized release or
172-unauthorized use of this information shall be a misdemeanor and
173-shall be punishable by incarceration in the county jail not
174-exceeding one (1) year or a fine not exceeding Fifty Thousand

201-Dollars ($50,000.00), or by both such fine and imprisonment. As
202-used in this section, “unauthorized release” or “unauthorized use”
203-shall include, but not be limited to, giving the information to a ny
204-person who is not a law enforcement officer or prosecutorial
205-authority unless necessitated by an ongoing criminal investigati on,
206-or release of information to a law enforcement officer who is not
207-engaged in a criminal investigation requiring the informat ion or who
208-is not authorized by his or her agency to receive such information,
209-or release of information without the express aut hority of the
210-Commissioner or in violation of any rules promulgated by the
211-Department of Public Safety. Information collected a nd compiled
212-under the authority of this section shall be privileged and not
213-discoverable nor subject to subpoena or order for pr oduction issued
214-by any court, other than production in a district court crimina l
215-proceeding for the prosecution of crimes which are the subject of
216-the information sought.
217-SECTION 2. It being immediately necessary for the preservation
218-of the public peace, health or safety, an emergency is hereby
219-declared to exist, by reason whereof this act shall take effect and
220-be in full force from and after its passage an d approval.”

404149 pursuant to the provisions of the Oklahoma Self -Defense Act, shall
405150 be authorized to carry a firea rm on his or her person, whether on
406151 duty or off duty, anywhere in the state pursuant to paragraph 3 of
407152 subsection A of Sectio n 1272 and paragraph 1 of subsectio n H of
408153 Section 1277 of Title 21 of the Oklahoma S tatutes.
409154 C. Release of information compiled pu rsuant to this section
410155 shall be prohibited except for release of information to l aw
411156 enforcement agencies and prosecutorial au thorities for the purpose
412157 of crime prevention, criminal investigation, or criminal
413158 prosecution. If the Commissioner determines it necessary to do so
414159 in the interest of public safety or crime prevention, the
415160 Commissioner may authorize the release of inform ation compiled
416161 pursuant to this sec tion to leadership of the state or any political
