73147 Quality Board at the same time staff recommendations are submitted
74148 to those members for Board review and consideration.

76149 B. 1. In addition to the requirements of subsection A of this
77150 section, each state environmental agency shall have pr omulgated by
78151 July 1, 2001, a Water Quality Standards Implementation Plan for its
79152 jurisdictional areas of environmental responsibility in compliance
80153 with the Administrative Procedures Act and pursuant to the
81154 provisions of this section. Each agency shall re view its plan at
82155 least every three (3) years thereafter to determine whether
83156 revisions to the plan are necessary.

85157 2. Upon the request of any state environmental agency, the
86158 Department of Environmental Quality shall provide consulting
87159 assistance to such ag ency in developing a Water Quality Standards
88160 Implementation Plan as required by this subsection.

90161 3. Each Water Quality Standards Implementation Plan shall:

92162 a. describe, generally, the processes, procedures and
93163 methodologies the state environmental agency will
94164 utilize to ensure that programs within its
95165 jurisdictional areas of environmental responsibility
96166 will comply with anti-degradation standards and lead
97167 to:

142256 Water Quality Standards Implementation Plan to achieve
143257 Oklahoma Water Quality Standards.

145258 C. 1. Each state environme ntal agency with groundwater
146259 protection authority pursuant to Article III of the Oklahoma
147260 Environmental Quality Act shall be the groundwater protection agency
148261 for activities within its jurisdictional areas of environmental
149262 responsibility.

151263 2. The Department of Environmental Quality shall cooperate with
152264 other state environmental agencies, as appropriate and necessary, in
153265 the protection of such unassigned activities.

155266 3. Groundwater regulatory agencies shall develop groundwater
156267 protection practices to prevent groundwater contamination from
157268 activities within their respective jurisdictional areas of
158269 environmental responsibility.

160270 4. Each groundwater protection agency shall promulgate such

163300 requirements of this subsection.

165301 5. Groundwater protection a gencies shall take such action as
166302 may be necessary to assure that activities within their respective
167303 jurisdictional areas of environmental responsi bility protect
168304 groundwater quality to support the uses of the state's water
169305 quality.

171306 6. In addition, each gr oundwater protection agency with
172307 enforcement authority is hereby authorized to:
173-
174308 a. engage the voluntary cooperation of all persons in the
175309 maintenance and protection of groundwater, and to
176310 advise, consult and cooperate with all persons, all
177311 agencies of the state, universities and colleges, the
178312 federal government or other states, and with
179-interstate agencies in the furtherance of the purposes ENR. H. B. NO. 1982 Page 5
313+interstate agencies in the furtherance of the purposes
180314 of this subsection, and to this end and for the
181315 purposes of studies, scientific or other
182316 investigations, research, exp eriments and
183317 demonstrations pertaining thereto, receive and spend

185319 such agencies and other office rs and persons on behalf

192352 the state, who, jointly or severally, are or may be
193353 impacting on the maintenance and protection of
194354 groundwater,

196355 c. encourage, participate in or conduct or cause to be
197356 conducted studies, scientific or other investigations,
198357 research, experiments and demonstr ations relating to
199358 the maintenance and protection of groundwater, and to
200359 collect data with respect thereto, a ll as may be
201360 deemed advisable and necessary to carry out the
202361 purposes of this subsection, and to make reports and
203362 recommendations with respect ther eto,

205363 d. conduct groundwater sampling, data collection,
206364 analyses and evaluations with sufficient frequency to
207365 ascertain the characteristics and quality of
208366 groundwater and the sufficiency of the groundwater
209367 protection programs established pursuant to this
210368 subsection, and
211-
212369 e. develop a public education and promotion program to
213370 aid and assist in publicizing the need o f, and
214371 securing support for, the maintenance and protection
215372 of groundwater.

217400 D. Each state environmental agency and each state agency with
218401 limited environmental responsibilities shall participate in the
219402 information management system developed by the Depart ment of
220403 Environmental Quality, pursuant to Section 1-4-107 of this title,
221404 with such information as the Department shall reasonably request.

223405 E. In each even-numbered year, in cooperation with other state

225407 resources, the Department of Environmental Quality shall provide a
226408 report on the status of water quality monitoring to the Legislature
227409 for review.

229410 SECTION 2. AMENDATORY 27A O.S. 2021, Section 1 -3-101, as
230411 amended by Section 4, Chapter 185, O.S.L. 2022 (27A O.S. Supp. 2022,
231412 Section 1-3-101), is amended to read as follows:

233413 Section 1-3-101. A. The provisions of this section specify the
234414 jurisdictional areas of responsibility for each state environmental
235415 agency and state agencies with limited environmental responsibility.
236416 The jurisdictional areas of environmental responsibil ity specified
237417 in this section shall be in addition to those otherwise provided by
238418 law and assigned to the specific state environmental agency;
239419 provided that any rule, interagency agreement or executive order
240420 enacted or entered into prior to the effective d ate of this section
241421 which conflicts with the assignment of jurisdictional environmental
242422 responsibilities specified by this section is hereby superseded.
243423 The provisions of this subsection shall not nullify any financial

247454 persons or parties entered into with any state environme ntal agency

250456 B. Department of Environmental Quality. The Department of
251457 Environmental Quality shall have the following jurisdictional areas
252458 of environmental responsibility:

254459 1. All point source discharges of pollutants and storm wate r to
255460 waters of the state which originate from mu nicipal, industrial,
256461 commercial, mining, transportation and utilities, construction,
257462 trade, real estate and finance, services, public administration,
258463 manufacturing and other sources, facilities and activities , except
259464 as provided in subsections D and E of t his section;
260-
261465 2. All nonpoint source discharges and pollution except as
262466 provided in subsections D, E and F of this section;
263-
264467 3. Technical lead agency for poin t source, nonpoint source and
265468 storm water pollution control programs funded under Section 106 of
266469 the federal Clean Water Act, for areas within the Department's
267470 jurisdiction as provided in this subsection;

295517 environmental jurisdiction statute, sole and exclusive jurisdiction
296518 for air quality under the federal Clean Air Act and ap plicable state

298520 worker safety by the federal Occupational Safety and Health Act and
299521 by Chapter 11 of Title 40 of the Oklahoma Statutes;

301522 9. Hazardous waste and solid waste including industrial,

304524 10. Superfund responsibilities of the state under the
305525 Comprehensive Environmental Response, Compensation and Liability Act
