41	41	O.S. 2021, Section 113 , which relates to rental
42	42	agreements; requiring fees to be listed on the first
43	43	page of the rental agreement; and providing an
44	44	effective date.

50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. AMENDATORY 41 O.S. 2021, Section 113, is
52	52	amended to read as follows:
53	53	Section 113. A. A rental agreement may not provide that either
54	54	party thereto:
55	55	1. Agrees to waive or forego rights or remedies under the
56	56	Oklahoma Residential Landlord and Te nant Act;
57	57	2. Authorizes any person to confess judgment on a clai m arising
58	58	out of the rental agreement;
59	59	3. Agrees to pay the other party 's attorney's attorney fees;
60	60	4. Agrees to the exculpation, limitation or indemnification of
61	61	any liability arising under law for damages or injuries to persons
62	62	or property caused by, or resulting from, the acts or omissions of

89	89	either party, their agents, servants or employees in t he operation
90	90	or maintenance of the dwelling unit or the premises of which it is a
91	91	part;
92	92	5. Agrees to the establishment of a lien except as allowed by
93	93	the Oklahoma Residential Landlord and Tenant Act in and to the
94	94	property of the other party ; or
95	95	6. Agrees to waive or limit his or her right to summon a peace
96	96	officer or other emergency assistance i n an emergency.
97	97	B. A provision prohibited by subsection A of this section an d
98	98	included in a rental agreement is unenforceable.
99	99	C. All rental agreements shall have all applicable fees,
100	100	including, but not limited to, rent payment late fees and
101	101	application fees, listed clearly on the first page of the rental
102	102	agreement.
103	103	SECTION 2. This act shall become effective November 1, 2023.
