4040 An Act relating to law enforcement; directing the
4141 Oklahoma State Bureau of Investigation to create
4242 certain annual report; directing the Oklahoma Highway
4343 Patrol Division and local law enforcement agencies to
4444 submit use-of-force incidents to the Bureau;
4545 specifying informati on to be submitted; prohibiting

4747 reported; making certain data available to the
4848 public; directing the Bureau to maintain statewide
4949 database; requiring publication of data on website of

6262 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6363 SECTION 1. NEW LAW A new section of law to be codified
6464 in the Oklahoma Statutes as Section 150.21c of Title 74, unless
6565 there is created a dupli cation in numbering, reads as follows:
6666 A. Beginning July 1, 202 4, the Oklahoma State Bu reau of
6767 Investigation shall create an ann ual report regarding use-of-force
6868 incidents involving peace officers in Oklahoma. The report shall

9595 include all the information that is reported to the Bureau pursuant
9696 to subsection B of this section by law enforcem ent agencies that
9797 employ peace officers i n this state.
9898 B. Beginning January 1, 202 4, the Oklahoma Highway Patrol
9999 Division of the Department of Public Safety and each l ocal law
100100 enforcement agency that employs peace officers in this state shall
101101 report to the Bureau:
102102 1. All uses of force by its pe ace officers that results in
103103 death or bodily injury, including:
104104 a. the date, time, and location of the use of force,
105105 b. the perceived demographic information of the person
106106 contacted; provided, that the identificatio n of these
107107 characteristics is based on th e observation and
108108 perception of the peace officer making the contact and
109109 other available data,
110110 c. the names of all peace office rs who were at the scene,
111111 identified by whether the peace officer was involved
112112 in the use of force or not; provided, that the
113113 identity of other peace officers at the scene not
114114 directly involved in the use of force shall be
115115 identified by the identification number of the officer
116116 unless the peace officer is charged criminally or is a
117117 defendant in a civil suit as a result arising from t he

145145 d. the type of force used, the severity and nature of the
146146 injury, whether the peace officer suffered physical
147147 injury, and the severity of the injury suffered by the
148148 peace officer,
149149 e. whether the peace officer was on duty at the time of
150150 the use of force,
151151 f. whether the peace officer unholstered a weapon during
152152 the incident,
153153 g. whether the peace officer discharged a firearm during
154154 the incident,
155155 h. whether the use of force resulted in a law enforcement
156156 agency investigation and the result of th at
157157 investigation, and
158158 i. whether the use of force resulted in a citizen
159159 complaint and the resolution of that complaint;
160160 2. All instances when a peace officer resigned while under
161161 investigation or was terminated for violating department policy;
162162 3. All data relating to contacts conducted by its peace
163163 officers, including:
164164 a. the perceived demographic information of the person
165165 contacted; provided, that the identification of these
166166 characteristics is based on the observa tion and
167167 perception of the peace officer making the contact and
168168 other available data,

195195 b. whether the contact was a traffic stop,
196196 c. the time, date, and location of the contact,
197197 d. the duration of the contact,
198198 e. the reason for the contact,
199199 f. the suspected crime,
200200 g. the result of the contact, suc h as:
201201 (1) no action, warning, citation, property seizure,
202202 or an arrest,
203203 (2) if a warning or citation was issued, the warning
204204 provided, or violation cited,
205205 (3) if an arrest was made, the offense charged, or
206206 (4) if the contact was a traffic stop, the
207207 information collected, which shall include the
208208 driver and contact with any passengers in the
209209 motor vehicle or pedestrians, and
210210 h. the actions taken by the peace officer during the
211211 contact including, but not limite d to, whether:
212212 (1) the peace officer asked for con sent to search the
213213 person, and, if so, whether consent was provided,
214214 (2) the peace officer searched the person or any
215215 property, and, if so, the basis for the search
216216 and the type of contraband or evidence

244244 (3) the peace officer seized any property, and, if
245245 so, the type of property that was seized and the
246246 basis for seizing the property,
247247 (4) a peace officer unholst ered a weapon during the
248248 contact, and
249249 (5) a peace officer discharged a firearm during the
250250 contact; and
251251 4. All instances of unann ounced entry into a residence, with or
252252 without a warrant, including:
253253 a. the date, time, and location of the use of unannounced
254254 entry,
255255 b. the perceived demographic information of the subject
256256 of the unannounced entry; provided, that the
257257 identification of the se characteristics is based on
258258 the observation and perception of the peace officer
259259 making the entry and other available data,
260260 c. whether a peace officer unholstered a weapon during
261261 the unannounced entry, an d
262262 d. whether a peace officer discharged a firearm during
263263 the unannounced entry.
264264 C. The Oklahoma Highway Patrol and local law enforcement
265265 agencies shall not report the name, add ress, Social Security number,
266266 or other unique personal identifying information of the subject of
267267 the use of force, victim of the official misconduct, or persons

294294 contacted, searched, or subjected to a property seizure. The data
295295 reported pursuant to this se ction shall be available to the public
296296 pursuant to subsection D of this section .
297297 D. The Oklahoma State Bureau of Investigation s hall maintain a
298298 statewide database with data collected pursuant to the provisions of
299299 this section, in a searchable format, and publish the database on
300300 its website.
301301 E. Any local law enforcement agency that fails to meet its
302302 reporting obligations pursuant t o the provisions of this section
303303 shall have the certification of its peace officers suspended
304304 indefinitely by the Council on La w Enforcement Education and
305305 Training until compliance with the provisions of th is section have
306306 been met.
307307 F. As used in this sect ion:
308308 1. "Law enforcement agency " means any department or agency of
309309 the state, a county, a municipality, or political subdivisi on which
310310 employs CLEET-certified personnel, with duties to maintain public
311311 order, make arrests, and enforce the criminal laws of this sta te or
312312 municipal ordinances; and
313313 2. "Peace officer" shall have the same meaning as that term is
314314 defined in Section 99 o f Title 21 of the Oklahoma Statutes.
