99 | 99 | | Division of the Department of Public Safety and each l ocal law |
---|
100 | 100 | | enforcement agency that employs peace officers in this state shall |
---|
101 | 101 | | report to the Bureau: |
---|
102 | 102 | | 1. All uses of force by its pe ace officers that results in |
---|
103 | 103 | | death or bodily injury, including: |
---|
104 | 104 | | a. the date, time, and location of the use of force, |
---|
105 | 105 | | b. the perceived demographic information of the person |
---|
106 | 106 | | contacted; provided, that the identificatio n of these |
---|
107 | 107 | | characteristics is based on th e observation and |
---|
108 | 108 | | perception of the peace officer making the contact and |
---|
109 | 109 | | other available data, |
---|
110 | 110 | | c. the names of all peace office rs who were at the scene, |
---|
111 | 111 | | identified by whether the peace officer was involved |
---|
112 | 112 | | in the use of force or not; provided, that the |
---|
113 | 113 | | identity of other peace officers at the scene not |
---|
114 | 114 | | directly involved in the use of force shall be |
---|
115 | 115 | | identified by the identification number of the officer |
---|
116 | 116 | | unless the peace officer is charged criminally or is a |
---|
117 | 117 | | defendant in a civil suit as a result arising from t he |
---|
118 | 118 | | use of force, |

155 | 155 | | h. whether the use of force resulted in a law enforcement |
---|
156 | 156 | | agency investigation and the result of th at |

157 | 157 | | investigation, and |

158 | 158 | | i. whether the use of force resulted in a citizen |
---|
159 | 159 | | complaint and the resolution of that complaint; |
---|
160 | 160 | | 2. All instances when a peace officer resigned while under |
---|
161 | 161 | | investigation or was terminated for violating department policy; |
---|
162 | 162 | | 3. All data relating to contacts conducted by its peace |
---|
163 | 163 | | officers, including: |
---|
164 | 164 | | a. the perceived demographic information of the person |
---|
165 | 165 | | contacted; provided, that the identification of these |
---|
166 | 166 | | characteristics is based on the observa tion and |
---|

---|
209 | 209 | | motor vehicle or pedestrians, and |

---|
258 | 258 | | the observation and perception of the peace officer |

259 | 259 | | making the entry and other available data, |
---|
260 | 260 | | c. whether a peace officer unholstered a weapon during |
---|
261 | 261 | | the unannounced entry, an d |
---|
262 | 262 | | d. whether a peace officer discharged a firearm during |
---|
263 | 263 | | the unannounced entry. |
---|
264 | 264 | | C. The Oklahoma Highway Patrol and local law enforcement |
---|
265 | 265 | | agencies shall not report the name, add ress, Social Security number, |
---|
266 | 266 | | or other unique personal identifying information of the subject of |
---|
267 | 267 | | the use of force, victim of the official misconduct, or persons |
---|

297 | 297 | | D. The Oklahoma State Bureau of Investigation s hall maintain a |
---|
298 | 298 | | statewide database with data collected pursuant to the provisions of |
---|
299 | 299 | | this section, in a searchable format, and publish the database on |
---|
300 | 300 | | its website. |
---|
301 | 301 | | E. Any local law enforcement agency that fails to meet its |
---|
302 | 302 | | reporting obligations pursuant t o the provisions of this section |
---|
303 | 303 | | shall have the certification of its peace officers suspended |
---|
304 | 304 | | indefinitely by the Council on La w Enforcement Education and |
---|
305 | 305 | | Training until compliance with the provisions of th is section have |
---|
306 | 306 | | been met. |
---|
307 | 307 | | F. As used in this sect ion: |
---|
308 | 308 | | 1. "Law enforcement agency " means any department or agency of |
---|
309 | 309 | | the state, a county, a municipality, or political subdivisi on which |
---|
310 | 310 | | employs CLEET-certified personnel, with duties to maintain public |
---|
311 | 311 | | order, make arrests, and enforce the criminal laws of this sta te or |
---|
312 | 312 | | municipal ordinances; and |
---|
313 | 313 | | 2. "Peace officer" shall have the same meaning as that term is |
---|
314 | 314 | | defined in Section 99 o f Title 21 of the Oklahoma Statutes. |
