59	52		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
60	53		SECTION 1. AMENDATORY 21 O.S. 2021, Section 1024.1, is
61	54		amended to read as follows:
62	55		Section 1024.1 A. As used in Sections 1021, 1021.1 thr ough
63	56		1021.4, Sections 1022 through 1024 and 1023, and Sections 1040.8
64	57		through 1040.24 of this title, "child pornography" means and
65	58		includes any visual depiction or individual image stored or
66	59		contained in any format on any medium inc luding, but not limited to,
67	60		film, motion picture, videotape, photograph, negative, undeveloped
	61	+	film, slide, photographic product, reprodu ction of a photographic
	62	+	product, play or performance wherein a minor under the age of
	63	+	eighteen (18) years is engaged in any act with a person, other than

95		-	film, slide, photographic product, reprodu ction of a photographic
96		-	product, play or performance wherein a minor under the age of
97		-	eighteen (18) years is engaged in any act with a person, other than
98	90		his or her spouse, of sexual intercourse which is normal or
99	91		perverted, in any act of anal sodomy, in any act of sexual activity
100	92		with an animal, in any act of sadomasochistic abuse includi ng, but
101	93		not limited to, flagellati on or torture, or the conditi on of being
102	94		fettered, bound or otherwise physically restrained in t he context of
103	95		sexual conduct, in any act of fell atio or cunnilingus, in any act of
104	96		excretion in the context of sexual conduct, in any lewd exhibition
105	97		of the uncovered genitals in the contex t of masturbation or other
106	98		sexual conduct, or where the lewd exhibi tion of the uncovered
107	99		genitals, buttocks or, if such minor is a female, the breast, has
108	100		the purpose of sexual stimulation of t he viewer, or wherein a person
109	101		under the age of eighteen (18) y ears observes such acts or
110	102		exhibitions. Each visual depiction or i ndividual image shall
111	103		constitute a separate item and multiple copies of the same identical
112	104		material shall each be counted as a separate item.
113	105		B. As used in Sections 1021 through 1024.4 and Sections 1040.8
114	106		through 1040.24 of this title:
115	107		1. "Obscene material" means and includes any representation,
116	108		performance, depiction or description of sexual conduct, whether in
117	109		any form or on any medium including any book, article, magazine,
118	110		publication, or written matter of any kind, or any drawing, etching,
	111	+	painting, still photographs, undeveloped photographs, motio n
	112	+	pictures, undeveloped film, videotape, optical, magnetic or solid -
	113	+	state storage, CD or DVD, or a purely photog raphic product or a

146		-	painting, still photographs, undeveloped photographs, motio n
147		-	pictures, undeveloped film, videotape, optical, magnetic or solid -
148		-	state storage, CD or DVD, or a purely photog raphic product or a
149	140		reproduction of such product in any book, pamphlet, ma gazine, or
150	141		other publication or electronic or photo -optical format, if said
151	142		items contain the following elements:
152	143		a. depictions or descriptions of sexual conduct which are
153	144		patently offensive as found by the average person
154	145		applying contemporary community st andards,
155	146		b. taken as a whole, have as the dominant theme an appeal
156	147		to prurient interest in sex as found by the average
157	148		person applying contemporary communit y standards, and
158	149		c. a reasonable person would find the material or
159	150		performance taken as a whole lack s serious literary,
160	151		artistic, educational, p olitical, or scientific
161	152		purposes or value.
162	153		The standard for obscenity applied in subparagraph s b and c of this
163	154		subsection shall not apply when an adult knowingly provides material
164	155		that qualifies as obscene material or harmful to minor s, as such
165	156		terms are defined in this section. The standard for obscenity
166	157		applied in this section shall not apply to child pornography;
167	158		2. "Performance" means and includes any display, live or
168	159		recorded, in any form or medium;
169	160		3. "Sexual conduct" means and includes any of the following:
	161	+	a. acts of sexual intercourse including any intercourse
	162	+	which is normal or perverte d, actual or simulated,

197		-	a. acts of sexual intercourse including any intercourse
198		-	which is normal or perverte d, actual or simulated,
199	189		b. acts of deviate sexual condu ct, including oral and
200	190		anal sodomy,
201	191		c. acts of masturbation,
202	192		d. acts of sadomasochist ic abuse including but not
203	193		limited to:
204	194		(1) flagellation or torture by or upon any person who
205	195		is nude or clad in unde rgarments or in a costume
206	196		which is of a revealing natur e, or
207	197		(2) the condition of being fettered, bo und, or
208	198		otherwise physically restrained on the part of
209	199		one who is nude or so clothed,
210	200		e. acts of excretion in a sexual context, or
211	201		f. acts of exhibiting hum an genitals or pubic areas ; and
212	202		4. "Explicit child pornography" means material which a law
213	203		enforcement officer can immediately identify upo n first viewing
214	204		without hesitation as child porn ography; and
215	205		5. "Harmful to minors" shall have the same meaning as provided
216	206		for in paragraph 2 of Section 1040.75 of this title.
217	207		The types of sexual conduct described in paragraph 3 of this
218	208		subsection are intended to include situations when, if appropriat e
219	209		to the type of conduct, the conduct is performed alone or between
	210	+	members of the same or opposite sex or between humans and animals in
	211	+	an act of apparent sexual stimulation or gratification.
