2451 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2652 SECTION 1. AMENDATORY 62 O. S. 2021, Section 34.70, is
2753 amended to read as follows:

2954 Section 34.70 A. 1. Upon the request of a state employee, a
3055 state agency shall make voluntary payroll deductions for the
3156 employee to any credit union, bank, or savings association having an
3257 office in this state.

3458 2. If the governing body of any county, municipality, or school
3559 district provides for voluntary payroll deductions to a credit union
3660 serving the employees of the county, municipality, or school
3761 district, it shall provide voluntary payroll de ductions to any
3862 credit union, bank, or savings association having an off ice in this

3990 state which has a minimum participation of twenty percent (20%) of
4091 the employees of the county, municipality, or school district.

4292 B. Upon the request of a state employee a nd pursuant to
4393 procedures established by the Director of the Office of M anagement
4494 and Enterprise Services, a state agency shall make payroll
4595 deductions for:

4796 1. The payment of any insurance premiums due a private
4897 insurance organization with a minimum parti cipation of five hundred
4998 (500) state employees for life, accident, and h ealth insurance which
5099 is supplemental to that provided for by the state;

52100 2. The payment of any insurance premiums, other than the
53101 premiums due pursuant to paragraph 1 of this subsecti on, due a
54102 private insurance organization or service company with a minim um
55103 participation of five hundred (500) state employees for legal
56104 services;

58105 3. Premiums or payments for retirement plans with a minimum
59106 participation of five hundred (500) state employ ees for retirement
60107 plans which are supplemental to that provided for by the state;

62108 4. Salary adjustment agreements included in a flexible benefits
63109 plan as authorized by the State Employees Flexible Benefits Act;

65110 5. Membership dues utilized for benefits, goods or services
66111 provided by the Oklahoma Public Employees Association to the
67112 organization's membership or any other statewide association limited
68113 to state employee membership with a minimum membership of two

69141 thousand (2,000) dues -paying members. For pur poses of this
70142 paragraph, state agencies shall accept online or electroni cally
71143 submitted forms from the Oklahoma Public Employees Association and
72144 other state employee associations. The Office of Management and
73145 Enterprise Services shall develop and implemen t a verification
74146 process for online or electronically submitted forms wh ich may
75147 include the use of electronic signature technology or other process
76148 as determined appropriate . In addition, the Office of Management
77149 and Enterprise Services shall provide an association representing
78150 state employees with a reconciliation report once a month containing
79151 information related to the name, warrant number and warrant date of
80152 those employees that have opt ed into the association 's membership;

82153 6. Contributions to any fou ndation organized pursuant to 26
83154 U.S.C., Section 501(c)(3) of the Oklaho ma Public Employees
84155 Association or any other statewide association limited to state
85156 employee membership with a minimum membership of two thousand
86157 (2,000) dues-paying members;

88158 7. Payments to a college savings account administered under the
89159 Oklahoma College Savings Plan Act pursuant to Section 3970.1 et seq.
90160 of Title 70 of the Oklahoma Statutes;

92161 8. Subscriptions to the Oklahoma Today magazine published by
93162 the State of Oklahoma through t he Oklahoma Tourism and Recreation

96191 9. The payment of an y insurance premiums due a private
97192 insurance organization, which is regulated by the State Insurance
98193 Commission, for an Oklahoma Long -Term Care Partnership Program
99194 approved policy purs uant to the Oklahoma Long -Term Care Partnership

102196 C. The administrative costs of processing payroll deductions or
103197 administering salary adjustment agreements for insurance premiums as
104198 provided for in subsection B of this section shall be a charge of
105199 two percent (2%) of the gross annual premiums for insurance plans.
106200 The administrative costs of processing payroll deductions or
107201 administering salary adjustment agreements for payments for
108202 retirement plans as provided for in subsection B of this section
109203 shall be one percent (1%) of the gross annual payments for
110204 retirement plans. These charges shall be collected monthly from the
111205 private insurance or retirement plan organization by the Office of
112206 Management and Enterprise Services and shall be deposited to the
113207 credit of the General Revenue Fund. Provided that these costs shall
114208 not be collected from state employees or state agencies unless
115209 otherwise directed in the Oklahoma State Finance Act.

117210 D. Any statewide association granted a payroll deduction prior
118211 to January 1, 2008, shall be exempt from the minimum state employee
119212 membership requirement.

121213 E. Approval of a payroll deduction or salary adjustment
122214 agreement for any insurance organization, line of coverage or policy

123242 shall not be construed as an assumption of li ability, for the term
124243 of policy or the performance of the insurance orga nization, by this
125244 state, or any of its agencies or any officer or employee thereof.
126245 Contracts for such insurance shall be in all respects subject to the
127246 insurance laws of this state, and shall be enforceable solely
128247 pursuant to such laws.

130248 F. The Oklahoma Employment Security Commission is authorized to
131249 deduct from the wages or salary of its employees the employees '
132250 contribution to the Oklahoma Employment Security Commission
133251 Retirement Plan.

135252 G. Payroll deductions shall be made for premium payments for
136-group insurance for retired members or beneficiaries of any state - ENR. H. B. NO. 2026 Page 4
253+group insurance for retired members or beneficiaries of any state-
137254 supported retirement system upon proper authorization given by the
138255 member or beneficiary to the board from which the member or
139256 beneficiary is currently receiving retirement benefits.

141257 H. Upon request of instructional personnel employed at either
142258 the Oklahoma School for the Blind or the Oklahoma School for the
143259 Deaf and pursuant to procedures established by the Director of the
144260 Office of Management and Enterprise Services, the Commission for
145261 Rehabilitation Services shall make payroll deductions for membership
146262 dues in any statewide educational employee organization or
147263 association.

149291 I. Upon the request of a state employee of the Dep artment of

151293 for the employee to the Correctional Peace Officer Foundation.
