4040 An Act relating to firearms; providing mandatory
4141 waiting period before purchasing firearms; defining
4242 terms; making certain acts unlawf ul; providing
4343 penalties; authorizing the inspection of fi rearm
4444 sales records by law enforcement agencies; providing
4545 exceptions to mandatory wa iting period; providing for
4646 codification; and providing an effective date.

5454 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5555 SECTION 1. NEW LAW A new section of law to be codified
5656 in the Oklahoma Statutes as Section 1288.1 of Title 21, unless there
5757 is created a duplication in numbering, reads as follows:
5858 A. A mandatory waiting period is imposed between the purchase
5959 and delivery of a firearm. The mandatory waiting period shall be
6060 three days, excluding weekends and legal holidays .
6161 B. As used in this section:
6262 1. "Firearm" means a rifle, pistol or shotgun;
6363 2. "Purchase" means the transfer of money or other valuable
6464 consideration to the retailer ; and

9191 2. "Retailer" means and includes a licensed importer, licensed
9292 manufacturer, or licensed dealer engaged i n the business of making
9393 firearm sales at retail or for distribution, or use , or consumption,
9494 or storage to be used or consumed in this state .
9595 C. 1. It shall be unlawful for an y retailer, or any employee
9696 or agent of a retailer, to deliver a firearm befor e the expiration
9797 of the three-day waiting period.
9898 2. It shall be unlawful f or a purchaser to obtain delivery of a
9999 firearm by fraud, false pretense, or false representation.
100100 D. Any person who violates the provisions of subsection C of
101101 this section shall, upon conviction, be guilty of a felony.
102102 E. Records of firearm sales shall be available for inspection
103103 by any law enforcement agency during normal business hours.
104104 F. The waiting period specified in subsection A of this section
105105 shall not apply in the following circumstances:
106106 1. When a firearm is being purchased by a holder of a handgun
107107 license issued pursuant to the provisions of the Oklahoma Self-
108108 Defense Act;
109109 2. To a trade-in of another firearm ;
110110 3. To the purchase of a rifle or shotgun, upon the person
111111 successfully completing a minimum of a sixteen hour hunter safety
112112 course and possessing a hunter safety certificat e issued by the
113113 Department of Wildlife; or

140140 4. When a rifle or shotgun is being p urchased by a law
141141 enforcement officer, correctional officer, or servicemember.
142142 SECTION 2. This act shall become effect ive November 1, 2023.
