40	40	An Act relating to firearms; providing mandatory
41	41	waiting period before purchasing firearms; defining
42	42	terms; making certain acts unlawf ul; providing
43	43	penalties; authorizing the inspection of fi rearm
44	44	sales records by law enforcement agencies; providing
45	45	exceptions to mandatory wa iting period; providing for
46	46	codification; and providing an effective date.

54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. NEW LAW A new section of law to be codified
56	56	in the Oklahoma Statutes as Section 1288.1 of Title 21, unless there
57	57	is created a duplication in numbering, reads as follows:
58	58	A. A mandatory waiting period is imposed between the purchase
59	59	and delivery of a firearm. The mandatory waiting period shall be
60	60	three days, excluding weekends and legal holidays .
61	61	B. As used in this section:
62	62	1. "Firearm" means a rifle, pistol or shotgun;
63	63	2. "Purchase" means the transfer of money or other valuable
64	64	consideration to the retailer ; and

91	91	2. "Retailer" means and includes a licensed importer, licensed
92	92	manufacturer, or licensed dealer engaged i n the business of making
93	93	firearm sales at retail or for distribution, or use , or consumption,
94	94	or storage to be used or consumed in this state .
95	95	C. 1. It shall be unlawful for an y retailer, or any employee
96	96	or agent of a retailer, to deliver a firearm befor e the expiration
97	97	of the three-day waiting period.
98	98	2. It shall be unlawful f or a purchaser to obtain delivery of a
99	99	firearm by fraud, false pretense, or false representation.
100	100	D. Any person who violates the provisions of subsection C of
101	101	this section shall, upon conviction, be guilty of a felony.
102	102	E. Records of firearm sales shall be available for inspection
103	103	by any law enforcement agency during normal business hours.
104	104	F. The waiting period specified in subsection A of this section
105	105	shall not apply in the following circumstances:
106	106	1. When a firearm is being purchased by a holder of a handgun
107	107	license issued pursuant to the provisions of the Oklahoma Self-
108	108	Defense Act;
109	109	2. To a trade-in of another firearm ;
110	110	3. To the purchase of a rifle or shotgun, upon the person
111	111	successfully completing a minimum of a sixteen hour hunter safety
112	112	course and possessing a hunter safety certificat e issued by the
113	113	Department of Wildlife; or

140	140	4. When a rifle or shotgun is being p urchased by a law
141	141	enforcement officer, correctional officer, or servicemember.
142	142	SECTION 2. This act shall become effect ive November 1, 2023.
