110 | 101 | | SECTION 1. NEW LAW A new section of law not to be |
---|
111 | 102 | | codified in the Oklahoma Statutes reads as follows: |

112 | 103 | | This act shall be known and may be cited as the "Sportsman |
---|
113 | 104 | | Hearing Protection Act ". |
---|
114 | 105 | | SECTION 2. NEW LAW A new section of law to be codified |
---|
115 | 106 | | in the Oklahoma Statutes as Section 1289.31 of Title 21, unless |
---|
116 | 107 | | there is created a duplication in numbering, reads as follows: |
---|
117 | 108 | | A. As used in this act: |
---|
118 | 109 | | 1. "Firearm" means a rifle, pistol, or shot gun; |
---|
119 | 110 | | 2. "Firearm suppressor" means any device desi gned, made, or |
---|
120 | 111 | | adapted to muffle the report of a fire arm; |
---|
121 | 112 | | 3. "Generic and insignificant part " means an item that has |
---|
122 | 113 | | manufacturing or consumer product applications other than inclusion |
---|
123 | 114 | | in a firearm suppressor. The term includes a spring, screw, nut, |
---|
124 | 115 | | and pin; and |
---|
125 | 116 | | 4. "Manufacture" includes forging, casting, machining, or any |
---|
126 | 117 | | other process for working a material. |
---|
127 | 118 | | B. For the purposes of this act, a firearm suppressor is |
---|
128 | 119 | | manufactured in this state if the ite m is manufactured: |
---|
129 | 120 | | 1. In this state from basic mater ials; and |
---|
161 | 151 | | subsection B of this section without regard to whether a firear m |
---|
162 | 152 | | imported into this state from another state is attached to or use d |
---|
163 | 153 | | in conjunction with the suppressor. |
---|
164 | 154 | | D. A firearm suppressor that is manufactured i n this state and |
---|
165 | 155 | | remains in this state is not subject to federal law or federal |
---|
166 | 156 | | regulation, including re gistration, under the authority of the |
---|
167 | 157 | | United States Congress to re gulate interstate commerce. |
---|
168 | 158 | | E. A basic material from which a firearm suppressor is |
---|
169 | 159 | | manufactured in this state, including unmachined steel , is not a |
---|
170 | 160 | | firearm suppressor and is not subject to federal regulation under |
---|
171 | 161 | | the authority of the United States Congre ss to regulate interstate |
---|
172 | 162 | | commerce as if it actually were a firearm suppressor. |
---|
173 | 163 | | F. A firearm suppressor manufactured and sold in this sta te |
---|
174 | 164 | | must have the words "Made in Oklahoma" clearly stamped, machined or |
---|
175 | 165 | | engraved on the firearm suppressor. |
---|
176 | 166 | | G. On written notification to th e Office of the Attorney |
---|
177 | 167 | | General of this state by a United Stat es citizen who resides in this |
---|
178 | 168 | | state of the intent of the citizen to manufa cture a firearm |
---|
179 | 169 | | suppressor to which subsection D of this section applies, the |
---|
180 | 170 | | Attorney General shall seek a declarator y judgment from a federal |
---|
211 | 200 | | 1. The State of Oklahoma, including an agency, department, |
---|
212 | 201 | | commission, bureau, board, office, council, court, or other entity |
---|
213 | 202 | | that is in any branch of state government and that is created by the |
---|
214 | 203 | | Oklahoma Constitution or a statute of this state, including a |
---|
215 | 204 | | university system or a system of higher education; |
---|
216 | 205 | | 2. The governing body of a municipality, county, district, or |
---|
217 | 206 | | authority; and |
---|
218 | 207 | | 3. An officer, employee, or other body that is part of a |
---|
219 | 208 | | municipality, county, special district or authority, including a |
---|
220 | 209 | | sheriff, municipal police department, municipal attorney or district |
---|
221 | 210 | | attorney. |
---|
222 | 211 | | I. An entity described by subsection H of this sec tion may not |
---|
223 | 212 | | adopt a rule, order, ordinance, or policy under which the enti ty |
---|
224 | 213 | | enforces or, by consistent action, allows the enforcement of, a |
---|
225 | 214 | | federal statute, order, rule, or regulation that purports to |
---|
226 | 215 | | regulate a firearm suppressor if the statute, order, rule, or |
---|
227 | 216 | | regulation imposes a prohibition, restriction, or other regulation |
---|
228 | 217 | | that does not exist under the laws of this state. |
---|
229 | 218 | | J. No entity described by subsection H of this section and no |
---|
230 | 219 | | person employed by or otherwise under the direction or control of |
---|
231 | 220 | | the entity may enforce or attempt to enforce any federal statute, |
---|
261 | 249 | | K. An entity described by subsection H of this section may not |
---|
262 | 250 | | receive state grant funds if the entity adopts a rule, or der, |
---|
263 | 251 | | ordinance, or policy under which the entity enforces a federal law |
---|
264 | 252 | | described by subsection I of this section or, by consistent action, |
---|
265 | 253 | | allows the enforcement of a federal law described by subsec tion I of |
---|
266 | 254 | | this section. |
---|
267 | 255 | | L. State grant funds for the ent ity shall be denied for the |
---|
268 | 256 | | fiscal year following the year in which a final judicial |
---|
269 | 257 | | determination in an action brought under the provisions of this act |
---|
270 | 258 | | is made that the entity has violated subsectio n I of this section. |
---|
271 | 259 | | M. Any citizen residing in the juri sdiction of an entity |
---|
272 | 260 | | described by subsection H of this section may file a complaint with |
---|
273 | 261 | | the Office of the Attorney General if the citizen offers evidence to |
---|
274 | 262 | | support an allegation that the entity ha s adopted a rule, order, |
---|
275 | 263 | | ordinance, or policy under which the entity enforces a federal law |
---|
276 | 264 | | described by subsection I of this sectio n or that the entity, by |
---|
277 | 265 | | consistent action, allows the enforcement of a federal law described |
---|
278 | 266 | | by subsection I of this sectio n. The citizen shall include with the |
---|
279 | 267 | | complaint any evidence the citizen has in support of the complaint. |
---|
280 | 268 | | N. If the Attorney Gener al determines that a complaint filed |
---|
281 | 269 | | under subsection M of this section against an entity described by |
---|
282 | 270 | | subsection H of this section is valid, the Attorney General may file |
---|
312 | 299 | | county in which the principal office of the entity is located. The |
---|
313 | 300 | | Attorney General may recover reasonable expenses incurred obtainin g |
---|
314 | 301 | | relief under this subsection, including court costs, reasonable |
---|
315 | 302 | | attorney fees, investigative costs, wi tness fees, and deposition |
---|
316 | 303 | | costs. |
---|
317 | 304 | | O. An appeal of a suit brought under subsection N of this |
---|
318 | 305 | | section shall be governed by the procedures for appeals in civil |
---|
319 | 306 | | cases under the Oklahoma Rules of Appellate Procedure. The |
---|
320 | 307 | | appellate court shall render its final order or judgment with the |
---|
321 | 308 | | least possible delay. |
---|
322 | 309 | | SECTION 3. It being immediately necessary for the preservation |
---|
323 | 310 | | of the public peace, h ealth or safety, an emergency is hereby |
---|
324 | 311 | | declared to exist, by reason whereo f this act shall take effect and |
---|
325 | 312 | | be in full force from and after its passage an d approval. |
