109-BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
110101 SECTION 1. NEW LAW A new section of law not to be
111102 codified in the Oklahoma Statutes reads as follows:
112103 This act shall be known and may be cited as the "Sportsman
113104 Hearing Protection Act ".
114105 SECTION 2. NEW LAW A new section of law to be codified
115106 in the Oklahoma Statutes as Section 1289.31 of Title 21, unless
116107 there is created a duplication in numbering, reads as follows:
117108 A. As used in this act:
118109 1. "Firearm" means a rifle, pistol, or shot gun;
119110 2. "Firearm suppressor" means any device desi gned, made, or
120111 adapted to muffle the report of a fire arm;
121112 3. "Generic and insignificant part " means an item that has
122113 manufacturing or consumer product applications other than inclusion
123114 in a firearm suppressor. The term includes a spring, screw, nut,
124115 and pin; and
125116 4. "Manufacture" includes forging, casting, machining, or any
126117 other process for working a material.
127118 B. For the purposes of this act, a firearm suppressor is
128119 manufactured in this state if the ite m is manufactured:
129120 1. In this state from basic mater ials; and
121+2. Without the inclusion of any part imp orted from another
122+state other than a generic and insignificant par t.
123+C. For the purposes of this act, a firearm suppressor is
124+manufactured in this sta te if it is manufactured as described by

157-2. Without the inclusion of any part imp orted from another
158-state other than a generic and insignific ant part.
159-C. For the purposes of this act, a firearm suppressor is
160-manufactured in this sta te if it is manufactured as described by
161151 subsection B of this section without regard to whether a firear m
162152 imported into this state from another state is attached to or use d
163153 in conjunction with the suppressor.
164154 D. A firearm suppressor that is manufactured i n this state and
165155 remains in this state is not subject to federal law or federal
166156 regulation, including re gistration, under the authority of the
167157 United States Congress to re gulate interstate commerce.
168158 E. A basic material from which a firearm suppressor is
169159 manufactured in this state, including unmachined steel , is not a
170160 firearm suppressor and is not subject to federal regulation under
171161 the authority of the United States Congre ss to regulate interstate
172162 commerce as if it actually were a firearm suppressor.
173163 F. A firearm suppressor manufactured and sold in this sta te
174164 must have the words "Made in Oklahoma" clearly stamped, machined or
175165 engraved on the firearm suppressor.
176166 G. On written notification to th e Office of the Attorney
177167 General of this state by a United Stat es citizen who resides in this
178168 state of the intent of the citizen to manufa cture a firearm
179169 suppressor to which subsection D of this section applies, the
180170 Attorney General shall seek a declarator y judgment from a federal
171+district court in this state that sub section D of this section is
172+consistent with the United States Constitution .
173+H. The provisions of this section shall apply to:

208-district court in this state that sub section D of this section is
209-consistent with the United States Constitution .
210-H. The provisions of this section shall apply to:
211200 1. The State of Oklahoma, including an agency, department,
212201 commission, bureau, board, office, council, court, or other entity
213202 that is in any branch of state government and that is created by the
214203 Oklahoma Constitution or a statute of this state, including a
215204 university system or a system of higher education;
216205 2. The governing body of a municipality, county, district, or
217206 authority; and
218207 3. An officer, employee, or other body that is part of a
219208 municipality, county, special district or authority, including a
220209 sheriff, municipal police department, municipal attorney or district
221210 attorney.
222211 I. An entity described by subsection H of this sec tion may not
223212 adopt a rule, order, ordinance, or policy under which the enti ty
224213 enforces or, by consistent action, allows the enforcement of, a
225214 federal statute, order, rule, or regulation that purports to
226215 regulate a firearm suppressor if the statute, order, rule, or
227216 regulation imposes a prohibition, restriction, or other regulation
228217 that does not exist under the laws of this state.
229218 J. No entity described by subsection H of this section and no
230219 person employed by or otherwise under the direction or control of
231220 the entity may enforce or attempt to enforce any federal statute,
221+order, rule, or regulation described by subsection I of this
222+section.

259-order, rule, or regulation described by subsection I of this
260-section.
261249 K. An entity described by subsection H of this section may not
262250 receive state grant funds if the entity adopts a rule, or der,
263251 ordinance, or policy under which the entity enforces a federal law
264252 described by subsection I of this section or, by consistent action,
265253 allows the enforcement of a federal law described by subsec tion I of
266254 this section.
267255 L. State grant funds for the ent ity shall be denied for the
268256 fiscal year following the year in which a final judicial
269257 determination in an action brought under the provisions of this act
270258 is made that the entity has violated subsectio n I of this section.
271259 M. Any citizen residing in the juri sdiction of an entity
272260 described by subsection H of this section may file a complaint with
273261 the Office of the Attorney General if the citizen offers evidence to
274262 support an allegation that the entity ha s adopted a rule, order,
275263 ordinance, or policy under which the entity enforces a federal law
276264 described by subsection I of this sectio n or that the entity, by
277265 consistent action, allows the enforcement of a federal law described
278266 by subsection I of this sectio n. The citizen shall include with the
279267 complaint any evidence the citizen has in support of the complaint.
280268 N. If the Attorney Gener al determines that a complaint filed
281269 under subsection M of this section against an entity described by
282270 subsection H of this section is valid, the Attorney General may file
271+a petition for a writ of mandamus or apply for other appropriate
272+equitable relief in the District Court of Oklaho ma County or in a

310-a petition for a writ of mandamus or apply for other appropriate
311-equitable relief in the District Court of Oklaho ma County or in a
312299 county in which the principal office of the entity is located. The
313300 Attorney General may recover reasonable expenses incurred obtainin g
314301 relief under this subsection, including court costs, reasonable
315302 attorney fees, investigative costs, wi tness fees, and deposition
316303 costs.
317304 O. An appeal of a suit brought under subsection N of this
318305 section shall be governed by the procedures for appeals in civil
319306 cases under the Oklahoma Rules of Appellate Procedure. The
320307 appellate court shall render its final order or judgment with the
321308 least possible delay.
322309 SECTION 3. It being immediately necessary for the preservation
323310 of the public peace, h ealth or safety, an emergency is hereby
324311 declared to exist, by reason whereo f this act shall take effect and
325312 be in full force from and after its passage an d approval.
