5454 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5555 SECTION 1. NEW LAW A new section of law to be codified
5656 in the Oklahoma Statutes as Section 401 of Title 61, unless there is
5757 created a duplication in numbering, reads as follow s:
5858 A. This act shall be known and may be cited as the "Safety
5959 Training for Employees Performing Construction Work with
6060 Governmental Entities ".
6161 B. As used in this section:
6262 1. "Construction contract " means a contract or agreement for
6363 the performance of ge neral construction for a governmental entity;

9090 2. "Construction safety training " means a construction and
9191 general industry safety training class approved by the federal
9292 Occupational Safety and Health Administration that is at least ten
9393 (10) hours in duration;
9494 3. "Contractor" means a person, firm or corporation contracting
9595 with a governmental entity for general construction;
9696 4. "Employee" means an individual paid by a contractor or
9797 subcontractor to perform genera l construction work or services;
9898 5. "General construction" means:
9999 a. erecting or preparing to erect a structure, including
100100 a building, bridge, roadway, public utility facility,
101101 or related structure,
102102 b. remodeling, extending, repair ing or demolishing a
103103 structure, or
104104 c. otherwise improving real prope rty or a structure
105105 related to real property;
106106 6. "Governmental entity" means this state, a political
107107 subdivision of this state, including a municipality, county, public
108108 school district, or authority; and
109109 7. "Subcontractor" means a person, firm or corporation
110110 contracting with a contractor for general c onstruction.
111111 C. To the extent consistent with federal law, a governmental
112112 entity that enters into a construction contract shall require that
113113 the contractor ensure that all employees working on the general

140140 construction site that is the subject of the construction contract
141141 have successfully completed construction safety training. Before an
142142 employee works on the general construction site, the contractor
143143 shall receive and provide to the governmental entity a cert ificate
144144 of training completion for the employee.
145145 D. A governmental entity that enters into a construction
146146 contract shall include in the contract notice and penalty provisions
147147 that:
148148 1. Require the governmental entity to provide the contractor
149149 with written notice, hand delivered or by certified mail, of a
150150 violation of subsection C of this section by the contractor;
151151 2. Require the contractor to comply with subsection C of this
152152 section by the twentieth day after the date the contractor receives
153153 any notice of noncompliance with that subsection;
154154 3. Inform a contractor that the governmental entity may impose
155155 an administrative penalty if the contractor fails to comply with
156156 subsection C of this section after the twentieth day after the date
157157 the contractor receive s any notice of noncompliance with that
158158 subsection; and
159159 4. Explain that a penalty amount may be withheld from a payment
160160 otherwise owed to the contractor under the construction contract.
161161 E. The amount of a penalty imposed under paragraph 3 of
162162 subsection D of this section shall be One Hundred Dollars ($100.00)
163163 per day for each employee working in noncompliance.

190190 F. Each governmental entity shall develop procedures for the
191191 administration of this section.
192192 SECTION 2. This act shall become effe ctive November 1, 2023.
