41	41	creating the Safety Training for Employees Performing
42	42	Construction Work wit h Governmental Entities;
43	43	defining terms; requiring certain contracts to
44	44	provide for construction safety training; providing
45	45	for notice and penalty; providing for administration
46	46	of act; providing for codification; and providing an
47	47	effective date.

54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. NEW LAW A new section of law to be codified
56	56	in the Oklahoma Statutes as Section 401 of Title 61, unless there is
57	57	created a duplication in numbering, reads as follow s:
58	58	A. This act shall be known and may be cited as the "Safety
59	59	Training for Employees Performing Construction Work with
60	60	Governmental Entities ".
61	61	B. As used in this section:
62	62	1. "Construction contract " means a contract or agreement for
63	63	the performance of ge neral construction for a governmental entity;

90	90	2. "Construction safety training " means a construction and
91	91	general industry safety training class approved by the federal
92	92	Occupational Safety and Health Administration that is at least ten
93	93	(10) hours in duration;
94	94	3. "Contractor" means a person, firm or corporation contracting
95	95	with a governmental entity for general construction;
96	96	4. "Employee" means an individual paid by a contractor or
97	97	subcontractor to perform genera l construction work or services;
98	98	5. "General construction" means:
99	99	a. erecting or preparing to erect a structure, including
100	100	a building, bridge, roadway, public utility facility,
101	101	or related structure,
102	102	b. remodeling, extending, repair ing or demolishing a
103	103	structure, or
104	104	c. otherwise improving real prope rty or a structure
105	105	related to real property;
106	106	6. "Governmental entity" means this state, a political
107	107	subdivision of this state, including a municipality, county, public
108	108	school district, or authority; and
109	109	7. "Subcontractor" means a person, firm or corporation
110	110	contracting with a contractor for general c onstruction.
111	111	C. To the extent consistent with federal law, a governmental
112	112	entity that enters into a construction contract shall require that
113	113	the contractor ensure that all employees working on the general

140	140	construction site that is the subject of the construction contract
141	141	have successfully completed construction safety training. Before an
142	142	employee works on the general construction site, the contractor
143	143	shall receive and provide to the governmental entity a cert ificate
144	144	of training completion for the employee.
145	145	D. A governmental entity that enters into a construction
146	146	contract shall include in the contract notice and penalty provisions
147	147	that:
148	148	1. Require the governmental entity to provide the contractor
149	149	with written notice, hand delivered or by certified mail, of a
150	150	violation of subsection C of this section by the contractor;
151	151	2. Require the contractor to comply with subsection C of this
152	152	section by the twentieth day after the date the contractor receives
153	153	any notice of noncompliance with that subsection;
154	154	3. Inform a contractor that the governmental entity may impose
155	155	an administrative penalty if the contractor fails to comply with
156	156	subsection C of this section after the twentieth day after the date
157	157	the contractor receive s any notice of noncompliance with that
158	158	subsection; and
159	159	4. Explain that a penalty amount may be withheld from a payment
160	160	otherwise owed to the contractor under the construction contract.
161	161	E. The amount of a penalty imposed under paragraph 3 of
162	162	subsection D of this section shall be One Hundred Dollars ($100.00)
163	163	per day for each employee working in noncompliance.

190	190	F. Each governmental entity shall develop procedures for the
191	191	administration of this section.
192	192	SECTION 2. This act shall become effe ctive November 1, 2023.
