AS INTRODUCED 
 
An Act relating to schools; amending 70 O.S. 2021, 
Section 14-106, which relates to the Oklahoma 
Department of Career and Technology Edu cation 
equipment pool; creating an exception for use of 
equipment pool; authorizing technology center school 
district board of education to donate certain 
equipment; providing for terms of donation; 
specifying eligible recipients of donation ; and 
providing an effective date. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     AMENDATORY     70 O.S. 2021, Section 14 -106, is 
amended to read as follows: 
Section 14-106. A.  The 1.  Except as provided in subsection B 
of this section, the Oklahoma Department of Career and Technology 
Education may operate and maintain an equipment pool, at which there 
shall be kept equipment for the use of technolo gy center school 
districts and schools supported by publi c funds, and said department 
the Department and schools shall be eligible for surplus property 
and equipment.

B. 2. Whenever the Department determines that any such a 
district or school has, and doe s not have a need for, equipment 
purchased wholly or partly with state or federal funds, it may, if 
consistent with federal laws and regulations, order the equipment 
transferred to the equipment pool; and the district or school, or 
its officials thereof, shall thereupon have the duty to comply with 
such the order.  Provided, any equipment which has been purchased 
wholly or in part with local school funds shall require the 
concurrence of the governing board of that local school before the 
equipment shall be transferred to the state equipment pool. 
C. 3. Whenever the Department determines that a technology 
center school district or school supported by public funds has a 
need for any equipment in the equipment pool, the Department may 
transfer the equipment to such district or school. 
B.  The board of education of a technology center school 
district is authorized, in its discretion , consistent with federal 
laws and regulations, and upon terms, conditions, and for such 
consideration as it deems advisable, to donate obsolete, surplus, or 
unneeded equipment, which it may have, to the board of education of 
a school district or technology center school district in the state 
for use in connection with any training, maintenance , or other 
similar educational program administered by the school district or 
technology center school district .

D. C.  The State Board of Career and Technology Education shall 
adopt and enforce such rules as it deems necessary to carry out the 
provisions of this section. 
SECTION 2. This act shall become effective November 1, 2023.
