50	50	BE IT ENACTED BY THE PE OPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. NEW LAW A new sect ion of law to be codified
52	52	in the Oklahoma Statutes as Section 4201.1 of Title 59, unless there
53	53	is created a duplication in numbering, reads as follows:
54	54	As used in this act:
55	55	1. "Accreditation Commission for Acupuncture and Herbal
56	56	Medicine" or "ACAHM" means the national organization that oversees
57	57	and credentials acupuncture college programs of study ;
58	58	2. "Acupuncture and Asian medicine" means a system of primary
59	59	health care for the prevention, di agnosis, and treatment of human
60	60	health conditions, injury , and disease; the promotion or restoration
61	61	of health; and the support and stim ulation of a patient 's inherent
62	62	self-healing processes thr ough patient education and the use of

89	89	acupuncture and Asian medicinal therapies and therapeutic
90	90	substances;
91	91	3. "Acupuncture physical application " means the therapeutic use
92	92	by licensed acupuncturists of the actions or devices of electrical
93	93	muscle stimulation, ga lvanic, diathermy, ultrasound, ultraviolet
94	94	light, sauna, infrared light therapy, biofeedback, musculoskeletal
95	95	technique, and therapeutic exercise ;
96	96	4. "Approved acupuncture and Asian medical program" means an
97	97	acupuncture and Asian medical education program in the United S tates
98	98	or abroad that meets the requirem ents for accreditation by the
99	99	Accreditation Commission for Acupu ncture and Herbal Medicine (ACAHM)
100	100	or an equivalent federally recognized accrediting body for the
101	101	acupuncture and Asian medical profession recognized b y the
102	102	Acupuncture and Asian Medicine Committee created in Section 2 of
103	103	this act, or the State Department of Health. This program must be
104	104	an institution, or part of an institution, of higher education that
105	105	at the time the student completes the program is :
106	106	a. either accredited or is a candidate for accredi tation
107	107	by a regional institutional accrediting agency
108	108	recognized by the State of Oklahoma or the United
109	109	States Department of Education, or
110	110	b. a degree-granting college or university that:
111	111	(1) prior to the existen ce of ACAHM offered a full-
112	112	time structured curricu lum in acupuncture and

139	139	supervised patient care which constituted a
140	140	master's level acupuncture education program that
141	141	was equivalent to the requirements of ACA HM,
142	142	(2) is reputable, and
143	143	(3) is in good standing in the jud gment of the State
144	144	Department of Health;
145	145	5. "Approved substances" means over-the-counter substances,
146	146	food extracts, vitamins, minerals, or other dietary supplements,
147	147	botanical preparations, and a limited formulary of legend drugs ;
148	148	6. "Committee" means the Acupuncture and Asian Medicine
149	149	Committee;
150	150	7. "Department" means the State Department of Health;
151	151	8. "License" means the document of authorization issued by the
152	152	State Department of Health for a person to engage in the practice of
153	153	acupuncture and Asian medicine;
154	154	9. "Licensed acupuncturist" means a practitioner of acupuncture
155	155	and Asian medicine who has been proper ly licensed for that purpose;
156	156	10. "National Certification Commission for Acupun cture and
157	157	Oriental Medicine" or "NCCAOM" means the national credentialing body
158	158	of acupuncturists which det ermines if an individual has completed
159	159	the requirements to be el igible to sit for the national board exams.
160	160	The Commission also administers the national board exams; and
161	161	11. "Practicing acupuncture and Asian medici ne" means the
162	162	surgical use of single -use needles inserted into and removed from

190	190	penetrate the skin and stimulate under lying myofascial trigger
191	191	points and muscular and connective tissues f or the management of
192	192	neuromusculoskeletal pain and movement im pairments, treat
193	193	dysfunctions in skeletal muscle, fascia, and connect ive tissue,
194	194	diminish persistent peripheral nociceptiv e input, and reduce or
195	195	restore impairments of bod y structure and functio n leading to
196	196	improved activity and participation . Practicing acupuncture and
197	197	Asian medicine further means the prevention, cure , or correction of
198	198	any disease, illness, injury, pain , or other condition.
199	199	Furthermore, practicing acupuncture and Asian m edicine means to
200	200	restore and maintain an individual's health. Practicing acupuncture
201	201	and Asian medicine includes, but is not limited to , utilizing
202	202	acupuncture, dry needling, herbs, tuina, massage, cupping, injection
203	203	therapy, auriculotherapy, gua sha, Eastern medicine nutrition,
204	204	therapeutic exercise, moxibust ion therapy, electrostimulation,
205	205	electro-cupping, bloodletting, interpreting bloodwork results,
206	206	manual therapy, vitami ns, injectable substances, and Chinese herbal
207	207	formulas which licensed acupuncturists use i n the practice of their
208	208	profession.
209	209	SECTION 2. NEW LAW A new section of law to be codified

238	238	A. There is hereby established the Acupuncture and Asian
239	239	Medicine Committee to assist the S tate Department of Health in
240	240	approval for applicants and to advise the Department on all matters
241	241	pertaining to the licensure, education , and continuing education of
242	242	licensed acupuncturists and the practice of acupunctu re and Asian
243	243	medicine.
244	244	B. The Acupuncture and Asian Medicine Committee shall consist
245	245	of seven (7) members who shall be appoint ed by the State Department
246	246	of Health as follows:
247	247	1. Four members who are licensed to prac tice acupuncture and
248	248	Asian medicine. Nominations for these four members shall be
249	249	submitted by the Oklahoma Society of Acupunctur ists and Asian
250	250	Medicine;
251	251	2. One member who is a layperson who is not and who has never
252	252	been licensed to practice acupuncture a nd Asian medicine, or is a
253	253	member of any closely related profession;
254	254	3. One member from the State of Department of Health; and
255	255	4. One member who is licensed by the State Board of Medical
256	256	Licensure and Supervision.
257	257	C. Members of the Committee shall be ap pointed for terms of
258	258	four (4) years or for the remainder of an unexpired term of a
259	259	vacancy. Members shall serve at the pleasure of the appointing
260	260	authority. Vacancies on the Committee shall be filled by the
261	261	Committee in the same manner as the original ap pointment.

288	288	D. Members of the Committee shall no t be compensated but may be
289	289	reimbursed for all actual and necessary expenses incurred in the
290	290	performance of duties.
291	291	E. The Committee shall have the power and duty to:
292	292	1. Assist the State Department of Health in promulgating rules;
293	293	2. Assist in approving courses for continuing education units
294	294	and in determining which applicants have met the requirements set
295	295	forth by the Department and the Committee ;
296	296	3. Advise the State Department of Health on all matters
297	297	pertaining to the licensure, education, and continuing education
298	298	requirements for the practice of acupunct ure and Asian medicine in
299	299	this state;
300	300	4. Assist and advise in all hearings involving licensed
301	301	acupuncturists who are deemed to be in violation of this act; and
302	302	5. Establish and maintain a reasonable fees and fines schedule.
303	303	SECTION 3. This act shall become effective November 1, 2023.
