4040 An Act relating to acupuncture and Asian medicine;
4141 defining terms; establishing the Acupuncture and
4242 Asian Medicine Committee; providing for membership,
4343 terms, reimbursement policy, and powers and duties of

5050 BE IT ENACTED BY THE PE OPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. NEW LAW A new sect ion of law to be codified
5252 in the Oklahoma Statutes as Section 4201.1 of Title 59, unless there
5353 is created a duplication in numbering, reads as follows:
5454 As used in this act:
5555 1. "Accreditation Commission for Acupuncture and Herbal
5656 Medicine" or "ACAHM" means the national organization that oversees
5757 and credentials acupuncture college programs of study ;
5858 2. "Acupuncture and Asian medicine" means a system of primary
5959 health care for the prevention, di agnosis, and treatment of human
6060 health conditions, injury , and disease; the promotion or restoration
6161 of health; and the support and stim ulation of a patient 's inherent
6262 self-healing processes thr ough patient education and the use of

8989 acupuncture and Asian medicinal therapies and therapeutic
9090 substances;
9191 3. "Acupuncture physical application " means the therapeutic use
9292 by licensed acupuncturists of the actions or devices of electrical
9393 muscle stimulation, ga lvanic, diathermy, ultrasound, ultraviolet
9494 light, sauna, infrared light therapy, biofeedback, musculoskeletal
9595 technique, and therapeutic exercise ;
9696 4. "Approved acupuncture and Asian medical program" means an
9797 acupuncture and Asian medical education program in the United S tates
9898 or abroad that meets the requirem ents for accreditation by the
9999 Accreditation Commission for Acupu ncture and Herbal Medicine (ACAHM)
100100 or an equivalent federally recognized accrediting body for the
101101 acupuncture and Asian medical profession recognized b y the
102102 Acupuncture and Asian Medicine Committee created in Section 2 of
103103 this act, or the State Department of Health. This program must be
104104 an institution, or part of an institution, of higher education that
105105 at the time the student completes the program is :
106106 a. either accredited or is a candidate for accredi tation
107107 by a regional institutional accrediting agency
108108 recognized by the State of Oklahoma or the United
109109 States Department of Education, or
110110 b. a degree-granting college or university that:
111111 (1) prior to the existen ce of ACAHM offered a full-
112112 time structured curricu lum in acupuncture and

139139 supervised patient care which constituted a
140140 master's level acupuncture education program that
141141 was equivalent to the requirements of ACA HM,
142142 (2) is reputable, and
143143 (3) is in good standing in the jud gment of the State
144144 Department of Health;
145145 5. "Approved substances" means over-the-counter substances,
146146 food extracts, vitamins, minerals, or other dietary supplements,
147147 botanical preparations, and a limited formulary of legend drugs ;
148148 6. "Committee" means the Acupuncture and Asian Medicine
149149 Committee;
150150 7. "Department" means the State Department of Health;
151151 8. "License" means the document of authorization issued by the
152152 State Department of Health for a person to engage in the practice of
153153 acupuncture and Asian medicine;
154154 9. "Licensed acupuncturist" means a practitioner of acupuncture
155155 and Asian medicine who has been proper ly licensed for that purpose;
156156 10. "National Certification Commission for Acupun cture and
157157 Oriental Medicine" or "NCCAOM" means the national credentialing body
158158 of acupuncturists which det ermines if an individual has completed
159159 the requirements to be el igible to sit for the national board exams.
160160 The Commission also administers the national board exams; and
161161 11. "Practicing acupuncture and Asian medici ne" means the
162162 surgical use of single -use needles inserted into and removed from

189189 the body and the use of other devices, modalitie s, and procedures to
190190 penetrate the skin and stimulate under lying myofascial trigger
191191 points and muscular and connective tissues f or the management of
192192 neuromusculoskeletal pain and movement im pairments, treat
193193 dysfunctions in skeletal muscle, fascia, and connect ive tissue,
194194 diminish persistent peripheral nociceptiv e input, and reduce or
195195 restore impairments of bod y structure and functio n leading to
196196 improved activity and participation . Practicing acupuncture and
197197 Asian medicine further means the prevention, cure , or correction of
198198 any disease, illness, injury, pain , or other condition.
199199 Furthermore, practicing acupuncture and Asian m edicine means to
200200 restore and maintain an individual's health. Practicing acupuncture
201201 and Asian medicine includes, but is not limited to , utilizing
202202 acupuncture, dry needling, herbs, tuina, massage, cupping, injection
203203 therapy, auriculotherapy, gua sha, Eastern medicine nutrition,
204204 therapeutic exercise, moxibust ion therapy, electrostimulation,
205205 electro-cupping, bloodletting, interpreting bloodwork results,
206206 manual therapy, vitami ns, injectable substances, and Chinese herbal
207207 formulas which licensed acupuncturists use i n the practice of their
208208 profession.
209209 SECTION 2. NEW LAW A new section of law to be codified
210210 in the Oklahoma Statutes as Section 4201.2 of Title 59, unless there

238238 A. There is hereby established the Acupuncture and Asian
239239 Medicine Committee to assist the S tate Department of Health in
240240 approval for applicants and to advise the Department on all matters
241241 pertaining to the licensure, education , and continuing education of
242242 licensed acupuncturists and the practice of acupunctu re and Asian
243243 medicine.
244244 B. The Acupuncture and Asian Medicine Committee shall consist
245245 of seven (7) members who shall be appoint ed by the State Department
246246 of Health as follows:
247247 1. Four members who are licensed to prac tice acupuncture and
248248 Asian medicine. Nominations for these four members shall be
249249 submitted by the Oklahoma Society of Acupunctur ists and Asian
250250 Medicine;
251251 2. One member who is a layperson who is not and who has never
252252 been licensed to practice acupuncture a nd Asian medicine, or is a
253253 member of any closely related profession;
254254 3. One member from the State of Department of Health; and
255255 4. One member who is licensed by the State Board of Medical
256256 Licensure and Supervision.
257257 C. Members of the Committee shall be ap pointed for terms of
258258 four (4) years or for the remainder of an unexpired term of a
259259 vacancy. Members shall serve at the pleasure of the appointing
260260 authority. Vacancies on the Committee shall be filled by the
261261 Committee in the same manner as the original ap pointment.

288288 D. Members of the Committee shall no t be compensated but may be
289289 reimbursed for all actual and necessary expenses incurred in the
290290 performance of duties.
291291 E. The Committee shall have the power and duty to:
292292 1. Assist the State Department of Health in promulgating rules;
293293 2. Assist in approving courses for continuing education units
294294 and in determining which applicants have met the requirements set
295295 forth by the Department and the Committee ;
296296 3. Advise the State Department of Health on all matters
297297 pertaining to the licensure, education, and continuing education
298298 requirements for the practice of acupunct ure and Asian medicine in
299299 this state;
300300 4. Assist and advise in all hearings involving licensed
301301 acupuncturists who are deemed to be in violation of this act; and
302302 5. Establish and maintain a reasonable fees and fines schedule.
303303 SECTION 3. This act shall become effective November 1, 2023.
