50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. AMENDATORY 70 O.S. 2021, Section 11 -105.1, is
52	52	amended to read as follows:
53	53	Section 11-105.1 A. All curriculum and materials including
54	54	supplementary materials which will be used to teach or will be used
55	55	for or in connection with a sex education class or program which is
56	56	designed for the exclusive purpose of discussing sexual behavior or
57	57	attitudes, or any test, survey , or questionnaire whose primary
58	58	purpose is to elicit responses on sexual behavior or attitudes shall
59	59	be available through the superintendent or a designee of the sch ool
60	60	district for inspectio n by parents and guardians of the student who
61	61	will be involved with the class, program or, test, survey, or
62	62	questionnaire. Such

89	89	B. The curriculum, materials, classes, programs, tests,
90	90	surveys, or questionnaires shall include information ab out consent
91	91	and shall have as one of its primary purposes the teaching of or
92	92	informing students about the practice of abstinence. For the
93	93	purposes of this section, "consent" shall have the same meaning as
94	94	that provided by Section 113 of Title 21 of the Ok lahoma Statutes.
95	95	The curriculum, materials, classes, programs, tests, surveys , or
96	96	questionnaires shall include information about state laws and
97	97	criminal penalties including, but not limited to:
98	98	1. Age of consent for sexual intercourse ;
99	99	2. Child pornography and disseminating nude photographs; and
100	100	3. Nonconsensual dissemi nation of private sexual images .
101	101	C. The superintendent or a designee of the school district
102	102	shall provide prior written notification to the parents or guardians
103	103	of the students involved of their right to inspect the curriculum
104	104	and material and of their obligation to notify the school in writing
105	105	if they do not want their child to participate in the class,
106	106	program, test, survey , or questionnaire. Each local board of
107	107	education shall determine the means of providing written
108	108	notification to the parents and guardian which will ens ure effective
109	109	notice in an efficient and appropriate manner. No student shall be
110	110	required to participate in a sex education class or program which
111	111	discusses sexual behavior or attit udes if a parent or guardian of
112	112	the student objects in writing to such par ticipation. If the type

139	139	of program referred to in this section is a part of or is taught
140	140	during a credit course, a student may be required to enroll in the
141	141	course but shall not be r equired to receive instruction in or
142	142	participate in the program if a paren t or guardian objects in
143	143	writing.
144	144	B. D. The superintendent or a designee of a school district in
145	145	which sex education is taught or a program is offered which is
146	146	designed for the excl usive purpose of discussing sexual behavior or
147	147	attitudes shall approve all cu rriculum and materials which will be
148	148	used for such education and any test, survey , or questionnaire whose
149	149	primary purpose is to elicit responses on sexual behavior or
150	150	attitudes used in the school prior to their use in the classroom or
151	151	school. The teacher i nvolved in the class, program, testing , or
152	152	survey shall submit the curriculum, materials, tests , or surveys to
153	153	the superintendent or a designee for approval prior to their use in
154	154	the classroom or school. This section shall not apply to those
155	155	students enrolled in classes, programs, testings , or surveys offered
156	156	through an alternative education program.
157	157	SECTION 2. This act shall become effective November 1, 2023.
