5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. AMENDATORY 70 O.S. 2021, Section 11 -105.1, is
5252 amended to read as follows:
5353 Section 11-105.1 A. All curriculum and materials including
5454 supplementary materials which will be used to teach or will be used
5555 for or in connection with a sex education class or program which is
5656 designed for the exclusive purpose of discussing sexual behavior or
5757 attitudes, or any test, survey , or questionnaire whose primary
5858 purpose is to elicit responses on sexual behavior or attitudes shall
5959 be available through the superintendent or a designee of the sch ool
6060 district for inspectio n by parents and guardians of the student who
6161 will be involved with the class, program or, test, survey, or
6262 questionnaire. Such

8989 B. The curriculum, materials, classes, programs, tests,
9090 surveys, or questionnaires shall include information ab out consent
9191 and shall have as one of its primary purposes the teaching of or
9292 informing students about the practice of abstinence. For the
9393 purposes of this section, "consent" shall have the same meaning as
9494 that provided by Section 113 of Title 21 of the Ok lahoma Statutes.
9595 The curriculum, materials, classes, programs, tests, surveys , or
9696 questionnaires shall include information about state laws and
9797 criminal penalties including, but not limited to:
9898 1. Age of consent for sexual intercourse ;
9999 2. Child pornography and disseminating nude photographs; and
100100 3. Nonconsensual dissemi nation of private sexual images .
101101 C. The superintendent or a designee of the school district
102102 shall provide prior written notification to the parents or guardians
103103 of the students involved of their right to inspect the curriculum
104104 and material and of their obligation to notify the school in writing
105105 if they do not want their child to participate in the class,
106106 program, test, survey , or questionnaire. Each local board of
107107 education shall determine the means of providing written
108108 notification to the parents and guardian which will ens ure effective
109109 notice in an efficient and appropriate manner. No student shall be
110110 required to participate in a sex education class or program which
111111 discusses sexual behavior or attit udes if a parent or guardian of
112112 the student objects in writing to such par ticipation. If the type

139139 of program referred to in this section is a part of or is taught
140140 during a credit course, a student may be required to enroll in the
141141 course but shall not be r equired to receive instruction in or
142142 participate in the program if a paren t or guardian objects in
143143 writing.
144144 B. D. The superintendent or a designee of a school district in
145145 which sex education is taught or a program is offered which is
146146 designed for the excl usive purpose of discussing sexual behavior or
147147 attitudes shall approve all cu rriculum and materials which will be
148148 used for such education and any test, survey , or questionnaire whose
149149 primary purpose is to elicit responses on sexual behavior or
150150 attitudes used in the school prior to their use in the classroom or
151151 school. The teacher i nvolved in the class, program, testing , or
152152 survey shall submit the curriculum, materials, tests , or surveys to
153153 the superintendent or a designee for approval prior to their use in
154154 the classroom or school. This section shall not apply to those
155155 students enrolled in classes, programs, testings , or surveys offered
156156 through an alternative education program.
157157 SECTION 2. This act shall become effective November 1, 2023.
