6356 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6457 SECTION 1. AMENDATORY 63 O.S. 2021, Section 420, as
6558 amended by Section 1, Chapter 251, O.S.L. 2022 (63 O.S. Supp. 2022,
6659 Section 420), is amended to read as follows:
6760 Section 420. A. A person in possession of a state-issued
6861 medical marijuana patient license shall be able to:
6962 1. Consume marijuana legally;
63+2. Legally possess up to three (3) ounces or eighty-four and
64+nine-tenths (84.9) grams of marijuana on their person;

97-2. Legally possess up to three (3) ounces or eighty-four and
98-nine-tenths (84.9) grams of marijuana on their person;
9991 3. Legally possess six mature marijuana plants and the
10092 harvested marijuana therefrom;
10193 4. Legally possess six seedli ng plants;
10294 5. Legally possess one (1) ounce or twenty-eight and three-
10395 tenths (28.3) grams of concentrated marijuana;
10496 6. Legally possess sevent y-two (72) ounces or two thousand
10597 thirty-seven and six-tenths (2,037.6) grams of edible marijuana;
10698 7. Legally possess up to eight (8) ounces or two hundred
10799 twenty-six and four-tenths (226.4) grams of marijuana in their
108100 residence; and
109101 8. Legally possess s eventy-two (72) ounces of topical
110102 marijuana.
111103 B. Possession of up to one and one-half (1.5) ounces or forty -
112104 two and forty-five one-hundredths (42.45) grams of marijuana by
113105 persons who can state a medical condition, but are not in possession
114106 of a state-issued medical marijuana patient license, shall
115107 constitute a misdemeanor offense not subject to imprisonment but
116108 punishable by a fine not to exceed Four Hundred Dollars ($400.00).
117109 Any law enforcement officer who comes in contact with a person in
118110 violation of this subsection and who is satisfied as to the identity
119111 of the person, as well as any other pertinent informatio n the law
120112 enforcement officer deems necessary, shall issue to the person a
113+written citation containing a notice to answer the charge against
114+the person in the appropriate court. Upon receiving the written

148-written citation containing a notice to answer the charge against
149-the person in the appropriate court. Upon receiving the written
150141 promise of the alleged violator to answer as speci fied in the
151142 citation, the law enforcement officer shall release the person upon
152143 personal recognizance unless there has been a violation of anoth er
153144 provision of law.
154145 C. The Oklahoma Medical Marijuana Authority shall be
155146 established which shall receive applications for medical marijuana
156147 patient and caregiver license recipients, dispensaries, growers and
157148 processors within sixty (60) days of the passage o f this initiative.
158149 D. The Authority shall, within thirty (30) days of pa ssage of
159150 this initiative, make available on its website, in an easy-to-find
160151 location, an application for a medical marijuana patient license.
161152 The license shall be valid for two (2) years. The bian nual
162153 application fee shall be One Hundred Dollars ($100.00 ), or Twenty
163154 Dollars ($20.00) for individuals on Medicaid, Medicare or
164155 SoonerCare. The methods of payment shall be provided on the website
165156 of the Authority. Reprints of the medical marijuana pat ient license
166157 shall be Twenty Dollars ($20.00).
167158 E. A short-term medical marijuana patient license application
168159 shall also be made available on the website of the Authority. A
169160 short-term medical marijuana patient license shall be granted to any
170161 applicant who can meet the requirements for a two-year medical
171162 marijuana patient license, but whose physician recommendation for
163+medical marijuana is only valid for sixty (60) days. Short-term
164+medical marijuana patient licenses shall be iss ued for sixty (60)

199-medical marijuana is only valid for sixty (60) days. Short-term
200-medical marijuana patient licenses shall be iss ued for sixty (60)
201191 days. The fee for a short-term medical marijuana patient license,
202192 reprints of the short-term medical marijuana patient licen se and the
203193 procedure for extending or renewing the license shall be determined
204194 by the Executive Director of the Authority.
205195 F. A temporary nonresident medical marijuana patient license
206196 application shall also be available on the website of the Authority
207197 for residents of other states. Temporary Nonresident medical
208198 marijuana patient licenses shall be gra nted to medical marijuana
209199 license holders from other states, provided that such states have
210200 state-regulated medical marijuana programs and app licants can prove
211201 they are members of such programs the patient is under the care of a
212202 licensed Oklahoma physician located within the State of Oklahoma .
213203 Temporary Nonresident medical marijuana patient licenses shall be
214204 issued for thirty (30) days two (2) years. The cost for a temporary
215205 nonresident medical marijuana patient license shall be One Hundred
216206 Dollars ($100.00) Two Hundred Fifty Dollars ($250.00). Renewal
217207 shall be granted with resubmission of a new application. No
218208 additional criteria shall be required for adult medical mari juana
219209 patients but medical marijuana patients who are eighteen (18) years
220210 of age or younger shall meet the requirements provided for in
221211 subsection L of this s ection. Reprints of the temporary nonresident
222212 medical marijuana patient license shall be Twe nty Dollars ($20.00).
213+G. Medical marijuana patient license applicants shall submit
214+their applications to the Authority for approval. The applicant

250-G. Medical marijuana patient license applicants shall submit
251-their applications to the Authority for approval. The applicant
252241 shall be a resident of this state and shall prove residency by a
253242 valid driver license, utility b ills, or other accepted methods.
254243 H. The Authority shall review the medical marijuana patient
255244 license application; approve, reject or deny the application; and
256245 mail the approval, rejection or denial letter stating any reasons
257246 for the rejection or denial to the applicant within fourteen (14)
258247 business days of receipt of the application. Approved applicants
259248 shall be issued a medical marijuana patient license w hich shall act
260249 as proof of his or her approved status. Applications may o nly be
261250 rejected or denied based on the applicant not meeting stated
262251 criteria or improper completion of the application.
263252 I. The Authority shall make available, both on its website and
264253 through a telephone verification system, an easy method to validate
265254 the authenticity of the medical marijuana patient license by the
266255 unique 24-character identification number.
267256 J. The Authority shall ensure that all medical marijuana
268257 patient and caregiver records and information are sealed to protect
269258 the privacy of medical marijuana patient license applicants.
270259 K. A caregiver license shall be made available for qualified
271260 caregivers of a medical marijua na patient license holder who is
272261 homebound. As provided in Section 427.11 of this title, the
273262 caregiver license shall provide the caregiver the same rights as the
263+medical marijuana patient licensee including the ability to possess
264+marijuana, marijuana prod ucts and mature and immature plants

301-medical marijuana patient licensee including the ability to possess
302-marijuana, marijuana prod ucts and mature and immature plants
303291 pursuant to the Oklahoma Medical Marijuana and Patient Protection
304292 Act, but excluding the ability to use marijuana or marijuana
305293 products unless the caregiver has a medical marijuana patient
306294 license. Applicants for a care giver license shall submit proof of
307295 the license status and homebound status of the medical marijuana
308296 patient and proof that the applicant is the designee of the medical
309297 marijuana patient. The applicant shall also submit proof that he or
310298 she is eighteen (18) years of age or older and proof of his or h er
311299 state residency.
312300 L. All applicants for a medical marijuana patient license shall
313301 be eighteen (18) years of age or older. A special exception shall
314302 be granted to an applicant under the age of eight een (18); however,
315303 these applications shall b e signed by two physicians and the parent
316304 or legal guardian of the applicant.
317305 M. All applications for a medical marijuana patient license
318306 shall be signed by an Oklahoma physician licensed by and in good
319307 standing with the State Board of Medical Licensure and Supervision,
320308 the State Board of Osteopathic Examiners, or the Board of Podiatric
321309 Medical Examiners. There are no qualifying conditions for adult
322310 medical marijuana patients . A medical marijuana patient license
323311 shall be recommended according to the accepted standards a
324312 reasonable and prudent physician would follow when recommending or
313+approving any medication. No physician may be u nduly stigmatized or

352-approving any medication. No physician may be u nduly stigmatized or
353340 harassed for signing a medical marijuana patient license
354341 application.
355342 N. Counties and cities may enact medical marijuana guidelines
356343 allowing medical marijuana patie nt license holders or caregiver
357344 license holders to exceed the state li mits set forth in subsection A
358345 of this section.
359346 SECTION 2. This act shall become effective November 1, 2023.
