4851 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4952 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1992, is
5053 amended to read as fol lows:
5154 Section 1992. A. This section sha ll be known and may be cited
5255 as the "Laser Safety Act".
5356 B. Any person who knowingly and maliciously projects a laser,
5457 as defined in this section, on or at a law enforcement officer
5558 without the consent of the office r while the officer is acting
5659 within the scope of the official duties of the officer shall , upon
5760 conviction, be guilty of a misdemeanor and upon conviction shall be
5861 punished punishable by a fine of not more than One Hundred Dollars
5962 ($100.00) Five Hundred Dollars ($500.00), or by imprisonment in the
6063 county jail for a period of no t more than one (1) year, or by both

8791 such fine and imprisonment. Any person who commits a second or
8892 subsequent violation of this section shall , upon conviction, be
8993 guilty of a misdemeanor felony punishable by a fine of not more than
9094 Five Hundred Dollars ($500.00) One Thousand Dollars ($1, 000.00), a
9195 term of or by imprisonment in the county jail custody of the
9296 Department of Corrections for a period of not more than six (6)
9397 months two (2) years, or by both such fine and impris onment.
9498 C. Anyone who knowingly aims the beam of a laser pointer at a n
9599 aircraft in flight or at the flight path of an aircraft shall , upon
96100 conviction, be guilty of a misdemeanor and upon conviction shall be
97101 punished felony punishable by a fine of not more than One Hundred
98102 Dollars ($100.00) One Thousand Dollars ($1,000.00), or by
99103 imprisonment in the custody of the Depar tment of Corrections for a
100104 period of not less than three (3) months nor more than two (2)
101105 years, or by both such fine and impr isonment. Any person who
102106 commits a second or subsequent violation of this section s hall, upon
103107 conviction, be guilty of a misdemeanor felony punishable by a fine
104108 of not more than Five Hundred Dollars ($500.00) Five Thousand
105109 Dollars ($5,000.00), a term of or by imprisonment in the county jail
106110 custody of the Depar tment of Corrections for a period of not less
107111 than one (1) year nor more than six (6) months five (5) years, or by
108112 both such fine and imprisonment.
109113 D. This section does no t prohibit aiming a beam of a laser
110114 pointer at an aircraft, or the flight path of such an aircraft by:

137142 1. An authorized individual in the conduct of researc h and
138143 development or flight test operations conducted by an aircraft
139144 manufacturer, the Federal Avia tion Administration, or any other
140145 person authorized by the Federal Aviation Administration to conduct
141146 research and development or flight test operations;
142147 2. Members or elements of the Department of Defense or
143148 Department of Homeland Security acting in an o fficial capacity for
144149 the purpose of resea rch, development, operations, testing or
145150 training; or
146151 3. By an individual using a laser emergency signaling device to
147152 send an emergency distress signal.
148153 E. As used in this section:
149154 1. "Laser" or "laser pointer" means any device designed or used
150155 to amplify electromagnetic radiation by stimulated emission that
151156 emits a beam designed to be used by the operator as a point er or
152157 highlighter to indicate, mark or identify a specific position,
153158 place, item or object; and
154159 2. "Law enforcement officer " means any police officer, peace
155160 officer, sheriff, deputy sheriff, correctional offic er, probation or
156161 parole officer, emergency man agement employee, judge, magistrate, or
157162 any employee of a governmental agency who is authorized by law to
158163 engage in the investigation, arres t, prosecution, or supervision of
159164 the incarceration of any person for any violation of law and has
160165 statutory powers of arrest.
