48	51		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
49	52		SECTION 1. AMENDATORY 21 O.S. 2021, Section 1992, is
50	53		amended to read as fol lows:
51	54		Section 1992. A. This section sha ll be known and may be cited
52	55		as the "Laser Safety Act".
53	56		B. Any person who knowingly and maliciously projects a laser,
54	57		as defined in this section, on or at a law enforcement officer
55	58		without the consent of the office r while the officer is acting
56	59		within the scope of the official duties of the officer shall , upon
57	60		conviction, be guilty of a misdemeanor and upon conviction shall be
58	61		punished punishable by a fine of not more than One Hundred Dollars
59	62		($100.00) Five Hundred Dollars ($500.00), or by imprisonment in the
60	63		county jail for a period of no t more than one (1) year, or by both

87	91		such fine and imprisonment. Any person who commits a second or
88	92		subsequent violation of this section shall , upon conviction, be
89	93		guilty of a misdemeanor felony punishable by a fine of not more than
90	94		Five Hundred Dollars ($500.00) One Thousand Dollars ($1, 000.00), a
91	95		term of or by imprisonment in the county jail custody of the
92	96		Department of Corrections for a period of not more than six (6)
93	97		months two (2) years, or by both such fine and impris onment.
94	98		C. Anyone who knowingly aims the beam of a laser pointer at a n
95	99		aircraft in flight or at the flight path of an aircraft shall , upon
96	100		conviction, be guilty of a misdemeanor and upon conviction shall be
97	101		punished felony punishable by a fine of not more than One Hundred
98	102		Dollars ($100.00) One Thousand Dollars ($1,000.00), or by
99	103		imprisonment in the custody of the Depar tment of Corrections for a
100	104		period of not less than three (3) months nor more than two (2)
101	105		years, or by both such fine and impr isonment. Any person who
102	106		commits a second or subsequent violation of this section s hall, upon
103	107		conviction, be guilty of a misdemeanor felony punishable by a fine
104	108		of not more than Five Hundred Dollars ($500.00) Five Thousand
105	109		Dollars ($5,000.00), a term of or by imprisonment in the county jail
106	110		custody of the Depar tment of Corrections for a period of not less
107	111		than one (1) year nor more than six (6) months five (5) years, or by
108	112		both such fine and imprisonment.
109	113		D. This section does no t prohibit aiming a beam of a laser
110	114		pointer at an aircraft, or the flight path of such an aircraft by:

137	142		1. An authorized individual in the conduct of researc h and
138	143		development or flight test operations conducted by an aircraft
139	144		manufacturer, the Federal Avia tion Administration, or any other
140	145		person authorized by the Federal Aviation Administration to conduct
141	146		research and development or flight test operations;
142	147		2. Members or elements of the Department of Defense or
143	148		Department of Homeland Security acting in an o fficial capacity for
144	149		the purpose of resea rch, development, operations, testing or
145	150		training; or
146	151		3. By an individual using a laser emergency signaling device to
147	152		send an emergency distress signal.
148	153		E. As used in this section:
149	154		1. "Laser" or "laser pointer" means any device designed or used
150	155		to amplify electromagnetic radiation by stimulated emission that
151	156		emits a beam designed to be used by the operator as a point er or
152	157		highlighter to indicate, mark or identify a specific position,
153	158		place, item or object; and
154	159		2. "Law enforcement officer " means any police officer, peace
155	160		officer, sheriff, deputy sheriff, correctional offic er, probation or
156	161		parole officer, emergency man agement employee, judge, magistrate, or
157	162		any employee of a governmental agency who is authorized by law to
158	163		engage in the investigation, arres t, prosecution, or supervision of
159	164		the incarceration of any person for any violation of law and has
160	165		statutory powers of arrest.
