4338 An Act relating to alcoholic beverages; providing
4439 that a holder of a small fa rm winery, winemaker, or
4540 small brewer license may serve free samples and s ell
4641 other items; providing that wine or beer may be
4742 served at off-premises locations; providing that at
4843 public events the location occupied by the small farm
4944 winery, winemaker, or small brewer licensee becomes a
5045 licensed premises and extension of the license
5146 holder; requiring a licens ee to establish a serving
5247 area; providing that multiple licensees may combine
5348 their serving areas; providing that a small farm
5449 winery, winemaker, or small brewer licensee shall not
5550 be required to control a consumer leaving the
5651 premises once served; providing there shall not be
5752 any permit or license require d by the event
5853 originator, coordinator, manager, or property owner;
5954 providing for codification; and pr oviding an
6055 effective date.

6560 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6661 SECTION 1. NEW LAW A new section of law to be codified
6762 in the Oklahoma Statutes as Section 2-162 of Title 37A, unless there
6863 is created a duplication in numbering, reads as follows:
6964 A holder of a small farm winery , winemaker, or small brewer
7065 license, which serves wi ne or beer for on-premises or off-premises
66+consumption, with permission from the event coor dinator, manager, or
67+the property owner, shall be allowed to serve free samples of, sell,

98-consumption, with permission from the event coor dinator, manager, or

10094 or serve Oklahoma-manufactured beer, wine, mulled wine, or spiced
10195 wine, mixed with nonalcoholic beverages or food items, such as
10296 water, sugar, fruits and vegetables, at any temperature, wine
10397 produced at the winery or blended on-site at any public event,
10498 including but not limited to festivals, trade shows, boat shows, RV
10599 shows, home and garden shows, fairs, car shows, swap meets, sport ing
106100 events, city events, county events, state events, for either on-
107101 premises or off-premises consumption, including any public events
108102 that are held at the premises which hold a retail beer license,
109103 retail spirits license, mixed beverage license, beer and wine
110104 license, caterer's license, special event license, public event
111105 license, winemaker license, small farm winery license, charitable
112106 auction license, or brewpub license. When attending a public event ,
113107 the location within the event occupied by the small farm wi nery,
114108 winemaker, or small brewer licensee becomes a licensed premises and
115109 extension of the licensed small farm winery , winemaker, or small
116110 brewer license. The licensee shall set up and define an area
117111 contiguous to their booth space as a serving area where the wine or
118112 beer is dispensed. The licensee may only serve the wine or beer in
119113 the serving area. In the event that multiple winemakers or small
120114 brewers are at the same public event, they may combine their serving
121115 areas into one area as long as they are contiguous to the
116+winemakers' or small brewers' booths. A small farm winery,
117+winemaker, or small brewer licensee shall not be required to cont rol

150-winemaker, or small brewer licensee shall not be required to cont rol

159152 SECTION 2. This act shall become effective November 1, 2023.
