40	40	An Act relating to crimes and punishments; amending
41	41	21 O.S. 2021, Sections 1902 and 1903, which relate to
42	42	the Bus Passenger Safety Act; mod ifying scope of
43	43	certain definition; defining terms; expanding scope
44	44	of unlawful acts to include rolling stock transit
45	45	vehicles and transit workers; and declaring an
46	46	emergency.

52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. AMENDATORY 21 O.S. 2021, Section 1902, is
54	54	amended to read as follows:
55	55	Section 1902. As used in the Bus Passenger Safety Act:
56	56	1. "Bus" means a vehicle designed to carry passengers that is
57	57	part of a network of passenger vehicles for use by the public,
58	58	running on a regular schedule of routes, times and fares;
59	59	2. "Bus transportation company" or "company" means any person
60	60	or governmental entity providing for-hire transport to passengers or
61	61	cargo by bus rolling stock transit vehicles upon the roads, streets,
62	62	highways and turnpikes of this state;

89	89	3. "Deadly or dangerous weapon" includes all weapons listed in
90	90	Section 1287 of this title, and any ot her weapon capable of
91	91	inflicting serious bodily injury, except for a weapon carried for
92	92	lawful self-defense in compliance under the Oklahoma Self Defense
93	93	Act;
94	94	4. "Passenger" means any person served by the bu s
95	95	transportation company; and
96	96	5. "Rolling stock transit vehicles" includes buses, vans, cars,
97	97	railcars, locomotives, trolley cars, ferry boats, and vehicles used
98	98	for support services;
99	99	6. "Terminal" means a bus station o r depot or any facility
100	100	operated or leased by or operated on behalf of a bus transp ortation
101	101	company. This term shall include a reasonable area immediately
102	102	adjacent to any desig nated stop along the route traveled by any bus
103	103	operated by a bus transportation company and parking lots or parking
104	104	areas adjacent to a terminal ; and
105	105	7. "Transit worker" means any employee, contractor, or
106	106	volunteer working on behalf of the transit agency.
107	107	SECTION 2. AMENDATORY 21 O.S. 2021, Section 1903, is
108	108	amended to read as follows:
109	109	Section 1903. A. No person shall by force or violence, or
110	110	threat of force or violence, seize or exercise control of any bus or
111	111	rolling stock transit vehicle. Any person violating this subsection
112	112	shall be guilty of a felony a nd shall, upon conviction, be punished

139	139	by imprisonment in the custody of the Department of Corrections for
140	140	not more than twenty (20) years, or by a fine of not more than
141	141	Twenty Thousand Dollars ($20,000.00), or by both such fine and
142	142	imprisonment.
143	143	B. In addition, no person shall intimidate, threaten, assault
144	144	or batter any driver, attendant transit worker, guard or passenger
145	145	of any bus or rolling stock transit vehicle with intent to violate
146	146	subsection A of this section. Any person violating this subsection
147	147	shall be guilty of a felony and shall, upon conviction, be punished
148	148	by imprisonment in the custody of the Department of Corrections for
149	149	not more than ten (10) years, or by a fin e of not more than Five
150	150	Thousand Dollars ($5,000.00), or by both su ch fine and imprisonment.
151	151	C. In addition, any person violating subsection A or B of this
152	152	section using a dangerous or deadly weapon shall be guilty of a
153	153	felony, and shall, upon conviction, be punished by imprisonment in
154	154	the custody of the Department of Corrections for not more than
155	155	twenty (20) years, or by a fine of not more than Twenty Thousand
156	156	Dollars ($20,000.00), or by both such fine and imprisonment.
157	157	D. It shall be unlawful for any pe rson to discharge any firearm
158	158	into or within any bus, rolling stock transit vehicle, terminal or
159	159	other transportation facility, unless such action is determined to
160	160	have been in defensive force resulting from reasonable fear of
161	161	imminent peril of death or gr eat bodily harm to himself or herself
162	162	or another. Such person shall, upon convi ction, be guilty of a

192	192	SECTION 3. It being immediat ely necessary for the preservation
193	193	of the public peace, health or safety, an emergency is hereby
194	194	declared to exist, by reason whereof this act shall take effect and
195	195	be in full force from and after its passage an d approval.
