4040 An Act relating to crimes and punishments; amending
4141 21 O.S. 2021, Sections 1902 and 1903, which relate to
4242 the Bus Passenger Safety Act; mod ifying scope of
4343 certain definition; defining terms; expanding scope

5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1902, is
5454 amended to read as follows:
5555 Section 1902. As used in the Bus Passenger Safety Act:
5656 1. "Bus" means a vehicle designed to carry passengers that is
5757 part of a network of passenger vehicles for use by the public,
5858 running on a regular schedule of routes, times and fares;
5959 2. "Bus transportation company" or "company" means any person
6060 or governmental entity providing for-hire transport to passengers or
6161 cargo by bus rolling stock transit vehicles upon the roads, streets,
6262 highways and turnpikes of this state;

8989 3. "Deadly or dangerous weapon" includes all weapons listed in
9090 Section 1287 of this title, and any ot her weapon capable of
9191 inflicting serious bodily injury, except for a weapon carried for
9292 lawful self-defense in compliance under the Oklahoma Self Defense
9393 Act;
9494 4. "Passenger" means any person served by the bu s
9595 transportation company; and
9696 5. "Rolling stock transit vehicles" includes buses, vans, cars,
9797 railcars, locomotives, trolley cars, ferry boats, and vehicles used
9898 for support services;
9999 6. "Terminal" means a bus station o r depot or any facility
100100 operated or leased by or operated on behalf of a bus transp ortation
101101 company. This term shall include a reasonable area immediately
102102 adjacent to any desig nated stop along the route traveled by any bus
103103 operated by a bus transportation company and parking lots or parking
104104 areas adjacent to a terminal ; and
105105 7. "Transit worker" means any employee, contractor, or
106106 volunteer working on behalf of the transit agency.
107107 SECTION 2. AMENDATORY 21 O.S. 2021, Section 1903, is
108108 amended to read as follows:
109109 Section 1903. A. No person shall by force or violence, or
110110 threat of force or violence, seize or exercise control of any bus or
111111 rolling stock transit vehicle. Any person violating this subsection
112112 shall be guilty of a felony a nd shall, upon conviction, be punished

139139 by imprisonment in the custody of the Department of Corrections for
140140 not more than twenty (20) years, or by a fine of not more than
141141 Twenty Thousand Dollars ($20,000.00), or by both such fine and
142142 imprisonment.
143143 B. In addition, no person shall intimidate, threaten, assault
144144 or batter any driver, attendant transit worker, guard or passenger
145145 of any bus or rolling stock transit vehicle with intent to violate
146146 subsection A of this section. Any person violating this subsection
147147 shall be guilty of a felony and shall, upon conviction, be punished
148148 by imprisonment in the custody of the Department of Corrections for
149149 not more than ten (10) years, or by a fin e of not more than Five
150150 Thousand Dollars ($5,000.00), or by both su ch fine and imprisonment.
151151 C. In addition, any person violating subsection A or B of this
152152 section using a dangerous or deadly weapon shall be guilty of a
153153 felony, and shall, upon conviction, be punished by imprisonment in
154154 the custody of the Department of Corrections for not more than
155155 twenty (20) years, or by a fine of not more than Twenty Thousand
156156 Dollars ($20,000.00), or by both such fine and imprisonment.
157157 D. It shall be unlawful for any pe rson to discharge any firearm
158158 into or within any bus, rolling stock transit vehicle, terminal or
159159 other transportation facility, unless such action is determined to
160160 have been in defensive force resulting from reasonable fear of
161161 imminent peril of death or gr eat bodily harm to himself or herself
162162 or another. Such person shall, upon convi ction, be guilty of a

189189 felony punishable by a fine of not more than Five Thousand Dollars
190190 ($5,000.00) or by imprisonment in the custody of the Department of
191191 Corrections for not more than five (5) years, or both.
192192 SECTION 3. It being immediat ely necessary for the preservation
193193 of the public peace, health or safety, an emergency is hereby
194194 declared to exist, by reason whereof this act shall take effect and
195195 be in full force from and after its passage an d approval.
