107 | 107 | | determined to be feasible, and economically sound, and based upon |
---|
108 | 108 | | reliable, data driven transportation pla nning and public policy |

109 | 109 | | pursuant to the studies required by paragraph F of this section ; . |

110 | 110 | | Provided, that until specifically authorized by the Legis lature, the |
---|
111 | 111 | | Authority shall be authorized to construct and operate toll |

501 | 501 | | turnpike project pass through, be located within, or otherwise |

502 | 502 | | substantially impact its jurisdict ion. In the case of a |

503 | 503 | | municipality or county, approval shall be in the form of an |

504 | 504 | | affirmative resolution of the duly elected city council or |
---|
505 | 505 | | affirmative resolution of t he board of county commissioners, as the |

506 | 506 | | case may be, or a simple majority vote of the registered voters |

507 | 507 | | within that municipality or county at an election duly conducted for |

548 | 548 | | New turnpike conception, alignments, corridors, route, and |

549 | 549 | | interchange placement design and engineering, among other facets, |

550 | 550 | | shall be a collaborative effort between the Oklahoma Turnpike |
---|
551 | 551 | | Authority and any impacted municipalities, counties, and citizens |
---|
552 | 552 | | with many stages for iterative, interactive input, public comm ent, |
---|
553 | 553 | | and design. Turnpike projects shall be consistent, to the maximum |
---|
554 | 554 | | extent feasible, with existing land use, transportation, and other |
---|
555 | 555 | | comprehensive plans of the municipal and county governments in which |
---|
556 | 556 | | such projects may be located or pass through. |
---|
557 | 557 | | The studies required in this paragraph shall be conducted in |
---|
558 | 558 | | such a way to limit con flicts-of-interest between consulting firms |
---|
559 | 559 | | providing the justification and impact studies, and engineering |
---|
560 | 560 | | firms contracted to perform design, right -of-way, corridor |
---|
561 | 561 | | management, or construction work. All reasonable, good faith efforts |
---|
562 | 562 | | shall be made to keep these activi ties separate. All studies shall |
---|
563 | 563 | | be professionally reviewed, approved, and certified as having been |
---|

600 | 600 | | Any common carrier having authority at the time of opening any |
---|
601 | 601 | | turnpike project to operate upon a highwa y approximately paralleling |
---|
602 | 602 | | the turnpike project shall be granted without further showing |
---|
603 | 603 | | authority to operate over the turnpike project to all municipalities |
---|
604 | 604 | | which such carrier is serving at the time the turnpike project is |
---|
605 | 605 | | opened to traffic. But nothing herein shall be construed as |

606 | 606 | | granting any new operation rights to any com mon carriers. |

607 | 607 | | (h) To acquire, hold, and dispose of real and personal property |
---|
608 | 608 | | in the exercise of its powers and the performance of its duties. |

652 | 652 | | (k) To make and enter into all contracts an d agreements |

653 | 653 | | necessary or incidental to the performance of its duties and the |

654 | 654 | | execution of its powers, and to employ consulting engineers, |

655 | 655 | | attorneys, accountants, construction and fi nancial experts, |
---|
656 | 656 | | superintendents, managers, and such other employees and a gents as |
---|
657 | 657 | | may be necessary in its judgment, and to fix their compensation; |
---|
658 | 658 | | provided, that all such expenses shall be payable solely from the |
---|
659 | 659 | | proceeds of turnpike revenue bonds issued under the provisions of |

660 | 660 | | Sections 1701 through 1734 of this title or from r evenues; provided, |

661 | 661 | | further, no attorney employed by the Authority, nor any member of |
---|
