61	119		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

63	120		SECTION 1. AMENDATORY 63 O.S. 2021 , Section 2-304, is
64	121		amended to read as follows:
65		-
66	122		Section 2-304. A. A registration, pursuant to Section 2-303 of
67	123		this title, to manufacture, distribute, dispense, prescribe,
68	124		administer or use for scientific purposes a controlled dan gerous
69	125		substance shall be limited, conditioned, denied, suspended,
70	126		annulled, or revoked by the Director upon a finding that the
71	127		registrant:
72		-
73	128		1. Has materially falsified any application filed pursuant to
74	129		the Uniform Controlled Dangerous Substances Act or required by t he
75	130		Uniform Controlled Dangerous Substances Act. It shall be unlawful
76	131		to knowingly and willfully:

78	132		a. make false statements, include false da ta or omit

83	163		b. provide false data or omit material information in any
84	164		records or reports required by rule or law to be
85	165		created, maintained or submitted to the Bureau .

87	166		Any registrant or applicant for a registration or any official,
88	167		agent or employee of any registrant or applicant for a registration
89	168		who violates the provisions of this paragraph shall be guilty of a
90	169		misdemeanor and additionally subject to administrative action ;

92	170		2. Has been found guilty of, entered a plea of guilty or
93	171		entered a plea of nolo contendere to a misdemeanor relating to any
94	172		substance defined herein as a controlled dangerous substance or any
95	173		felony under the laws of any state or the United States;

97	174		3. Has had his or her federal registration retired, suspended
98	175		or revoked by a competent federal authority and is no longer
99	176		authorized by federal law to manufacture, distribute, dispense,
100	177		prescribe, administer or use for scientific purposes controlled
101	178		dangerous substances;

103	179		4. Has failed to maintain effective controls against the
104	180		diversion of controlled dangerous substances to unauthorized persons
105	181		or entities;

107	182		5. Has prescribed, dispensed or administered a contro lled
108	183		dangerous substance from schedules other tha n those specified in his
109	184		or her state or federal registration;

113	214		certificate or practice as a result of a proceeding pursuant t o the

117	217		excessively used drugs or controlled dangerous substances;

119	218		8. Has prescribed, sold, administered or ordered any contr olled
120	219		dangerous substance for an immediate family member, himself or
121	220		herself; provided that this shall not apply to a medical emergency
122	221		when no other doctor is available to respond to the emergency;

124	222		9. Has possessed, used, prescribed, dispensed or adminis tered
125	223		drugs or controlled dangerous substances fo r other than legitimate
126	224		medical or scientific purposes or for purposes outsid e the normal
127	225		course of his or her professional practice;

129	226		10. Has been under the influence of alcohol or another
130	227		intoxicating substance which adversely affected the central nervou s
131	228		system, vision, hearing or other sensory or motor functioning to
132	229		such degree the person was impaired during the performance of his or
133	230		her job; or

135	231		11. Has violated any federal law relating to any controlle d
136		-	dangerous substances, any provision of the Unif orm Controlled ~~ENR. H. B. NO. 2282 Page 4~~

140	262		B. In the event the Director suspends or revokes a registration
141	263		granted under Section 2-303 of this title, all controlled dangerous
142	264		substances owned or possessed by the registrant pursuant to such
143	265		registration at the time of denial revocation or suspension or the
144	266		effective date of the revoc ation order, as the case may be, may in
145	267		the discretion of the Direct or be impounded and preserve d. All
146	268		controlled dangerous substances not imp ounded or preserved by the
147	269		Director shall be maintained by the registrant. No disposition,
148	270		purchase, distribution, sale, or transfer may be made of substances
149	271		impounded and preserv ed until the time for taking an appeal has
150	272		elapsed or until all appeals have been concluded unless a court,
151	273		upon application therefor, orders the sale of perishable substances
152	274		and the deposit of the proceeds of the sale with the court . Upon a
153	275		revocation order becoming final, all suc h controlled dangerous
154	276		substances shall be forfeited to the state or otherwise considered
155	277		waste and submitted to a licensed medical marijuana waste disposal
156	278		service for destruction pursuant to Section 430 of this title.

158	279		C. The Drug Enforcement Administrat ion shall promptly be
159	280		notified of all orders suspending or revoking registration and all
160	281		forfeitures of controlled dangerous substances.

162	282		D. In lieu of or in addition to any other remedies available to
163	283		the Director, if a finding is made that a registrant h as committed
164	284		any act in violation of federal law relating to any controlled
165	285		substance, any provision of the Uniform Controlled Dangerous

168	315		authorized to assess an administrative penalty not to exceed Two
169	316		Thousand Dollars ($2,0 00.00) for each such act. The provisions of
170	317		this subsection shall not apply to violations of subsection G of
171	318		Section 2-309D of this title. Nothing in this section s hall be
172	319		construed so as to permit the Director of the State Bureau of
173	320		Narcotics and Danger ous Drugs Control to assess administrative fines
174	321		for violations of the provisions of subsection G of Sectio n 2-309D
175	322		of this title.

177	323		SECTION 2. AMENDATORY 63 O.S. 2021, Section 2-305, is
178	324		amended to read as follows:

180	325		Section 2-305. A. Before denying In addition to any other

187	332		dangerous substance within or into this state , that the Director
188	333		shall serve upon the applicant or registrant an order to show cause
189	334		why registration should not be denied, revoked or suspend ed or why
190	335		the renewal should not be refused . The order to show cause shall
191	336		contain a statement of the basi s therefor and shall call upon the

192	364		applicant or registrant to appear before the appropriate person or
193	365		agency at a time and place within thirty (30) days after the date of
194	366		service of the order, but in the case of a denial or renewal of
195	367		registration the show cause order shall be served within thirt y (30)
196	368		days before the expiration of the registration. These has reason to
197	369		believe is operating inconsisten t with any provision of Section 2 -
198	370		303 or 2-304 of this title or otherwise, where there has been a
199	371		violation of any federal law, any rule or regulati on of the Drug
200	372		Enforcement Administration, any provision of the Uniform Controlled
201	373		Dangerous Substances Act, or any rules or regulations of the
202	374		Oklahoma State Bureau of Narcotics and Dangerous Drugs Control. The
203	375		provisions of this subsection shall not apply to a violation of
204	376		federal law regarding marijuana or any rule or reg ulation of the
205	377		Drug Enforcement Administration regarding mar ijuana.

207	378		B. The written order shall state with specifici ty the nature of
208	379		the violation or basi s for the action. The Director may impose any
209	380		disciplinary action authorized by the Uniform Controlle d Dangerous
210	381		Substances Act or rules of the Bureau including, but not limited to,
211	382		the assessment of monetary pena lties.

213	383		C. Any written order issued pursua nt to the provisions of this
214	384		section shall become a final ord er unless the registrant requests an
215	385		administrative hearing in accordance with the rules and regulations
216	386		promulgated by the Director within thirty (30) days of issuance.

224	420		D. The Director may authorize the Deputy Director or the
225	421		general counsel of the Bureau to initiate any individual proceedings

230	425		E. 1. All proceedings shall be conducted in accordance with
231	426		the Administrative Procedures Act and the rules and regulations of
232	427		the Bureau without regard to any criminal prosecution or other
233	428		proceeding. Proceedings to refuse renewal of, revoke, or suspend a
234	429		registration shall not abate the existing registration which shall
235	430		remain in effect pending the outcome of the administrative hearing
236	431		proceedings.

238	432		B. The This abatement shall not apply wh en the Director shall
239	433		suspend, without an ord er to show cause, any registration
240	434		simultaneously with the institution of proceedings under Section 2-
241	435		304 of this title, if he or she finds there is an imminent danger to
242	436		the public health or safety which warrants this action. The
243	437		requiring an immediate suspension shall continue in effect until the
244	438		conclusion of the proceedings, including judicial review thereof,

248	468		2. The Director may delegate to an administrative hea ring
249	469		officer the authority to conduct hear ings and recommend action for
250	470		final agency orders in accordance with the rules and regulations of
251	471		the Bureau.

253	472		F. The Director may issue an order immediately suspending a
254	473		registration, without notice or a hearing, when he or she finds
255	474		there is imminent dan ger to the public health or safety which
256	475		warrants this action. The suspension shall continue in effec t until
257	476		the conclusion of any administrative proceedings, including judicial
258	477		review thereof, unless sooner withd rawn by the Director or dissolved
259	478		by a court of competent jurisdiction. The order shall state the
260	479		existence of an emergency requiring action be taken that the
261	480		Director deems necessary to meet the emergency. Such action may
262	481		include, but is not limited to, ordering the registrant to
263	482		immediately cease and desist operations. The order shall be
264	483		effective immediately upon issuance. Any person to whom th e order
265	484		is directed shall comply immediately with the provisions of the
266	485		order. The Director may assess a pe nalty not to exceed Ten Thousand
267	486		Dollars ($10,000.00) per day of noncompliance with the order. In
268	487		assessing such a penalty, the Director shall consid er the
269	488		seriousness of the violation and any efforts to comply with

276	521		has committed any act in violation of federal law relating to any
277	522		controlled dangerous substance, any provision of the Uniform
278	523		Controlled Dangerous Substances Act , or any rules of the Bureau, the
279	524		Director is hereby authorized to assess an administrative penalty
280	525		not to exceed Five Thousand Dollars ($5,000.00) per day for each
281	526		such act. The provisions of this subsection shall not apply to
282	527		violations of subsection G of Secti on 2-309D of this title. Nothing
283	528		in this section shall be construed so as to permit the Director of
284	529		the Bureau to assess administrative fines f or violations of the
285	530		provisions of subsection G of Section 2-309D of this title.

287	531		2. If a judge of competent jur isdiction finds probable cause
288	532		that a registrant has possessed, transferred, sold, or offered for
289	533		sale any controlled dangerous substance in violation of the Uniform
290	534		Controlled Dangerous Substances Act, any controlled dangerous
291	535		substance in Schedule I of Section 2-204 of this title, and any
292	536		controlled dangerous substance in Schedules II, III, IV, and V tha t
293	537		is not in properly labeled containers in accordance with the Uniform
294	538		Controlled Dangerous Substances Act then in the possession of the
295	539		registrant, shall be deemed contraband and shall be seized and
296	540		summarily forfeited pursuant to Section 2 -505 of this title.

303	573		H. Upon an annulment, revocation, or denial of a registration,
304	574		the Director may prohibit the registrant or ap plicant from
305	575		reapplying for registration for a period up to five (5) years
306	576		following the date of the final order. The length of any
307	577		prohibition shall not be us ed as grounds to contest the validity of
308	578		the annulment, revocation, or denial of a registration.

328	619		B. Before denying annulling, suspending, or revoking a license
329	620		or permit, the Director shall cause to be served upon the applicant,
330	621		licensee, or permit holder an order to show cause why a license or a
331	622		permit should not be denied annulled, suspended, or revoked. T he
332	623		order to show cause shall conta in a statement of the basis therefor
333	624		and shall call upon the applicant, licensee, or permit holder to
334	625		appear before the appropriate person or agency at the time and place
335	626		within thirty (30) sixty (60) days after the date o f service of the
336	627		order. The proceedings shall be conducted in accordance with the
337	628		Administrative Procedures Act without regard to any criminal
338	629		prosecution or other proceeding. Nothing in this section shall be
339	630		construed so as to require an individual proceeding for the denial
340	631		of a new license or permit.

342	632		C. The Director shall suspend, without an order to show cause,
343	633		any license or permit simultaneously with the institution of
344	634		proceedings described in subsection B of this section if he the
345	635		Director finds there is imminent danger to the publ ic health or
346	636		safety which warrants this action. The suspension shall continue in
347	637		effect until the conclusion of the proceedings, including judicial
348	638		review thereof, unless withdrawn by the Director or dissolved by a
349	639		court of competent jurisdiction.

351	640		SECTION 4. It being immediately necessary for the preservation
352	641		of the public peace, health or safety, an emergency is hereby
