5653 SECTION 1. AMENDATORY 62 O.S. 2021, Section 34.11.1, is

162157 Information Services Division shall be set by the Chief Information
163158 Officer and shall be budgeted as a separate line item through the

197191 D. 1. Within twelve (12) months of appointment, the first The

199193 which shall be modified ann ually pursuant to Section 35.5 of this
200194 title, of the implem entation of the transfer, coordination , and
201195 modernization of all information technology an d telecommunication
202196 systems of all state agencies in the state as provided for in the
203197 Oklahoma Information Services Act. The assessment shal l include the
204198 information technology and telecommunications sys tems of all
205199 institutions within The Oklahoma State S ystem of Higher Education,
206200 the Oklahoma State Regents for Higher Education and the
207201 telecommunications netwo rk known as OneNet as assembled an d
208202 submitted by the Oklaho ma Higher Education Chief Information
209203 Officer, as designated by the Oklahoma State Regents for Higher
210204 Education Oklahoma IT 3-Year Strategic Plan. The report shall
211205 include the current and upcoming years' technology-based services, a
212206 short-term and long-term direction for technology strategy, and
213207 outline plans for data enablement and protection, digital
214208 transformation and technology management for the State of Oklahoma.
215-2. Within twelve (12) month s of appointment, the first Chief

252245 agencies and the shared applications that are utilized

255248 services model under the control of the Information
256249 Services Division of the Office of Management and

258251 d. define the roadmap to implement the proposed shared
259252 services model. The roadmap shall include

308300 3. The plan of action report Oklahoma IT 3-Year Strategic Plan
309301 shall be presented to the Governor, Speaker of the House of
310302 Representatives, and the President Pro Tempore of the State Senate
311303 published annually on the Office of Management and Enterprise
312304 Services Information Services website.
313305 4. The Chief Information Officer may contract with a private
314306 consultant or consultants to assis t in the assessment and
315-development of the plan of action report as required in this
316-subsection.

344335 E. The Chief Information Officer shall be authorized to requ ire
345336 all state agencies, regardless of whether they subscribe to services
346337 provided by the Informati on Services Division of the Office of
347338 Management and Enterprise Services or not, to annually provide a
348339 written three-year technology plan.
349340 1. Each technology plan shall be submitted on a form to be
350341 developed by the Chief Information Officer, and sh all include at a
351342 minimum:
352343 a. a description of the agency 's technology needs to meet
353344 service delivery requirements,
354345 b. an overview of the agency 's current technology
355346 reference architecture,
356347 c. any planned changes to the architecture ,
357348 d. data protection and maintenance plans,
358349 e. data retention policy,
359350 f. a three-year budgetary forecast .
360351 2. Each agency shall submit their annual technology plan in a
361352 commercially available and commonly accepted digital format to the
362353 Chief Information Officer no later than the first day of August each
363354 year.
364355 3. The Chief Information Off icer shall compile the plans of the
365356 various agencies into one consolidated report and provide an
366-analysis of the plans and their alignment with the state's
367-architecture and the Oklahoma IT 3-Year Strategic Plan. This

395385 compiled report shall be provided in a commercially available and
396386 commonly accepted digital format to the State Governmental
397387 Technology Applications Review Board no later th an the first day of
398388 December each year.
399389 F. The Chief Information Officer shall be authorized to employ
400390 personnel, fix the duties and compensation of the personnel, not
401391 otherwise prescribed by law, and otherwise dir ect the work of the
402392 personnel in performing the function and acco mplishing the purposes
403393 of the Information Services Division of the Office of Management and
404394 Enterprise Services.
405395 F. G. The Information Services Division of the Office of
406396 Management and Enter prise Services shall be responsible for the
407397 following duties:
408398 1. Formulate and implement the information technology strategy
409399 for all state agencies ;
410400 2. Define, design, and implement a shared services statewide
411401 infrastructure and application environment f or information
412402 technology and telecommunications for all state ag encies;
413403 3. Direct the development and operation of a scalable
414404 telecommunications i nfrastructure that supports data and voice
415405 communications reliability, integrity, and security;
416-4. Supervise the applications development process for those
417-applications that are utilized across multiple agencies;

445434 5. Provide direction for the professional development of
446435 information technology staff of state agencies and oversee the
447436 professional development of t he staff of the Information Services
448437 Division of the Office of Ma nagement and Enterprise Services;
449438 6. Evaluate all technology and telecommunication investment
450439 choices for all state agencies;
451440 7. Create a plan to ensure alignment of current systems, tools,
452441 and processes with the strategic information technology plan for all
453442 state agencies;
454443 8. Set direction and provide oversight for the support and
455444 continuous upgrading of the current information technology and
456445 telecommunication infrastructure in the state i n support of enhanced
457446 reliability, user service levels, and secur ity;
458447 9. Direct the development, implementation, and management of
459448 appropriate standards, policies and procedures to ensure the success
460449 of state information technology and telecommunication i nitiatives;
461450 10. Recruit, hire and transfer the required technica l staff in
462451 the Information Services Division of the Office of Management and
463452 Enterprise Services to support the services provided by the Division
464453 and the execution of the strategic informatio n technology plan;.
465454 The Chief Informatio n Officer shall be autho rized to require
466455 Information Services employees, other OMES employees, and the
467-employees of agency contractors in positions that have access to
468-information and data protected by state and fed eral statute, to

497485 criminal history record search by the Oklahoma State Bureau of
498486 Investigation, as well as be fingerprinted for submission of the
499487 fingerprints through the Oklahoma State Bureau of Investigation to
500488 the Federal Bureau of Investigation for a nat ional criminal history
501489 record check as defined in Section 150.9 of Title 74 of the Oklahoma
502490 Statutes. The OMES Information Services Division shall be
503491 responsible for receiving the results fo r both the criminal histor y
504492 record search and th e national criminal history record check.
505493 11. Establish, maintain, and enforce information technology and
506494 telecommunication standards;
507495 12. Delegate, coordinate, and review all work to ensure quality
508496 and efficient operation of the In formation Services Div ision of the
509497 Office of Management and Enterprise Services;
510498 13. Create and implement a communication plan that disseminates
511499 pertinent information to state agencies on standards, policies,
512500 procedures, service levels, project status, an d other important
513501 information to customers of the Information Services Division of the
514502 Office of Management and Enterprise Services and provide for agency
515503 feedback and performance evaluation by customers of the Division;
516504 14. Develop and implement training programs for state ag encies
517505 using the shared services of the Information Services Division of
518-the Office of Management and Enterprise Services and recommend

554541 the purchase of any information technology and telecommunication
555542 product except the following:
556543 a. a purchase less than or equal to Five Thousand Dollars
557544 ($5,000.00) if such product is purchased using a state
558545 purchase card and the product is listed on either the
559546 Approved Hardware or Approved Software list located on
560547 the Office of Management and Enterprise Services
561548 website, or
562549 b. a purchase over Five Thousand Dollar s ($5,000.00) and
563550 less than or equal to Twenty-five Thousand Dollars
564551 ($25,000.00) if such product is purchased using a
565552 state purchase card, the product is listed on an
566553 information technology or telecommunications statewide
567554 contract, and the product is list ed on either the
568555 Approved Hardware or Approved Software list located on

601587 18. Effectively manage the design, implementation and support
602588 of complex, highly available infrastructure to ensure optimal
603589 performance, on-time delivery of features, and new products, and

605591 19. Define and implement a governance model for requesting
606592 services and monitoring service level metrics for all shared
607593 services; and
608594 20. Create the budget for the Information Services Division of
609595 the Office of Management and Enterprise Ser vices to be submitted to
610596 the Legislature each year.
611597 G. The State Governmental Technology Applications Review Board
612598 shall provide ongoing oversight of the implementation of the plan of
613599 action required in subsection D of this sectio n. Any proposed
614600 amendments to the plan of acti on shall be approved by the Board
615601 prior to adoption.
616602 H. 1. The Chief Information Officer shall act as the
617603 Information Technology and Telecommunications Purchasing Director
618604 for all state agencies and shall be responsible for the proc urement
619605 of all information technology and telecommunication software,

649634 technology, data processing, te lecommunication and relat ed
650635 peripherals and services for all state agencies. The Chief
651636 Information Officer shall establish, implement, and enforce policies
652637 and procedures for the procurement of information technology and
653638 telecommunication software, hardwa re, equipment, peripheral devices,
654639 maintenance, consulting services, high technology systems, and other
655640 related information technology, data processing, telecommunication
656641 and related peripherals and services by purchase, lease -purchase,
657642 lease with option to purchase, lease and ren tal for all state
658643 agencies. The procurement policies and procedures established by
659644 the Chief Information Officer shall be consistent with The Oklahoma
660645 Central Purchasing Act.
661646 2. The Chief Information Officer, or any employee or a gent of
662647 the Chief Information Officer acting wi thin the scope of delegated
663648 authority, shall have the same power and authority regarding the
664649 procurement of all information technology and telecommunication
665650 products and services as outlined in paragraph 1 of this subsection
666651 for all state agencies as the S tate Purchasing Director has for all
667652 acquisitions used or consumed by state agencies as established in
668653 The Oklahoma Central Purchasing Act. Such authority shall,
669654 consistent with the authority granted to the S tate Purchasing
670655 Director pursuant to Section 85 .10 of Title 74 of the Oklahoma

703687 I. The Information Services Division of the Office of

705689 shall be subject to The Oklahoma Central Purchasing Ac t for the
706690 approval and purchase of equipment and products not related to
707691 information and telecommunications technology, equipment, software,
708692 products and related peripherals and services and shall also be
709693 subject to the requirements of the Public Competiti ve Bidding Act of
710694 1974, the Oklahoma Lighting Energy Conservation Act and the Public
711695 Building Construction and Planning Act when procuring data
712696 processing, information technology, telecommuni cation, and related
713697 peripherals and services and when constructin g information
714698 technology and telecommunication facilities, telecommunication
715699 networks and supporting infrastructure. The Chief Information
716700 Officer shall be authorized to delegate all or some of the
717701 procurement of information technolog y and telecommunication products
718702 and services and construction of facilities and telecommunication
719703 networks to another state entity if the Chief Information Officer
720704 determines it to be cost -effective and in the b est interest of the
721705 state. The Chief Inform ation Officer shall h ave authority to

754737 Section 85.9D of Title 74 of the Oklahoma Statutes. Any contract
755738 entered into by a state agency f or which the Chief Inf ormation
756739 Officer has not acted as the Infor mation Technology and
757740 Telecommunications Purchasing Director as required in this
758741 subsection or subsection H of this section, shall be deemed to be
759742 unenforceable and the Office of Management a nd Enterprise Services
760743 shall not process any claim associated wit h the provisions thereof.
761744 J. The Chief Information Officer shall establish, implem ent,
762745 and enforce policies and procedure for the development and
763746 procurement of an interoperable radio commun ications system for
764747 state agencies. The Chief Information Office r shall work with local
765748 governmental entities in developing the interoperable radio
766749 communications system.
767750 K. The Chief Information Officer shall develop and implement a
768751 plan to utilize open source technology and products for th e
769752 information technology an d telecommunication systems of all state
770753 agencies.
771754 L. All state agencies and auth orities of this state and all
772755 officers and employees of those entities shall work and cooperate

810792 N. L. For purposes of the Oklahoma Information Services Act,
811793 unless otherwise provided for, "state agencies" shall include any
812794 office, officer, bureau, board, commission, counsel, unit, division,
813795 body, authority or institution o f the executive branch of state
814796 government, whether elected or appointed; provided, except with
815797 respect to the provisions of subsection D of this section, the term
816798 "state agencies" shall not include institutions within The O klahoma
817799 State System of Higher E ducation, the Oklahoma State Rege nts for
818800 Higher Education and the telecommunications network known as OneNet.
819801 O. M. As used in this section:
820802 1. "High technology system " means advanced technological
821803 equipment, software, com munication lines, and services f or the

855836 who manufactures, develops and designs products and provides
856837 services that are used by one or more state agencies.
857838 SECTION 2. AMENDATORY 62 O.S. 2021, Section 34.11.2, is
858839 amended to read as follows:
859840 Section 34.11.2 A. There is hereby established the Oklahoma
860841 State Government 2.0 Initiative.
861842 B. The State Governmental Te chnology Applications Review Boa rd
862843 shall consider and ap prove a standardized social media policy for
863844 use by state agencies, boards, commissions and public trusts having
864845 the State of Oklahoma as a beneficiary.
865846 C. The board Board shall establish open techno logy standards
866847 and a schedule by which state agencies, boards, commissions and
867848 public trusts having the State of Oklahoma as a beneficiary shall
868849 utilize these standards to provide citizens with web -based
869850 interactivity to state government services. Wheneve r possible these
870851 standards shall match commonly used standards by other government
871852 entities.
872853 D. The board Board shall set a schedule by which state

902882 information sets which shall be accessibl e through standardized
903883 application programming interfaces and published in standardized
904884 formats including but not limited to eXtensible Markup Language
905885 (XML) and Comma Separated Value (CSV) f ormats. The board Board
906886 shall establish application programming interface standards which
907887 enable access to convenience information sets. The schedule shall
908888 place an emphasis on first making accessible convenience information
909889 sets most commonly requested in open records requests. A directory
910890 and link to all available convenience information sets shall be
911891 prominently featured on the portal system referenced in Section
912892 34.24 of this title and if possible linked to the data.ok.gov web
913893 portal.
914894 E. The board Board may conduct events and contests t o provide
915895 recognition of software application development provided that the
916896 application being recognized utilizes standards established in this
917897 section to the benefit of the citizens of Oklahoma.
918898 F. The board Board shall establish an application process
919899 through which applicants can request the scheduled implementation of
920900 application programming interfaces, creation of open technology
921901 standards and publication of convenience information sets pursuant
922902 to the provisions of this section. Instructions regardin g the
923903 application process s hall be prominently featured on the portal
924904 system referenced in Section 34.24 of this title.

955934 H. The Board shall review the con solidated report of agency
956935 three-year technology plans prov ided to it each year by the Chief
957936 Information Officer. The Board shall incorporate its own analysis
958937 into the report, highlighting deviat ions from industry best
959938 practices and policies, schedules and sta ndards established by this
960939 section. The complete report shall be presented in a commercially
961940 available and commonly accepted digital format to the Governor, the
962941 Speaker of the Oklahoma House of Representatives, and the President
963942 Pro Tempore of the Oklahoma State Senate no later than the fifteenth
964943 day of January each year.
965944 I. The board Board shall promulgate performance information
966945 metrics and guidelines which shall be used to establish crite ria
967946 which govern participa tion in the "State Government Employee
968947 Performance Transparency Pilot Program". The board Board shall set
969948 a schedule for the publication of performance information metrics
970949 through the data.ok.gov website.
971950 I. J. For the purposes of this section, "open technology
972951 standards" are widely accepted standards and mechanisms for the web-
973952 based connectivity and asynchronous communication between software
974953 programs. "Application programming interface " is a standardized
975954 interface enabling a s tandard form of connectivity bet ween
