40	43		An Act relating to the Oklahoma Open Records Act;
41	44		amending 51 O.S. 2021, Section 24 A.16, which relates
42	45		to educational records; modifying provisions related
43	46		to confidential records; authorizing certain student
44	47		athlete records to be kept confid ential; and

52	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	56		SECTION 1. AMENDATORY 51 O.S. 2021, Section 24A.16, is
54	57		amended to read as follows:
55	58		Section 24A.16 A. Except as set forth in subsection B of this
56	59		section, public educational institutions and their e mployees may
57	60		keep confidential:
58	61		1. Individual student records;
59	62		2. Teacher lesson plans, tests and other teachin g material; and
60	63		3. Personal communications concerning individ ual students; and
61	64		4. Contracts for use of a stu dent athlete's name, image or
62	65		likeness disclosed to a postseconda ry institution.

89	93		B. If kept, statistical information not identified with a
90	94		particular student and directory information shall be open for
91	95		inspection and copying. Except as provided in subsection C of this
92	96		section, each educational institution may choose t o designate
93	97		specific information whic h shall be classified as directory
94	98		information for students attending the educational institution . In
95	99		accordance with the Family Educa tional Rights and Privacy Act,
96	100		Section 1232g of Title 20 of the United States Code a nd Part 99 of
97	101		Title 34 of the Code of Federal Regulations, "directory information"
98	102		includes a student's name, address, telephone listing, date and
99	103		place of birth, major fie ld of study, participation in officially
100	104		recognized activities and sports, weight an d height of members of
101	105		athletic teams, dates of attendance, degrees and awards received,
102	106		and the most recent previous educational institution a ttended by the
103	107		student. Any educational agency or institution making public
104	108		directory information shall give pub lic notice of the categories of
105	109		information which it has designated as director y information with
106	110		respect to each student attending the institu tion or agency and
107	111		shall allow a reasonable period of time after the notice has been
108	112		given for a parent to inform the institution or agency that any o r
109	113		all of the information designated should not be released without
110	114		prior consent of the parent or guardian or the student if the
111	115		student is eighteen (18) years of age or older.

138	143		C. All educational agencies or institutio ns which are not the
139	144		primary custodians of student directory information of st udents
140	145		attending the educational institution, but which are allow ed to
141	146		access the information for educational purposes, shall be prohibited
142	147		from releasing or selling any or all s tudent directory information
143	148		unless disclosure is authorized by the Family Edu cational Rights and
144	149		Privacy Act, Section 1232g of Title 20 of the United States Code and
145	150		Part 99 of Title 34 of the Code of Federal Regulations, or Section
146	151		3-168 of Title 70 of t he Oklahoma Statutes.
147	152		D. A public school district may release individual stu dent
148	153		records for the current or previous school year to a school d istrict
149	154		at which the student was previously enrolled for purposes of
150	155		evaluating educational programs and school e ffectiveness.
151	156		SECTION 2. This act shall become effective November 1, 2023.
