4043 An Act relating to the Oklahoma Open Records Act;
4144 amending 51 O.S. 2021, Section 24 A.16, which relates
4245 to educational records; modifying provisions related
4346 to confidential records; authorizing certain student
4447 athlete records to be kept confid ential; and

5255 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5356 SECTION 1. AMENDATORY 51 O.S. 2021, Section 24A.16, is
5457 amended to read as follows:
5558 Section 24A.16 A. Except as set forth in subsection B of this
5659 section, public educational institutions and their e mployees may
5760 keep confidential:
5861 1. Individual student records;
5962 2. Teacher lesson plans, tests and other teachin g material; and
6063 3. Personal communications concerning individ ual students; and
6164 4. Contracts for use of a stu dent athlete's name, image or
6265 likeness disclosed to a postseconda ry institution.

8993 B. If kept, statistical information not identified with a
9094 particular student and directory information shall be open for
9195 inspection and copying. Except as provided in subsection C of this
9296 section, each educational institution may choose t o designate
9397 specific information whic h shall be classified as directory
9498 information for students attending the educational institution . In
9599 accordance with the Family Educa tional Rights and Privacy Act,
96100 Section 1232g of Title 20 of the United States Code a nd Part 99 of
97101 Title 34 of the Code of Federal Regulations, "directory information"
98102 includes a student's name, address, telephone listing, date and
99103 place of birth, major fie ld of study, participation in officially
100104 recognized activities and sports, weight an d height of members of
101105 athletic teams, dates of attendance, degrees and awards received,
102106 and the most recent previous educational institution a ttended by the
103107 student. Any educational agency or institution making public
104108 directory information shall give pub lic notice of the categories of
105109 information which it has designated as director y information with
106110 respect to each student attending the institu tion or agency and
107111 shall allow a reasonable period of time after the notice has been
108112 given for a parent to inform the institution or agency that any o r
109113 all of the information designated should not be released without
110114 prior consent of the parent or guardian or the student if the
111115 student is eighteen (18) years of age or older.

138143 C. All educational agencies or institutio ns which are not the
139144 primary custodians of student directory information of st udents
140145 attending the educational institution, but which are allow ed to
141146 access the information for educational purposes, shall be prohibited
142147 from releasing or selling any or all s tudent directory information
143148 unless disclosure is authorized by the Family Edu cational Rights and
144149 Privacy Act, Section 1232g of Title 20 of the United States Code and
145150 Part 99 of Title 34 of the Code of Federal Regulations, or Section
146151 3-168 of Title 70 of t he Oklahoma Statutes.
147152 D. A public school district may release individual stu dent
148153 records for the current or previous school year to a school d istrict
149154 at which the student was previously enrolled for purposes of
150155 evaluating educational programs and school e ffectiveness.
151156 SECTION 2. This act shall become effective November 1, 2023.
