2855 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3056 SECTION 1. AMENDATORY 12 O.S. 2021, Section 2503.1, is
3157 amended to read as follows:

3358 Section 2503.1 A. As used in this section:

3559 1. An "interpreter" is a qualified legal interpreter for the
3660 deaf or hard-of-hearing, as defined by Section 2 408 of Title 63 of
3761 the Oklahoma Statutes , or a spoken language inte rpreter for a
3862 Limited English Proficient (LEP) person;

4063 2. A "deaf or hard-of-hearing person" is a person whose sense
4164 of hearing is nonfunctional for the ordinary purposes of life; and

4392 3. A "Limited English Proficient (LEP) person" is a person who
4493 cannot speak or easily understand Eng lish; and

4694 4. A communication is "confidential" if made privately and not
4795 intended for further disclosure except to other persons present in
4896 furtherance of the purpose of the communication.

5097 B. A person has a privilege to refuse to disclose and to
5198 prevent an interpreter from disclosing such person 's confidential
5299 communication made while such interpreter is acting in the capacity
53100 as an interpreter for persons who are deaf or hard-of-hearing or
54101 LEP.

56102 C. The privilege may be claimed by the interpreter, by the LEP
57103 or deaf or hard-of-hearing person, by the guardian o r conservator of
58104 the LEP or deaf or hard-of-hearing person, or by the personal
59105 representative of the LEP or deaf or hard-of-hearing person if the
60106 LEP or deaf or hard-of-hearing person is deceased.

62107 D. An interpreter who is employed to interpret, transliter ate
63108 or relay a conversation between a person who can hear and speak
64109 English and a LEP or deaf or hard-of-hearing person is a conduit for
65110 the conversation and may not disclose or be compelled to disclose,
66111 through reporting or testimony , or by judicial process or subpoena,
67112 the contents of a confidential communication.

69113 E. There is no privilege pursuant to thi s section for

72142 1. If the services of the interpr eter were sought or obtained
73143 to enable or aid anyone to commit or plan to commit what the LEP or
74144 deaf or hard-of-hearing person knew, or reasonably should have
75145 known, to be a crime or fraud or physical injury to the LEP or deaf
76146 or hard-of-hearing person or another indiv idual;

78147 2. In which the LEP or deaf or hard-of-hearing person has
79148 expressed an intent to engage in conduct likely to result in
80149 imminent death or serious bodily injury to the LEP or deaf or hard-
81150 of-hearing person or another individual;

83151 3. Relevant to an issue in a proce eding challenging the
84152 competency of the interpreter;

86153 4. Relevant to a breach of d uty by the interpreter; or

88154 5. That are subject to a duty to disclose under statut ory law.
