40	40	An Act relating to schools; amending 70 O.S. 2021,
41	41	Section 5-200, which relates to educational
42	42	management organizations ; modifying definition;
43	43	requiring new contracts only be executed with certain
44	44	educational management organization s; authorizing
45	45	certain contracts to remain effective until
46	46	expiration, termination, or renewal ; and providing an

54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. AMENDATORY 70 O.S. 2021, Section 5 -200, is
56	56	amended to read as follows:
57	57	Section 5-200. A. As used in this section, "educational
58	58	management organization " means a for-profit or nonprofit an
59	59	organization that receives public funds to provide administration
60	60	and management services for a charter school, statewide virtual
61	61	charter school or traditional public schoo l.
62	62	B. Beginning November 1, 2023, a charter school or virtual
63	63	charter school that executes a new contract or renews a contract
64	64	with an educational management orga nization shall only contract with

91	91	an educational management organization that is a nonprofit
92	92	organization or a benefit corporation organized pursuant to the
93	93	Oklahoma Benefit Corporation Act. If a charter school or virtual
94	94	charter school has an existing contract with an educational
95	95	management organization that is not a nonprofit organization or
96	96	benefit corporation on or before October 1, 2023 , the contract may
97	97	remain in effect until the contract term expires , terminates, or is
98	98	eligible for renewal.
99	99	C. A charter school that contracts with an educational
100	100	management organizati on shall use the Oklahoma Cost Accounting
101	101	System (OCAS) to report the total am ount paid to an educa tional
102	102	management organization as well as itemized expenditure information
103	103	for the goods or services provided by the management organization as
104	104	defined by OCAS expenditure codes, including the total compensation
105	105	package of the superint endent including the base salary, insurance,
106	106	retirement and other fringe benefits.
107	107	C. D. Any owner of an educational management organization shall
108	108	be required to disclose to the go verning board of the school in a
109	109	public meeting any ownership position in a ny business that cont racts
110	110	or proposes to contract with the same public school that the
111	111	educational management organization is managing.
112	112	D. E. Whenever any person shall enter into a c ontract with any
113	113	school district or public charter school in the state t o teach in
114	114	such school district or public charter school the contract shall be

141	141	binding on the teacher and on the board of education until the
142	142	teacher legally has been discharged from t he teaching position or
143	143	released by the board of education from the cont ract. Except as
144	144	provided in Section 5-106A of Title 70 of the Oklahoma Statutes,
145	145	until such teacher has been thus discharged or released, the teacher
146	146	shall not have authority to enter into a contract with any other
147	147	board of education in Oklahoma for the s ame time covered by t he
148	148	original contract. If upon written complaint by the board of
149	149	education in a district any teacher is reported to have failed to
150	150	obey the terms of the contract p reviously made and to have entered
151	151	into a contract with another board of education, including a public
152	152	charter school board of education, without having been released from
153	153	the former contract except as provided in Section 5 -106A of Title 70
154	154	of the Oklahoma Statutes, the teacher, upon being found to be
155	155	employed full-time for another public school, including a public
156	156	charter school in the state, at a hearing held before the State
157	157	Board of Education, shall have such teacher 's certificate suspended
158	158	for the remainder of the term for which the contract was made.
159	159	SECTION 2. This act shall become effective November 1, 2023.
