106106 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
107107 SECTION 1. AMENDATORY 63 O.S. 2021, Section 421, as
108108 amended by Section 1, Chapter 332, O.S.L. 2022 (63 O.S. Supp. 2022,
109109 Section 421), is amended to read as follows:
110110 Section 421. A. The Oklahoma Medical Marijuana Authority shall
111111 make available on its website in an easy-to-find location an
112112 application applications for a temporary medical marijuana
113113 dispensary license and annual medical marijuana dispensary license.
114114 The application fee to fees for the temporary or annual lice nse
115115 shall be paid by the applicant shall be in the amounts provided for
116116 in Section 427.14 of this title. A method of payment for the
117117 application fee fees shall be provided on the website of the
118118 Authority. Dispensary Medical marijuana dispensary applicants must
119119 all be residents of Oklahoma. Any entity applying for a temporary
120120 or annual medical marijuana dispensary license must be owned by an
121121 Oklahoma resident and must be registere d to do business in Oklahoma.
122122 The Authority shall have ninety (90) business days to review the
123123 application for a temporary medical marijuana dispensary license;
124124 approve, reject or deny the application; and mail the approval,
125125 rejection or denial letter stating reasons for the rejection or
126126 denial to the applicant.

153153 B. The In addition to the requirements provided for in the
154154 Oklahoma Medical Marijuana and Patient Protection Act, the Authority
155155 shall approve all applications which m eet the following criteria:
156156 1. The applicant must be twenty-five (25) years of age or
157157 older;
158158 2. The applicant, if applying as an individual, must show
159159 residency in the State of Oklahoma;
160160 3. All applying entities must show that a ll members, managers,
161161 and board members are Oklahoma residents;
162162 4. An applying entity may show ownership of non -Oklahoma
163163 residents, but that percentage ownership may not exceed twe nty-five
164164 percent (25%);
165165 5. All applying individuals or entities must be registered to
166166 conduct business in the State of Oklahoma; and
167167 6. All applicants must disclose all ownership interests in the
168168 dispensary.
169169 Applicants with a nonviolent felony conviction in the last two
170170 (2) years, any other felony conviction in the last five (5) years,
171171 inmates in the custody of the Department of Corrections or any
172172 person currently incarcerate d shall not qualify for a temporary or
173173 annual medical marijuana dispensary license.
174174 C. Licensed medical marijuana dispensaries shall be required to
175175 complete a monthly sal es report to the Authority. This report shall
176176 be due on the fifteenth of each month and provide reportin g on the

203203 previous month. This report shall detail the weight of marijuana
204204 purchased at wholesale and the weight of marijuan a sold to licensed
205205 medical marijuana patients and license d caregivers and account for
206206 any waste. The report shall show total sales in dollars, tax
207207 collected in dollars, and tax due in d ollars. The Authority shall
208208 have oversight and auditing responsibilities to ensure that all
209209 marijuana being grown is accounted for.
210210 D. Only a licensed medical marijuan a dispensary may conduct
211211 retail sales of marijuana or marijuana derivatives. Beginning on
212212 the effective date of this act, licens ed medical marijuana
213213 dispensaries shall be authorized to package and sell pre -rolled
214214 marijuana to licensed medical marijuana pati ents and licensed
215215 caregivers. The products described in this subsection shall contain
216216 only the ground parts of the marijuana p lant and shall not include
217217 marijuana concentrates or derivatives . The total net weight of each
218218 pre-roll packaged and sold by a m edical marijuana dispensary shall
219219 not exceed one (1) gram. These products shall be tested, packaged
220220 and labeled in accordance with Oklahoma law and rules promulgated by
221221 the Authority.
222222 E. No medical marijuana dispensary shall offer or allow a
223223 medical marijuana patient licensee, careg iver licensee or other
224224 member of the public to handle or otherwise have physical contact
225225 with any medical marijuana not contained in a sealed or separate
226226 package. Provided, such prohibition shall not preclude an employe e

253253 of the medical marijuana dispensary from handling loose or
254254 nonpackaged medical marijuana to be placed in packaging consistent
255255 with the Oklahoma Medical Marijuana and Patient Protection Act and
256256 the rules promulgated by the Authority for the packaging of m edical
257257 marijuana for retail sale. Provided, further, such prohibition
258258 shall not prevent a medical marijuana dispensary from displaying
259259 samples of its medical marijuana in separate display cases, jars or
260260 other containers and allowing medical marijuana pati ent licensees
261261 and caregiver licensee s the ability to handle or smell the various
262262 samples as long as the sample medical marijuana is used for display
263263 purposes only and is not offered for retail sale.
264264 SECTION 2. AMENDATORY 63 O.S. 2021, Section 422, as
265265 amended by Section 2, Chapter 332, O.S.L. 2022 (63 O.S. Su pp. 2022,
266266 Section 422), is amended to read as follows:
267267 Section 422. A. The Oklahoma Medical Marijuana Authori ty shall

353353 C. A licensed medical marijuana commercial grower may sell
354354 marijuana to a licensed medical marijuana dispensary or a licensed
355355 medical marijuana processor. Further, sales by a licensed medical
356356 marijuana commercial grower shall be considered wholesale sales and
357357 shall not be subject to taxation. Under no circumstances may a
358358 licensed medical marijuana commercial grower sell marijuana directly
359359 to a licensed medical marijuana patient or licensed medical
360360 marijuana caregiver. A licensed medical marijuana commercial grower
361361 may only sell at the wholesale level to a licensed medical marijuana
362362 dispensary, a licensed medical marijuana commercial grower or a
363363 licensed medical marijuana processor. If the federal government
364364 lifts restrictions on buying and selling marijuana between states,
365365 then a licensed medical marijuana commercial grower would be allowed
366366 to sell and buy marijuana wholesale from, or to, an out-of-state
367367 wholesale provider. A licensed medical marijuana commercial grower
368368 shall be required to complet e a monthly yield and sales report to
369369 the Authority. This report shall be due on the fifteenth of each
370370 month and provide reporting on the previous month. This report
371371 shall detail the amount of marijuana harvested in pounds, the amount
372372 of drying or dried marijuana on hand, t he amount of marijuana sold
373373 to licensed processors in pounds, the amount of waste in pounds, and
374374 the amount of marijuana sold to licensed medical marijuana
375375 dispensaries in pounds. Additionally, this repor t shall show total
376376 wholesale sales in dollars . The Authority shall have oversight and

403403 auditing responsibilities to ensure th at all marijuana being grown
404404 by licensed medical marijuana commercial growers is accounted for.
405405 D. There shall be no limits on how much marijuana a lic ensed
406406 medical marijuana commercial grower can grow.
407407 E. Beginning on the effective date of this act, licensed
408408 medical marijuana commercial growers shall be authorized to package
409409 and sell pre-rolled marijuana to licensed medical marijuana
410410 dispensaries. The products described in this subsection shall
411411 contain only the ground parts of t he marijuana plant and shall not
412412 include marijuana concentrates or derivatives. The total net weight
413413 of each pre-roll packaged and sold by licensed medical marijuana
414414 commercial growers shall not exc eed one (1) gram. These products
415415 must be tested, package d and labeled in accordance with Oklahoma law
416416 and rules promulgated by the Authority.
417417 SECTION 3. AMENDATORY 63 O.S. 2021, Section 423, as
418418 amended by Section 3, Chap ter 332, O.S.L. 2022 (63 O.S. Supp. 2022,
419419 Section 423), is amended to read as follows:
420420 Section 423. A. The Oklahoma Medical Mar ijuana Authority shall
421421 make available on its website in an easy-to-find location an
422422 application applications for a temporary medical marijuana processor
423423 license and annual medical marijuana processing processor license.
424424 The Authority shall be authorized to issue two types of annual
425425 medical marijuana processor licenses based on the lev el of risk
426426 posed by the type of processing conducted:

454454 2. Hazardous medical ma rijuana processor license .
455455 The application fee fees for a nonhazardous or hazardous medical
456456 marijuana processor the temporary or annual license shall be paid by
457457 the applicant in the amounts provided for in Section 427.14 of this
458458 title. A method of payment shall be provided on the website of the
459459 Authority. The Authority shall have ninety (90) days to review the
460460 application for a temporary medical marijuana processor license ;

510510 C. 1. A licensed medical marijuana processor may take
511511 marijuana plants and dis till or process these plants into
512512 concentrates, edibles, and other forms for consumption.
513513 2. As required by subsection D of this section, the Authority
514514 shall make available a set of standards which shall be used by
515515 licensed medical marijuana processors in the preparation of edible
516516 marijuana products. The standards should be in line with curr ent
517517 food preparation guidelines . No excessive or punitive rules may b e
518518 established by the Authority.
519519 3. Up to two times a year, the Authority may inspect a
520520 processing operation and de termine its compliance with the
521521 preparation standards . If deficiencies are found, a written report
522522 of the deficiency shall be issued to the licensed medical marijuana
523523 processor. The licensed medical marijuana processor shall have one
524524 (1) month to correct the deficiency or be subject to a f ine of Five
525525 Hundred Dollars ($500.00) for each deficiency.

552552 4. A licensed medical marijuana processor may sell marijuana
553553 products it creates to a licensed medical marijuana dispensary or
554554 any other licensed medical marijuana processor. All sales by a
555555 licensed medical marijuana processor shall be considered wholesale
556556 sales and shall not be subject to taxation.
557557 5. Under no circumstances may a licensed medical marijuana
558558 processor sell marijuana or a ny marijuana product directly to a
559559 licensed medical marijuana patient or licensed medical marijuana
560560 caregiver. However, a licensed medical marijuana processor may
561561 process cannabis into a concentrated form for a licensed medical
562562 marijuana patient for a fee.
563563 6. Licensed medical marijuana processors shall be required to
564564 complete a monthly yield and sales report to the Authority. This
565565 report shall be due on the fifteenth of each month and shall provide
566566 reporting on the previous month . This report shall detail the
567567 amount of marijuana and medical marijuana products purchased in
568568 pounds, the amount of marijuana cooked or processed in p ounds, and
569569 the amount of waste i n pounds. Additionally, this repor t shall show
570570 total wholesale sales in dolla rs. The Authority shall have
571571 oversight and auditing responsibilities to ensu re that all marijuana
572572 being processed is accounted for.
573573 D. The Authority shall oversee the inspection and compliance of
574574 licensed medical marijuana processors producing products with
575575 marijuana as an additive . The Authority shall be compelled to,

602602 within thirty (30) days of passage of this initiative, appoint
603603 twelve (12) Oklahoma residents to the Medical Marijuan a Advisory
604604 Council, who are marijuana industry experts, to create a list of
605605 food safety standards for processing and handling me dical marijuana
606606 in Oklahoma. These standards shall be adopted by the Authority and
607607 the Authority may enforce these standards fo r licensed medical
608608 marijuana processors. The Authority shall develop a standards
609609 review procedure and these stan dards can be altered by calling
610610 another council of twelve (12) Oklahoma marijuana industry experts .
611611 A signed letter of twenty operating, licensed medical marijuana
612612 processors shall constitute a need for a new council and standards
613613 review.
614614 E. If it becomes permissible unde r federal law, marijuana may
615615 be moved across state lines.
616616 F. Any device used for the processing or consumption of medical
617617 marijuana shall be considered legal to be sold, manufactured,
618618 distributed and possessed . No merchant, wholesaler, manufacturer or
619619 individual may be unduly harassed or prosecuted for sellin g,
620620 manufacturing or possessing marijuana paraphernalia .
621621 SECTION 4. AMENDATORY 63 O.S. 2021, Section 424, is
622622 amended to read as follows :
623623 Section 424. A. A temporary medical marijuana transportation
624624 transporter license will or an annual medical marijuana tra nsporter
625625 license shall be issued to qualifying applicants for a medical

653653 grower, or processing medical marijuana processor license. The
654654 transportation temporary or annual medical marijuana tran sporter
655655 license will shall be issued at the time of approval of a retail,
656656 growing, or processing the temporary or annual medical marijuana
657657 dispensary, medical marijuana commercial grower, or medical
658658 marijuana processor license. The fees for the temporary or annual
659659 license shall be paid by the applicant in the amounts provided for
660660 in Section 427.14 of th is title.
661661 B. A transportation medical marijuana transporter license will
662662 shall allow the holder to transport medical marijuana from an
663663 Oklahoma-licensed medical marijuana retailer dispensary, licensed
664664 growing medical marijuana commercial grower facility, or licensed
665665 medical marijuana processor facility to an Oklahoma -licensed medical
666666 marijuana retailer dispensary, licensed growing medical marijuana
667667 commercial grower facility, or licensed medical marijuana processing
668668 facility.
669669 C. All medical marijuana or medical marijuana products shall be
670670 transported in a locked container and clearly labeled "Medical
671671 Marijuana or Derivative ".
672672 SECTION 5. AMENDATORY 63 O.S. 2021, Section 427.14, as
673673 amended by Section 4, Chapter 332, O.S.L. 2022 (63 O.S. Supp. 2022,

701701 Section 427.14 A. There is hereby created the medical
702702 marijuana business license, which shall include the following
703703 categories:
704704 1. Medical marijuana commercial grower;
705705 2. Medical marijuana processor;
706706 3. Medical marijuana dispensary;
707707 4. Medical marijuana transporter; and
708708 5. Medical marijuana testing laboratory.
709709 B. The Oklahoma Medical Marijuana Authority, with the aid of
710710 the Office of Management and Enterprise Services, shall develop a
711711 website for medical marijuana business license applications.
712712 C. The Authority shall make available on it s website in an
713713 easy-to-find location, applications for a temporary medical
714714 marijuana business license and annual medical marijuana business
715715 license.
716716 D. Beginning November 1, 2023, the Authority shall require all
717717 persons or entities seeking licensure as a medical marijuana
718718 commercial grower, medical marijuan a processor, medical marijuana
719719 dispensary, or medical marijuana transporter to first apply for a
720720 temporary medical marijuana business license.
721721 1. A temporary medical marijuana business license is a
722722 conditional license and does not authorize the licensee t o conduct
723723 any sales of medical marijuana or marijuana products, the growing or
724724 processing of marijuana, or the transportation of any medical

751751 marijuana or marijuana products by the licensee. A tempo rary
752752 medical marijuana business licensee shall follow all applicable
753753 rules and regulations promulgated by the Authority.
754754 2. A temporary medical marijuana busines s license does not
755755 obligate the Authority to issue an annual medical marijuana business
756756 license nor does the temporary medical marijuana business licens e
757757 create a vested right in the holder to either an extension of the
758758 temporary medical marijuana business license or to the granting o f a
759759 subsequent annual medical marijuana business license.
760760 3. A temporary medical marijuana business license issued under
761761 the provisions of this subsection shall be valid for one hundred
762762 eighty (180) days from its effective dat e.
763763 4. A temporary medical ma rijuana business license may be
764764 extended by the Authority for add itional ninety-day periods not to
765765 exceed eighteen (18) mon ths if:
766766 a. an application for an annual license has been
767767 submitted to the Authority prior to the initial
768768 expiration date of the tempo rary medical marijuana
769769 business license, and
770770 b. the Authority determines that the application and
771771 required documentation su bmitted by the applicant for
772772 an annual medical marijuana business license is
773773 deficient in some manner.

800800 5. In addition to the initial fee for a medical marijuana
801801 business license provided for in subsection E of this section , a
802802 nonrefundable application fee for a temporary medical marijuana
803803 business license shall be assessed in the amount of One Thousand
804804 Dollars ($1,000.00). A nonrefund able fee of One Thousand Dollars
805805 ($1,000.00) shall be assessed for every ninety -day extension
806806 requested by the holder of a temporary medical marijuana business
807807 license and subsequently granted by the Authori ty.
808808 6. In addition to the general requirements p rovided for in
809809 subsection F of this section, persons or entities applying for a
810810 temporary medical marijuana busin ess license or applying to renew a
811811 medical marijuana business license shall submit the followi ng to the
812812 Authority:
813813 a. business-formation documents, which may include, but
814814 not be limited to, articles of incorporation,
815815 operating agreements, partnership agree ments, and
816816 fictitious business name statements. The applicant
817817 shall also provide all document s filed with the
818818 Oklahoma Secretary of State,
819819 b. financial information pertaining to the operations of
820820 the medical marijuana business, which shall include
821821 the following:
822822 (1) a list of funds belonging to the applicant held
823823 in savings, checking, or other acc ounts

853853 financial institution, account type, account
854854 number, and the amount of money in the account,
855855 (2) a list of loans made to the applicant. For each
856856 loan, the applicant shall provide the amount of
857857 the loan, the date of the loan, term of the loan,
858858 security provided for th e loan, and the name,
859859 address, and phone number of the lender,
860860 (3) a list of investments made into the medical
861861 marijuana business. For each in vestment, the
862862 applicant shall provide the amount of the
863863 investment, the date of the investment, term of
864864 the investment, and the name, address, and phone
865865 number of the investor, and
866866 (4) a list of all monetary gifts, equipment, and
867867 property of any kind given to the applicant for
868868 the purpose of or in exchange for applying for or
869869 operating a medical marijuana business. For each
870870 gift, the applicant shall provide the value or a
871871 description of the gift and the name, address,
872872 and phone number of the provider of th e gift,

904904 licensed under the provisions of the Oklahoma Medical
905905 Marijuana and Patient Protection Act,
906906 e. a complete and detailed diagram of the proposed
907907 premises. If changes to the proposed pr emises occur
908908 during the application period, a revised set of plans
909909 shall be submitted to the Authority for final
910910 inspection. The diagram shall be to scale and shall
911911 show the following:
912912 (1) boundaries of the property an d the proposed
913913 premises to be license d, showing all boundaries,
914914 dimensions, entrances and exits , interior
915915 partitions, walls, rooms, windows, doorways, and
916916 common or shared entryways, and shall include a
917917 brief statement or description of the principal
918918 activity to be conducted therein,
919919 (2) the location of medical marijuana business
920920 activities that will take place in each area of
921921 the premises, and limited -access areas,

955955 f. if the applicant is not the landowner of the real
956956 property upon which the premises is loca ted, a
957957 document from the landowner or the agent of the
958958 landowner that states that the applicant has the right
959959 to occupy the property and acknowledging the applicant
960960 may use the property for the medical marijuana
961961 business activity for which the applicant is applying
962962 for licensure. An applicant shall also provide a copy
963963 of the rental agreement, as applicable,
964964 g. if the applicant is the landowner of the real property
965965 upon which the premises is located, a copy of the
966966 title or deed to the property,
967967 h. if the applicant is applying for a medical marijuana
968968 commercial grower license, the applicant shall also

10021002 from a waterbody, groundwater well, or rain
10031003 catchment system as a water s ource for
10041004 cultivation, the applicant shall include the
10051005 following locations on the property diagram with
10061006 locations also provided as coordinates in either
10071007 latitude and longitude or the Oklahoma Coordinate
10081008 System:
10091009 (a) sources of water used, including the
10101010 location of waterbody diversion, pump
10111011 location, and distribution system, and
10121012 (b) location, type, and capacity of each storage
10131013 unit to be used for cultivation, and
10141014 (3) a proposed cultivation plan, which shall includ e
10151015 identification of all water sources used for
10161016 cultivation activities, and
10171017 i. evidence of insurance including, but not limited to:
10181018 (1) general liability insurance,
10191019 (2) workers' compensation insurance or a copy of an
10201020 Affidavit of Exempt Status filed with th e

10531053 8. The Authority may reject an application for an annual

10551055 temporary medical marijuana business license or any provision of the
10561056 Oklahoma Medical Marijuana and Patient Protection Ac t are not
10571057 satisfied.
10581058 9. For purposes of this subsection, "financial interest"
10591059 concerning a medical marijuana busines s shall include any
10601060 contractual agreements for profit sharing, subcontracting, or
10611061 similar financial arrangements; provided, that such discl osures
10621062 alone shall not automatically indicate ownership of the license or
10631063 require disclosure as an owner of the licen se.
10641064 E. 1. The In addition to the fee for a temporary medical
10651065 marijuana transporter license, the annual, nonrefundable fee for a
10661066 medical marijuana transporter license shall be Two Thousand Five
10671067 Hundred Dollars ($2,500.00).
10681068 2. The In addition to the nonrefundable application fee for a
10691069 temporary medical marijuana business license, the initial fee for a
10701070 medical marijuana commercial grower license shall be calculated

12471247 (1) "canopy" means the total surface area within a
12481248 cultivation area that is dedicated to the
12491249 cultivation of flowering marijuana plants. The
12501250 surface area of the plant canopy must be
12511251 calculated in square feet and mea sured and must
12521252 include all of the area within the boundaries
12531253 where the cultivation of the fl owering marijuana
12541254 plants occurs. If the surface of the plant
12551255 canopy consists of noncontiguous areas, each
12561256 component area must be separat ed by identifiable
12571257 boundaries. If a tiered or shelving system is
12581258 used in the cultivation area, the surface area of
12591259 each tier or shelf must be included in
12601260 calculating the area of the plant canopy.
12611261 Calculation of the area of the plant canopy may
12621262 not include the areas within the cult ivation area
12631263 that are used to cultivate immature marijuana

13651365 4. The In addition to the nonrefundable application fee for a
13661366 temporary medical marijuana business license, the initial fee for a

14011401 5. The In addition to the nonrefundable application fee for a
14021402 temporary medical marijuana business license, the annual,
14031403 nonrefundable license fee for a medical marijuana testing laboratory
14041404 shall be Twenty Thousand Dollars ($20,000.00).
14051405 E. F. All applicants seeking licensure or licensure renewal as
14061406 a medical marijuana business shall comply with the following general
14071407 requirements:
14081408 1. All applications for licenses and registrations authorized
14091409 pursuant to this section shall be made upon forms prescribed by the
14101410 Authority;
14111411 2. Each application shall identify the city or co unty in which
14121412 the applicant seeks to obtain licensure as a medical marijuana
14131413 business;
14141414 3. Applicants shall submit a complete application to the
14151415 Authority before the application may be accepted or considered;
14161416 4. All applications shall be comple te and accurate in every
14171417 detail;

14501450 7. All applicants shall be approved for licensing review that,
14511451 at a minimum, meets the following criteria:
14521452 a. twenty-five (25) years of age or older,
14531453 b. if applying as an individual, proof that the applic ant
14541454 is an Oklahoma resident pursuant to paragraph 11 of
14551455 this subsection,
14561456 c. if applying as an entity, proof that seventy-five
14571457 percent (75%) of all members, managers, executive
14581458 officers, partners, board members or any other form of
14591459 business ownership are Ok lahoma residents pursuant to
14601460 paragraph 11 of this subsecti on,
14611461 d. if applying as an individual or entity, proof that the
14621462 individual or entity is registered to conduct business
14631463 in the State of Oklahoma,
14641464 e. disclosure of all ownership interests pursuant t o the
14651465 Oklahoma Medical Marijuana and Patient Protection Act,

14991499 five (5) years, is not a current inmate in the custody
15001500 of the Department of Corrections, or currently
15011501 incarcerated in a jail or corrections fac ility;
15021502 8. There shall be no limit to the number of medica l marijuana
15031503 business licenses or categories that an individual or entity can
15041504 apply for or receive, although each application and each category
15051505 shall require a separate application and application fe e. A
15061506 commercial grower, processor and dispensary, or any combination
15071507 thereof, are authorized to share the same address or physical
15081508 location, subject to the restrictions set forth in the Oklahoma
15091509 Medical Marijuana and Patient Protection Act;
15101510 9. All applicants for a medical marijuana business license,
15111511 research facility license or education facility license authorized
15121512 by the Oklahoma Medical Marijuana and Patient Protection Act, or for
15131513 a renewal of such license, shall undergo an Oklahoma criminal
15141514 history background check conducted by the Oklahoma State Bureau of
15151515 Investigation (OSBI) within thirty (30) days prior to the

15521552 of a medical marijuana business application, all applicants shall

15981598 registration with the Oklahoma State Bureau of Narcotics and
15991599 Dangerous Drugs Control as provided in Sections 2-302 through 2-304

16011601 13. All applicants shall establish their identity through
16021602 submission of a color copy or digital image of one of the following
16031603 unexpired documents:
16041604 a. front of an Oklahoma driver license,
16051605 b. front of an Oklahoma identification card,
16061606 c. a United States passport or other photo id entification
16071607 issued by the United States government, or
16081608 d. a tribal identification card approved for
16091609 identification purposes by the Oklahoma Department of

16111611 14. All applicants shall submit an applicant photograph.
16121612 F. G. The Authority shall review the temporary medical
16131613 marijuana business license application; approve, reject or deny the

16431643 G. H. 1. The Authority shall review the temporary medical
16441644 marijuana business applications and conduct all investigations,
16451645 inspections and interviews before approving the application for an
16461646 annual medical marijuana business license for the specific category
16471647 applied under. The annual medical marijuana business license shall
16481648 not be issued until the Authority determines that all n ecessary
16491649 inspections and reviews including, bu t not limited to, plan reviews,
16501650 safety inspections or compliance inspections, have been completed .
16511651 2. Approved applicants shall be issued a an annual medical
16521652 marijuana business license for the specific category applied under,
16531653 which shall act as proof of their approved status. Rejection and
16541654 denial letters shall provide a reason for the rejection or denial.
16551655 Applications for an annual medical marijuana business license may
16561656 only be rejected or denied based on the applicant not meeting the
16571657 standards set forth in the provisions of subsection D of this
16581658 section for a temporary medical marijuana business license, the
16591659 provisions of the Oklahoma Medical Marijuana and Patient Protection
16601660 Act and Sections 420 through 426.1 of this title, improper
16611661 completion of the application, or for a reason provided for in the
16621662 Oklahoma Medical Marijuana and Patient Protection Act and Sections

17061706 4. Approval, rejection, denial or status-update letters shall
17071707 be sent to the applicant in the same method the application was
17081708 submitted to the Authority.
17091709 5. Medical marijuana businesses issued a medical m arijuana
17101710 business license prior to the effective date of this act shall b e
17111711 required to submit business -formation documents, financial and
17121712 property information, and insurance information pertaining to the
17131713 operations of the medical marijuana business, as prescribed in
17141714 subparagraphs a, b, c, d, e, f, and i of paragraph 6 of subsection D

17471747 immediately thereafter for purposes of resolving any

17501750 fails to submit the required documentation six ty (60) days prior to
17511751 the date of renewal, the license of the medical ma rijuana business
17521752 shall be suspended until such time as the documentation is submitted
17531753 to the Authority.
17541754 6. Medical marijuana businesses that have be en issued a
17551755 temporary and annual me dical marijuana business license pursuant to
17561756 the provisions of subsectio n D of this section shall be required to
17571757 annually submit updated business -formation documents, financial and
17581758 property information, and insurance info rmation pertaining to the
17591759 operations of the medi cal marijuana business, as prescribed in
17601760 subparagraphs a, b, c, d, e, f, and i of paragraph 6 of subsection D
17611761 of this section, to the Authority w hen seeking renewal of the
17621762 medical marijuana business license.
17631763 H. I. A license for a medical marijuana business, medical
17641764 marijuana research facility, medical marijuana education facility or

17931793 1. A person until all required fees have been paid;
17941794 2. A person who has been convicted of a nonviolent felony
17951795 within two (2) years of the date of application, or within five (5)
17961796 years for any other felony;
17971797 3. A corporation, if the criminal history of any of its
17981798 officers, directors or stockholders indicates that the officer,
17991799 director or stockholder has been convicted of a nonviolent felony
18001800 within two (2) years of the date of application, or wi thin five (5)
18011801 years for any other felony;
18021802 4. A person under twenty-five (25) years of age;
18031803 5. A person licensed pursuant to this section who, during a
18041804 period of licensure, or who, at the time of application, has failed
18051805 to:
18061806 a. file taxes, interest or pena lties due related to a
18071807 medical marijuana business, or
18081808 b. pay taxes, interest or penalties due related to a
18091809 medical marijuana business;
18101810 6. A sheriff, deputy sheriff, police officer or pros ecuting
18111811 officer, or an officer or employee of the Authority or munic ipality;
18121812 7. A person whose authority to be a caregiver, as defined in
18131813 Section 427.2 of this title, has been revoked by the Authority; or

18431843 disposal facility that, after the initiation of a disciplinary
18441844 action, has had a medical marijuana license revoked, not renewed, or
18451845 surrendered during the five (5) ye ars preceding submission of the
18461846 application and for the following violations:
18471847 a. unlawful sales or purchases,
18481848 b. any fraudulent acts, falsification of records or
18491849 misrepresentation to the Authority, medical marijuana
18501850 patient licensees, caregiver licensees o r medical
18511851 marijuana business licensees,
18521852 c. any grossly inaccurate or fraudulent reporting,
18531853 d. threatening or harming any medical marijuana patient,
18541854 caregiver, medical practitioner or employee of the
18551855 Authority,
18561856 e. knowingly or intentionally refus ing to permit the
18571857 Authority access to premises or records,
18581858 f. using a prohibited, hazardous substance for processing
18591859 in a residential area,
18601860 g. criminal acts relating to t he operation of a medical
18611861 marijuana business, or
18621862 h. any violations that end anger public health and safety
18631863 or product safety.

18911891 licensee, the Authority and municipalities may have access to
18921892 criminal history record information furnished by a criminal justice
18931893 agency subject to any restrictions imposed by such an agency.
18941894 J. K. The failure of an applicant or licensee to provide the
18951895 requested information by the Authority deadline may be groun ds for
18961896 denial of the application.
18971897 K. L. All applicants and licensees shall submit information to
18981898 the Authority in a full, faithful, truthful and fair manner. The
18991899 Authority may recommend denial of an application where the appli cant
19001900 or licensee made misstatements, omissions, misrepresentations or
19011901 untruths in the application or in connection with the background
19021902 investigation of the applicant. This type of conduct may be grounds
19031903 for administrative action against the applicant or licensee. Typos
19041904 and scrivener errors shall not be grounds for denial.
19051905 L. M. A licensed medical marijuana business premises shall be
19061906 subject to and responsible for compliance with applicable provisions
19071907 consistent with the zoning where such business is locate d as
19081908 described in the most recent versions of the Oklahoma Uniform
19091909 Building Code, the International Building Code and the International
19101910 Fire Code, unless granted an exemption by a municipality or
19111911 appropriate code enforcement entity.
19121912 M. N. All medical marijuana business, medical marijuana
19131913 research facility, medical marijuana education facility and medical

19411941 licensure fees prior to receiving licensure to operate.
19421942 N. O. A medical marijuana business, medical marijuana rese arch
19431943 facility, medical marijuana education facility or medical marijuana
19441944 waste disposal facility that attempts to renew its license after the
19451945 expiration date of the license shall pay a late renewal fee in an
19461946 amount to be determined by the Authority to reinstate the license.
19471947 Late renewal fees are nonrefundable. A license that has been
19481948 expired for more than ninety (90) days shall not be renewed.
19491949 O. P. No medical marijuana business, medical marijuana research
19501950 facility, medical marijuana education facility or medical marijuana
19511951 waste disposal facility shall possess, sell or transfer medical
19521952 marijuana or medical marijuana products without a valid, unexpired
19531953 license issued by the Authority.
19541954 SECTION 6. AMENDATORY 63 O.S. 2021, Section 427.16, as
19551955 amended by Section 16, Chapter 251, O.S.L. 2022 (63 O.S. Supp. 2022,
19561956 Section 427.16), is amended to read as follows:
19571957 Section 427.16 A. There is hereby created a medical marijuana
19581958 transporter license as a category of the medical marijuana business
19591959 license.
19601960 B. Pursuant to Sect ion 424 of this title, the Oklahoma Medical
19611961 Marijuana Authority sh all issue a temporary and an annual medical
19621962 marijuana transporter license to licensed medical marijuana

19961996 C. A temporary or annual medical marijuana transporter license

19991999 medical marijuana business license set forth in Section 427.14 of
20002000 this title, the Oklahoma Medical Marijuana and Patient Protection
20012001 Act and the requirements set forth in this section to provide
20022002 logistics, distribution and storage of medical marijuana, medical
20032003 marijuana concentrate and medical marijuana products.
20042004 D. A medical marijuana transporter license shall be v alid for
20052005 one (1) year and shall not be transferred with a change of
20062006 ownership. A licensed medical marijuana transporter shall be
20072007 responsible for all medical marijuana, medical marijuana concentrate
20082008 and medical marijuana products once the transporter takes control of
20092009 the product.
20102010 E. A transporter license shall be required for any person or
20112011 entity to transport or transfer medical marijuana, medical marijuana
20122012 concentrate or medical marijuana products from a licensed medical
20132013 marijuana business to another medi cal marijuana business, or from a

20422042 F. A medical marijuana transporter licensee may contract with

20442044 G. A medical marijuana transporter may maintain a licensed
20452045 premises to temporarily store medical marijuana, medical marijuana
20462046 concentrate and medical marijuana products and to use as a
20472047 centralized distribution point. A medical marijuana transporter may
20482048 store and distribute medical marijuana, medical marijuana
20492049 concentrate and medical marijuana products from the licensed
20502050 premises. The licensed premises shall meet all security
20512051 requirements applicable to a medical marijuana business.
20522052 H. A medical marijuana tr ansporter licensee shall use the seed-
20532053 to-sale tracking system developed pursuant to the Oklahoma Medical
20542054 Marijuana and Patient Protection Act to create shipping manifests
20552055 documenting the transport of medical marijuana, medical marijuana
20562056 concentrate and medical marijuana products throughout the state.
20572057 I. A licensed medical marijuana transporter may maintain and
20582058 operate one or more warehouses in the state to handle medical
20592059 marijuana, medical marijuana concentrate and medical marijuana
20602060 products. Each locatio n shall be registered and inspected by the
20612061 Authority prior to its use.
20622062 J. With the exception of a lawful transfer between medical
20632063 marijuana businesses who are licensed to operate at the same

20982098 K. A transporter agent may possess marijuana at any location
20992099 while the transporter agent is transferring marijuana to or from a
21002100 licensed medical marijuana business, licensed medical marijuana
21012101 research facility or licensed medical marijuana education facility.
21022102 The Authority shall administer and enforce the provisions of this
21032103 section concerning transportation.
21042104 L. The Authority shall issue a transporter agent license to
21052105 individual agents, employees, officers or owners of a transporter
21062106 license in order for the individual to qualify to transport medical
21072107 marijuana, medical marijuana concentrate or medical marijuana
21082108 products.
21092109 M. The annual fee for a transporter agent license shall be
21102110 Twenty-five Dollars ($25.00) and shall be paid by the transporter
21112111 license holder or the individual applicant. Transporter license
21122112 reprints shall be Twenty Dollars ($20.00).

21432143 3. Proof of identity as required for a medical marijuana

21452145 4. Possession of a valid state-issued driver license;
21462146 5. Verification of employment with a licensed transporter;
21472147 6. The application and affiliated fee; and
21482148 7. A copy of the criminal background check conducted by the
21492149 Oklahoma State Bureau of Investigation, paid for by the applicant.
21502150 O. If the transporter agent application is denied, the
21512151 Authority shall notify the transporter in writing of the reason for
21522152 denying the registry identification card.
21532153 P. A registry identification card for a transporter shall
21542154 expire one (1) year after the date of issuance or upon notification
21552155 from the holder of the transporter license that the transporter
21562156 agent ceases to work as a transporter.
21572157 Q. The Authority may revoke the registry identification card of
21582158 a transporter agent who knowi ngly violates any provision of this
21592159 section, and the transporter is subject to any other penalties
21602160 established by law for the violation.
21612161 R. The Authority may revoke or suspend the transporter license

21972197 427.2 of this title capable of securing all transported products.
21982198 T. Prior to the transport of any medical marijuan a, medical
21992199 marijuana concentrate or medical marijuana products, an inventory
22002200 manifest shall be prepared at the originat ion point of the medical
22012201 marijuana. The inventory manifest shal l include the following
22022202 information:
22032203 1. For the origination point of the medical marijuana:
22042204 a. the licensee number for the commercial grower,
22052205 processor or dispensary,
22062206 b. address of originatio n of transport, and
22072207 c. name and contact information for the orig inating
22082208 licensee;
