43	40		An Act relating to schools; amending 70 O.S. 2021,
44	41		Section 3-101, which relates to the State Board of
45	42		Education; modifying mem bership of the Board;
46	43		requiring Senate confirmation f or certain
47	44		appointments; providing for members to serve at the
48	45		pleasure of the appointing authority ; directing
49	46		vacancies to be filled by the appointing authority;
50	47		providing for initial appointments within specified
51	48		time; establishing termination date for initial

59	56		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
60	57		SECTION 1. AMENDATORY 70 O.S. 2021, Section 3 -101, is
61	58		amended to read as follows:
62	59		Section 3-101. A. The State Board of Education shall consist
63	60		of seven (7) eleven (11) members. The State Superinten dent of
64	61		Public Instruction shall be a member and the chairperson of the
65	62		Board. The remaining six ten (10) members shall be appointed as
66	63		follows:
	64	+	1. Six (6) members appointed by the Governor by and with the
	65	+	advice and consent of the Senate. Except as otherwise provided for

94		-	1. Six (6) members appointed by the Governor by and with the
95		-	advice and consent of the Senate. Except as otherwise provided for
96	92		in subsection B of this section, upon assuming office each Governor
97	93		shall appoint one member from each congressional district and one
98	94		member from the state at large.;
99	95		2. Two (2) members appointed by the Speaker of the Oklahoma
100	96		House of Representatives , one which shall be a rural resident of the
101	97		state and one which shall be a former school superi ntendent from a
102	98		district with an enrollment of less t han ten thousand (10,000)
103	99		students; and
104	100		3. Two (2) members a ppointed by the President Pro Tempore of
105	101		the Oklahoma State Senate, one which shall be a rural resid ent of
106	102		the state and one which shall be a former school superintendent from
107	103		a district with an enrollment of more than ten thousa nd (10,000)
108	104		students.
109	105		Each appointment shall be made to take eff ect on April 2. The term
110	106		of each appointed member shall be four (4) years. Appointed members
111	107		shall serve until a successor is appointed . Appointed members shall
112	108		serve at the pleasure of the Governor appointing authority . Upon
113	109		the occurrence of a vacancy the same shall be f illed by the Governor
114	110		appointing authority , subject to confirmation by the Senate at the
115	111		next session of the Legislature if the vacancy is a member appointed
116	112		by the Governor. The appointment to fill a vacancy shall be made
117	113		for the unexpired term.
	114	+	B. On the effective date of this act, all appointed positions
	115	+	of the current State Board of Education shall be deemed vacant and

145		-	B. On the effective date of this act, all appoint ed positions
146		-	of the current State Board of Education shall be deemed vacant and
147	142		the terms of persons serving on the Board shall b e deemed
148	143		terminated. The Governor appointing authorities shall make initial
149	144		appointments pursuant to t he provisions of this subsection within
150	145		thirty (30) days of the ef fective date of this act, with one member
151	146		appointed from each congressional district an d one member appointed
152	147		from the state at large . The appointments Members appointed by the
153	148		Governor shall be subject to confirmation by t he Senate at the next
154	149		session of the Legislature. The terms for members appoin ted
155	150		pursuant to this subsection shall te rminate on April 2, 2015 2024.
156	151		Thereafter, members shall be appointed as provided for in subsection
157	152		A of this section.
158	153		C. No person shall be eligible to be appointed to serve on the
159	154		State Board unless the person has been awarded a high school diploma
160	155		or certificate of high school equivalency. Any member appointed to
161	156		the State Board shall complete the workshop requirements of a new
162	157		school board member pursuant to Section 5-110 of this title within
163	158		thirteen (13) months fo llowing or preceding the appointmen t of the
164	159		member. Notwithstanding any provision of law to the contrary, the
165	160		State Department of Education shall not charge any member of the
166	161		State Board of Education a fee for any workshop provided by the
167	162		Department for board members pursuant to Section 5 -110 of this title
168	163		and shall not pay a fee to any organization or institution of higher
	164	+	education on behalf of a member of the State Board of Education, or
	165	+	reimburse any member of the Board for a fee paid to any organizati on

197		-	reimburse any member of the Board for a fee paid to any organizati on
198	192		or institution of higher educati on, for attendance at a workshop or
199	193		courses to satisfy the requirements of Section 5 -110 of this title.
200	194		D. Members of the Board shall receive necessary traveling
201	195		expenses while in the performance of their duties in accordance with
202	196		the State Travel Reimbur sement Act.
203	197		SECTION 2. This act shall become effective November 1, 2023.
