4340 An Act relating to schools; amending 70 O.S. 2021,

5956 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6057 SECTION 1. AMENDATORY 70 O.S. 2021, Section 3 -101, is
6158 amended to read as follows:
6259 Section 3-101. A. The State Board of Education shall consist
6360 of seven (7) eleven (11) members. The State Superinten dent of
6461 Public Instruction shall be a member and the chairperson of the
6562 Board. The remaining six ten (10) members shall be appointed as
6663 follows:
64+1. Six (6) members appointed by the Governor by and with the
65+advice and consent of the Senate. Except as otherwise provided for

94-1. Six (6) members appointed by the Governor by and with the
95-advice and consent of the Senate. Except as otherwise provided for
9692 in subsection B of this section, upon assuming office each Governor
9793 shall appoint one member from each congressional district and one
9894 member from the state at large.;
9995 2. Two (2) members appointed by the Speaker of the Oklahoma
10096 House of Representatives , one which shall be a rural resident of the
10197 state and one which shall be a former school superi ntendent from a
10298 district with an enrollment of less t han ten thousand (10,000)
10399 students; and
104100 3. Two (2) members a ppointed by the President Pro Tempore of
105101 the Oklahoma State Senate, one which shall be a rural resid ent of
106102 the state and one which shall be a former school superintendent from
107103 a district with an enrollment of more than ten thousa nd (10,000)
108104 students.
109105 Each appointment shall be made to take eff ect on April 2. The term
110106 of each appointed member shall be four (4) years. Appointed members
111107 shall serve until a successor is appointed . Appointed members shall
112108 serve at the pleasure of the Governor appointing authority . Upon
113109 the occurrence of a vacancy the same shall be f illed by the Governor
114110 appointing authority , subject to confirmation by the Senate at the
115111 next session of the Legislature if the vacancy is a member appointed
116112 by the Governor. The appointment to fill a vacancy shall be made
117113 for the unexpired term.
114+B. On the effective date of this act, all appointed positions
115+of the current State Board of Education shall be deemed vacant and

145-B. On the effective date of this act, all appoint ed positions
146-of the current State Board of Education shall be deemed vacant and
147142 the terms of persons serving on the Board shall b e deemed
148143 terminated. The Governor appointing authorities shall make initial
149144 appointments pursuant to t he provisions of this subsection within
150145 thirty (30) days of the ef fective date of this act, with one member
151146 appointed from each congressional district an d one member appointed
152147 from the state at large . The appointments Members appointed by the
153148 Governor shall be subject to confirmation by t he Senate at the next
154149 session of the Legislature. The terms for members appoin ted
155150 pursuant to this subsection shall te rminate on April 2, 2015 2024.
156151 Thereafter, members shall be appointed as provided for in subsection
157152 A of this section.
158153 C. No person shall be eligible to be appointed to serve on the
159154 State Board unless the person has been awarded a high school diploma
160155 or certificate of high school equivalency. Any member appointed to
161156 the State Board shall complete the workshop requirements of a new
162157 school board member pursuant to Section 5-110 of this title within
163158 thirteen (13) months fo llowing or preceding the appointmen t of the
164159 member. Notwithstanding any provision of law to the contrary, the
165160 State Department of Education shall not charge any member of the
166161 State Board of Education a fee for any workshop provided by the
167162 Department for board members pursuant to Section 5 -110 of this title
168163 and shall not pay a fee to any organization or institution of higher
164+education on behalf of a member of the State Board of Education, or
165+reimburse any member of the Board for a fee paid to any organizati on

196-education on behalf of a member of the State Board of Education, or
197-reimburse any member of the Board for a fee paid to any organizati on
198192 or institution of higher educati on, for attendance at a workshop or
199193 courses to satisfy the requirements of Section 5 -110 of this title.
200194 D. Members of the Board shall receive necessary traveling
201195 expenses while in the performance of their duties in accordance with
202196 the State Travel Reimbur sement Act.
203197 SECTION 2. This act shall become effective November 1, 2023.
