40	40	An Act relating to counties and county officers ;
41	41	amending 19 O.S. 202 1, Section 165, which relates to
42	42	travel allowances for county officers; adjusting
43	43	travel reimbursement allowances; establishing rate
44	44	for allowances; providing an effective date ; and

50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. AMENDATORY 19 O.S. 2021, Section 165, is
52	52	amended to read as follows:
53	53	Section 165. A. In lieu of reimbursement for traveling
54	54	expenses within their county each county commissioner and sheriff
55	55	may receive a monthly travel allowance of Seven Hundred Dollars
56	56	($700.00) One Thousand Dollars ($1,000.00). In lieu of the
57	57	reimbursement for traveling expenses authorized by law for each
58	58	county officer, each county assessor may receive a monthly travel
59	59	allowance of Six Hundred Dollars ($600.00) Nine Hundred Dollars
60	60	($900.00), and each county clerk, court clerk and county trea surer
61	61	may receive a monthly travel allowance of Five Hundred Dollars
62	62	($500.00) Eight Hundred Dollars ($800 .00). Each such county officer

89	89	may be subject to the penalty provided by Section 166 of this title
90	90	for failure to attend the meetin gs specified in that section.
91	91	B. Beginning in fiscal year 2028, the monthly amount of travel
92	92	reimbursement allowances for county officers shall be annually
93	93	increased by two percent (2%).
94	94	C. All newly elected county officials shal l be reimbursed by
95	95	their respective coun ties for any approved training provided before
96	96	such official takes office. Such training expenses shall be
97	97	reimbursed in January when such off icial takes office.
98	98	C. D. The provisions of this section and Sections 16 3 and 164
99	99	of this title shall not prevent the emergency use of a county-owned
100	100	vehicle or county-owned equipment by a county officer when such
101	101	county officer is acting on behalf of the co unty or when such use is
102	102	related to county business. As used in this subsection, "emergency"
103	103	means an unforeseen combination of circumstances or the resulting
104	104	state that calls for immediate action.
105	105	SECTION 2. This act shall become effective July 1, 2023.
106	106	SECTION 3. It being immediately nece ssary for the preservation
107	107	of the public peace, health or safety, an emergency is hereby
108	108	declared to exist, by reason whereof thi s act shall take effect and
109	109	be in full force from and after its passage and approval.
