4040 An Act relating to counties and county officers ;
4141 amending 19 O.S. 202 1, Section 165, which relates to
4242 travel allowances for county officers; adjusting
4343 travel reimbursement allowances; establishing rate
4444 for allowances; providing an effective date ; and

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. AMENDATORY 19 O.S. 2021, Section 165, is
5252 amended to read as follows:
5353 Section 165. A. In lieu of reimbursement for traveling
5454 expenses within their county each county commissioner and sheriff
5555 may receive a monthly travel allowance of Seven Hundred Dollars
5656 ($700.00) One Thousand Dollars ($1,000.00). In lieu of the
5757 reimbursement for traveling expenses authorized by law for each
5858 county officer, each county assessor may receive a monthly travel
5959 allowance of Six Hundred Dollars ($600.00) Nine Hundred Dollars
6060 ($900.00), and each county clerk, court clerk and county trea surer
6161 may receive a monthly travel allowance of Five Hundred Dollars
6262 ($500.00) Eight Hundred Dollars ($800 .00). Each such county officer

8989 may be subject to the penalty provided by Section 166 of this title
9090 for failure to attend the meetin gs specified in that section.
9191 B. Beginning in fiscal year 2028, the monthly amount of travel
9292 reimbursement allowances for county officers shall be annually
9393 increased by two percent (2%).
9494 C. All newly elected county officials shal l be reimbursed by
9595 their respective coun ties for any approved training provided before
9696 such official takes office. Such training expenses shall be
9797 reimbursed in January when such off icial takes office.
9898 C. D. The provisions of this section and Sections 16 3 and 164
9999 of this title shall not prevent the emergency use of a county-owned
100100 vehicle or county-owned equipment by a county officer when such
101101 county officer is acting on behalf of the co unty or when such use is
102102 related to county business. As used in this subsection, "emergency"
103103 means an unforeseen combination of circumstances or the resulting
104104 state that calls for immediate action.
105105 SECTION 2. This act shall become effective July 1, 2023.
106106 SECTION 3. It being immediately nece ssary for the preservation
107107 of the public peace, health or safety, an emergency is hereby
108108 declared to exist, by reason whereof thi s act shall take effect and
109109 be in full force from and after its passage and approval.
