50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. NEW LAW A new section of law to be codified
52	52	in the Oklahoma Statutes as Section 1685.2 of Title 21, unless there
53	53	is created a duplication in numberin g, reads as follows:
54	54	A. This act shall be known and may be cited as the "Endangered
55	55	Ark Foundation Preservation Act ".
56	56	B. The purpose of this act is to preserve the sa fety, health,
57	57	and well-being of elephants in Oklahoma.
58	58	C. As used in the Endangered Ark Foundation Preservation Act:
59	59	1. "Free contact" means the use of tools and techniques such as
60	60	a guide and tether to help elephants cope with certain conditions or
61	61	as necessary during intensive procedures associated with treating
62	62	chronic illnesses or a nimal reproduction; and

89	89	2. "Protected contact" means the contact between an elephant
90	90	and its handler through a barrier such as a chute or an elephant
91	91	restraint device.
92	92	D. It shall not be considered cruelty to animals , as provided
93	93	in Section 1685 of Title 21 of the Oklahoma Statutes, for licensed
94	94	operators of a nonprofit entity caring for elephants to practice
95	95	free contact and protected contact.
96	96	SECTION 2. This act shall become effective Nov ember 1, 2023.
