5457 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5558 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1290.22, is

6063 A. Except as provided in subsections B, C and D of this

6366 manner the existing rights of any person, property owne r, tenant,

9195 control the possession of weapons on any property owned or
9296 controlled by the person or business entity.
9397 B. 1. No person, property owner, tenant, employer, liquor
9498 store, holder of an ev ent permit, place of worship or business
9599 entity shall be permitted to establish any policy or rule that has
96100 the effect of prohibiting prohibits any person, except a convicted
97101 felon, from transporting and storing firearms in a locked vehicle on
98102 any property set aside for any vehicle.
99103 2. No person, employer, or business entity shall establish,
100104 maintain, or enforce any policy or rule that has the effect of
101105 prohibiting any person or employ ee, except a convicted felon, from
102106 transporting, carrying, or storing firearms or amm unition in or upon
103107 a vehicle, personally owned, leased, or rented by the person or
104108 employee while conducting business for the employer or business
105109 entity.
106110 3. An individual may bring a civil action to enforce the
107111 provisions of paragraph 1 and 2 of this subsection. If a plaintiff
108112 prevails in a civil action against a person, property owner, tenant,
109113 employer, liquor store, place of wor ship or business, for a policy
110114 or rule that violates paragraph 1 and 2 of this subsection, the
111115 court shall award actual damages, enjoin further violations of
112116 paragraph 1 of this subsection, and award court costs and attorney
113117 fees to the prevailing plaintiff. The provisions of this subsection

140145 shall not apply to claims pursuant to the Administrative Workers '
141146 Compensation Act.
142147 C. A property owner, tenant, employer, liqu or store, place of
143148 worship or business entity may prohibit a ny person from carrying a
144149 concealed or unconcealed firearm on the property. If the building
145150 or property is open to the public, the property owner, tenant,
146151 employer, liquor store, place of worship or business entity shall
147152 post signs on or about the propert y stating such prohibition.
148153 D. No person, property owner, tenant, employer, liq uor store,
149154 holder of an event permit, place of worship or business entity shall
150155 be permitted to establish any policy or rule that has the effect of
151156 prohibiting any person from carrying a concealed or unconc ealed
152157 firearm on property within the specific excl usion provided for in
153158 paragraph 4 of subsection B of Section 1277 of this title; provided
154159 that carrying a concealed or unconcealed firearm may be prohibited
155160 in the following places:
156161 1. The portion of a pub lic property structure or building
157162 during an event authorized by the city, town, county, state or
158163 federal governmental authority owning or controlling such building
159164 or structure;
160165 2. Any public property sports field including any adjacent
161166 seating or adjacent area set aside for viewing a sporting event,
162167 where an elementary or secondary school, collegiate, or professional
163168 sporting event, or an International Olympic Commit tee or

190196 organization, or any committee subordinate to the In ternational
191197 Olympic Committee event is being held;
192198 3. The fairgrounds during the Oklahoma State Fair or the Tulsa
193199 State Fair; and
194200 4. The portion of a public property structure or building that
195201 is leased or under contract to a business or not -for-profit entity
196202 or group for offices.
197203 E. The otherwise lawful carrying of a concealed or un concealed
198204 firearm by a person on property that has signs prohibiting the
199205 carrying of firearms shall subject the pers on to being denied
200206 entrance onto the property or removed f rom the property. If the
201207 person:
202208 1. Has been informed by the property owner, bus iness entity or
203209 manager of the business that the person is in violation of a policy
204210 that prohibits firearms on the p roperty; and
205211 2. Refuses to leave the property and a peace officer is
206-summoned, the person shall, upon conviction, be guilty of a
207-misdemeanor punishable by a fine not to exceed Two Hundred Fifty
208-Dollars ($250.00).

247+concealed or unconcealed weapon on property that the person,
240248 property owner, tenant, employer, liquor store, holder of an event
241249 permit, place of worship or business entity owns, o r has legal
242250 control of, is immune from and shall not be subject to any liability
243251 arising from that decision. Except for acts of gross negligence or
244252 willful or wanton mi sconduct, an employer who does or does not
245253 prohibit his or her employees from transporting, storing, or
246254 carrying a concealed or unconcealed weapon is immune from and shall
247255 not be subject to any liability arising from that decision. A
248256 person, property owner, tenant, employer, liquor store, holder of an
249257 event permit, place of worship or busin ess entity that does not
250258 prohibit persons from transporting, storing, or carrying a concealed
251259 or unconcealed weapon pursuant to subse ction D of this section shall
252-be immune from and shall not be subject to any liability arising
260+not be immune from and shall not be subject to any liability arising
253261 from the transporting, storing, or carrying of a concealed or
254262 unconcealed weapon, while in the scope of employment, on the
255263 property or in or about a business entity vehicle. The provisions
256264 of this subsection shal l not apply to claims pursuant to the
257265 Administrative Workers ' Compensation Act.
258266 G. It shall not be considered part of an employee's job
259267 description or within the employee 's scope of employment if an
260268 employee is allowed to carry or discharge a weapon pursu ant to this
261269 section.
262-H. Nothing in subsections F and G of this section sh all prevent

297+H. Nothing in subsections F and G of this section sh all prevent
298+an employer, employee or p erson who has suffered loss resulting from
290299 the discharge of a weapon to seek redress or damages of the person
291300 who discharged the weapon or used the weapon outside the provisions
292301 of the Oklahoma Self -Defense Act.
293302 I. As used in the this section, "vehicle" includes, but is not
294303 limited to any automobile, truck, minivan, sports utility vehicle,
295304 motorcycle, motor sc ooter, bicycle, vessel, and any other vehicle or
296305 vessel used for lawful transportation.
297306 SECTION 2. This act shall become effective November 1, 2023.
