99 | 103 | | 2. No person, employer, or business entity shall establish, |
---|
100 | 104 | | maintain, or enforce any policy or rule that has the effect of |
---|
101 | 105 | | prohibiting any person or employ ee, except a convicted felon, from |
---|
102 | 106 | | transporting, carrying, or storing firearms or amm unition in or upon |
---|
103 | 107 | | a vehicle, personally owned, leased, or rented by the person or |
---|
104 | 108 | | employee while conducting business for the employer or business |
---|
105 | 109 | | entity. |
---|
106 | 110 | | 3. An individual may bring a civil action to enforce the |
---|
107 | 111 | | provisions of paragraph 1 and 2 of this subsection. If a plaintiff |
---|
108 | 112 | | prevails in a civil action against a person, property owner, tenant, |
---|
109 | 113 | | employer, liquor store, place of wor ship or business, for a policy |
---|
110 | 114 | | or rule that violates paragraph 1 and 2 of this subsection, the |
---|
111 | 115 | | court shall award actual damages, enjoin further violations of |
---|
112 | 116 | | paragraph 1 of this subsection, and award court costs and attorney |
---|

148 | 153 | | D. No person, property owner, tenant, employer, liq uor store, |
---|
149 | 154 | | holder of an event permit, place of worship or business entity shall |
---|
150 | 155 | | be permitted to establish any policy or rule that has the effect of |
---|
151 | 156 | | prohibiting any person from carrying a concealed or unconc ealed |
---|
152 | 157 | | firearm on property within the specific excl usion provided for in |
---|
153 | 158 | | paragraph 4 of subsection B of Section 1277 of this title; provided |
---|
154 | 159 | | that carrying a concealed or unconcealed firearm may be prohibited |
---|

156 | 161 | | 1. The portion of a pub lic property structure or building |
---|
157 | 162 | | during an event authorized by the city, town, county, state or |
---|
158 | 163 | | federal governmental authority owning or controlling such building |

160 | 165 | | 2. Any public property sports field including any adjacent |
---|
161 | 166 | | seating or adjacent area set aside for viewing a sporting event, |

197 | 203 | | E. The otherwise lawful carrying of a concealed or un concealed |

198 | 204 | | firearm by a person on property that has signs prohibiting the |
---|
199 | 205 | | carrying of firearms shall subject the pers on to being denied |
---|
200 | 206 | | entrance onto the property or removed f rom the property. If the |
---|
201 | 207 | | person: |
---|
202 | 208 | | 1. Has been informed by the property owner, bus iness entity or |
---|
203 | 209 | | manager of the business that the person is in violation of a policy |
---|
204 | 210 | | that prohibits firearms on the p roperty; and |
---|
205 | 211 | | 2. Refuses to leave the property and a peace officer is |
---|
209 | 216 | | F. A person, property owner, tenant, empl oyer, liquor store, |
---|
210 | 217 | | holder of an event permit, place of w orship or business entity that |
---|
211 | 218 | | does or does not prohibit any individual, except a c onvicted felon, |
---|
212 | 219 | | from transporting, storing, or carrying a loaded or unloaded, |
---|
240 | 248 | | property owner, tenant, employer, liquor store, holder of an event |
---|
241 | 249 | | permit, place of worship or business entity owns, o r has legal |
---|
242 | 250 | | control of, is immune from and shall not be subject to any liability |
---|
243 | 251 | | arising from that decision. Except for acts of gross negligence or |
---|
244 | 252 | | willful or wanton mi sconduct, an employer who does or does not |
---|
245 | 253 | | prohibit his or her employees from transporting, storing, or |
---|
246 | 254 | | carrying a concealed or unconcealed weapon is immune from and shall |
---|
247 | 255 | | not be subject to any liability arising from that decision. A |
---|
248 | 256 | | person, property owner, tenant, employer, liquor store, holder of an |
---|
249 | 257 | | event permit, place of worship or busin ess entity that does not |
---|
250 | 258 | | prohibit persons from transporting, storing, or carrying a concealed |
---|
251 | 259 | | or unconcealed weapon pursuant to subse ction D of this section shall |
---|
253 | 261 | | from the transporting, storing, or carrying of a concealed or |
---|
254 | 262 | | unconcealed weapon, while in the scope of employment, on the |
---|
255 | 263 | | property or in or about a business entity vehicle. The provisions |
---|
256 | 264 | | of this subsection shal l not apply to claims pursuant to the |
---|
257 | 265 | | Administrative Workers ' Compensation Act. |
---|
258 | 266 | | G. It shall not be considered part of an employee's job |
---|
259 | 267 | | description or within the employee 's scope of employment if an |
---|
260 | 268 | | employee is allowed to carry or discharge a weapon pursu ant to this |
---|
261 | 269 | | section. |
---|
290 | 299 | | the discharge of a weapon to seek redress or damages of the person |
---|
291 | 300 | | who discharged the weapon or used the weapon outside the provisions |
---|
292 | 301 | | of the Oklahoma Self -Defense Act. |
---|
293 | 302 | | I. As used in the this section, "vehicle" includes, but is not |
---|
294 | 303 | | limited to any automobile, truck, minivan, sports utility vehicle, |
---|
295 | 304 | | motorcycle, motor sc ooter, bicycle, vessel, and any other vehicle or |
---|
296 | 305 | | vessel used for lawful transportation. |
---|
297 | 306 | | SECTION 2. This act shall become effective November 1, 2023. |
