55 | 56 | | SECTION 1. AMENDATORY 21 O.S. 2021, Section 1277, is |

57 | 58 | | Section 1277. A. It shall be unlawful for any person, |
---|

102 | 104 | | allowed by the property owner; |
---|
103 | 105 | | 6. Any other place spec ifically prohibited by law ; and |
---|
104 | 106 | | 7. Any property set aside by a county, city, town, public trust |
---|
105 | 107 | | with a county, city or town as a beneficiary, or state governmental |
---|
106 | 108 | | authority for an event that is secured with minimum -security |
---|
107 | 109 | | provisions. For purposes of this paragraph, a minimum-security |
---|
108 | 110 | | provision consists of a location that is secured utilizing the |
---|
109 | 111 | | following: |
---|
110 | 112 | | a. a metallic-style security fence that is at least eight |
---|
111 | 113 | | (8) feet in height that encompasses the property and |
---|
112 | 114 | | is secured in such a way as to deter unauthorized |
---|

145 | 148 | | B. It shall be lawful for a person t o carry a concealed or |
---|
146 | 149 | | unconcealed firearm on the following properties: |
---|
147 | 150 | | 1. Any property set aside for the use or parking of any |
---|
148 | 151 | | vehicle, whether attended or una ttended, by a city, town, county, |
---|
149 | 152 | | state or federal governmental authority; |
---|
150 | 153 | | 2. Any property set aside for the use or parking of any |
---|
151 | 154 | | vehicle, whether attended or unattended, which is open to the |
---|
152 | 155 | | public, or by any entity engaged in gambling authorized by la w; |
---|
153 | 156 | | 3. Any property adjacent to a structure, building or office |
---|
154 | 157 | | space in which concealed or unco ncealed weapons are prohibited by |
---|
155 | 158 | | the provisions of this section; |
---|
156 | 159 | | 4. Any property designated by statute, ordinance, resolution, |
---|
157 | 160 | | policy, or use by a city, town, county or state governmental |
---|
158 | 161 | | authority as a street, plaza, sidewalk, alley, park, recreational |
---|
159 | 162 | | area, wildlife refuge, wildlife management area or fairgrounds; |
---|
160 | 163 | | provided, nothing in this paragraph shall be construed to authorize |
---|
161 | 164 | | any entry by a person in possession of a concealed or unconceale d |
---|

196 | 200 | | 6. Any public property set aside temporarily by a co unty, city, |
---|
197 | 201 | | town, public trust with a coun ty, city or town as a beneficiary, or |
---|
198 | 202 | | state governmental auth ority for the holder of an event permit that |
---|
199 | 203 | | is without minimum-security provisions, as such term is defined in |
---|
200 | 204 | | paragraph 7 of subsection A of this secti on; provided, the carry of |
---|
201 | 205 | | firearms within said permitted event area shall be limited to |
---|
202 | 206 | | concealed carry of a handgun unless otherwise authorized by the |
---|
203 | 207 | | holder of the event permit . |
---|
204 | 208 | | Nothing contained in any provision of this subsection or |
---|
205 | 209 | | subsection C of this section shall be construed to authoriz e or |
---|
206 | 210 | | allow any person in control of any place described in sub section A |
---|
207 | 211 | | of this section to establish any policy or rule that has the effect |
---|
208 | 212 | | of prohibiting any person in lawful possession of a handgun license |
---|
209 | 213 | | or otherwise in lawful possession of a firearm f rom carrying or |
---|
210 | 214 | | possessing the firearm on the property describ ed in this subsection. |
---|
211 | 215 | | C. A concealed or unconcealed weapon may be carried onto |
---|
212 | 216 | | private school property or in any school bus or vehicle used by any |
---|

244 | 249 | | used by a private school . Except for acts of gross negligence or |
---|
245 | 250 | | willful or wanton misconduct, a governing entity of a private school |
---|
246 | 251 | | that adopts a policy which authorizes the possession of a weapon on |
---|
247 | 252 | | private school property, a s chool bus or vehicle used by the private |
---|
248 | 253 | | school shall not be subject to liability for any injuries arising |
---|
249 | 254 | | from the adoption of the policy . The provisions of this subsection |
---|
250 | 255 | | shall not apply to claims pursuant to the Administrative Workers ' |
---|
251 | 256 | | Compensation Act. |
---|
252 | 257 | | D. Notwithstanding paragraph 3 of subsection A of this sect ion, |
---|
253 | 258 | | a board of education of a school district may adopt a policy |
---|
254 | 259 | | pursuant to Section 5 -149.2 of Title 70 of the Oklahoma Statutes to |
---|
255 | 260 | | authorize the carrying of a handgun onto school property b y school |
---|
256 | 261 | | personnel specifically designated by the board of educa tion, |
---|
257 | 262 | | provided such personnel either: |
---|
258 | 263 | | 1. Possess a valid armed security guard license as provided for |
---|
259 | 264 | | in Section 1750.1 et seq. of Title 59 of the Oklah oma Statutes; or |
---|
260 | 265 | | 2. Hold a valid reserve peace officer certi fication as provided |
---|
261 | 266 | | for in Section 3311 o f Title 70 of the Oklahoma Statutes. |
---|

292 | 298 | | resolution, policy, or use by a municipality as a municipal zoo or |
---|
293 | 299 | | park, of any size that is owned, leased, operated or managed by: |
---|
294 | 300 | | 1. A public trust created pursuant to the provisions of Section |
---|
295 | 301 | | 176 of Title 60 of the Oklahoma Statutes; or |
---|
296 | 302 | | 2. A nonprofit entity, |
---|
297 | 303 | | an individual shall be allowed to carry a concealed handgun but not |
---|
298 | 304 | | openly carry a handgun on the property ; provided, however, an |
---|
299 | 305 | | individual may openly carry a handgun or other firearm on the |
---|
300 | 306 | | property with permission from the public tr ust or nonprofit entity . |
---|
301 | 307 | | F. Any person violating the provisions of paragraph 2 or 3 of |
---|
302 | 308 | | subsection A of this section s hall, upon conviction, be guilt y of a |
---|
303 | 309 | | misdemeanor punishable by a fine not to exceed Two Hundred Fifty |
---|
304 | 310 | | Dollars ($250.00). A person violating any other provision of |
---|
305 | 311 | | subsection A of this section may be denied entrance onto the |
---|
306 | 312 | | property or removed from the p roperty. If the person refuses to |
---|
307 | 313 | | leave the property and a peace officer is summoned, the perso n may |
---|
308 | 314 | | be issued a citation for an amount n ot to exceed Two Hundred Fifty |
---|
309 | 315 | | Dollars ($250.00). |
---|
310 | 316 | | G. No person in possession of a valid handgun license issued |
---|
311 | 317 | | pursuant to the provisions of the Ok lahoma Self-Defense Act or who |

350 | 357 | | carried or stored as required by law and the firearm, machete, |
---|
351 | 358 | | blackjack, loaded cane, hand chain or metal knuckles are not removed |
---|
352 | 359 | | from the motor vehicle without the prior consent of the college or |
---|
353 | 360 | | university president or technology center school administrator w hile |
---|
354 | 361 | | the vehicle is on any college, university or technology center |
---|
355 | 362 | | school property; |
---|
356 | 363 | | 2. Any property authori zed for possession or use of firearms, |
---|
357 | 364 | | machetes, blackjacks, loaded canes, hand chains or metal knuckles by |

392 | 400 | | the Oklahoma State Bureau of Investigation within ten (10) days of a |

393 | 401 | | violation of any provision of this subsection by a licensee . Upon |
---|
394 | 402 | | receipt of a written notification of violation, the Bureau shall |
---|
395 | 403 | | give a reasonable notice to the licensee and hold a hearing . At the |
---|
396 | 404 | | hearing, upon a determination that the licensee has violated any |
---|
397 | 405 | | provision of this subsection, the licensee may be subject to an |
---|
398 | 406 | | administrative fine of Two Hundred Fifty Dol lars ($250.00) and may |
---|
399 | 407 | | have the handgun license suspended for three (3) months. |
---|
400 | 408 | | Nothing contained in any provision of this subsection shall be |
---|
401 | 409 | | construed to authorize or allow any college, university or |
---|
402 | 410 | | technology center school to establish any policy or ru le that has |
---|
403 | 411 | | the effect of prohibiting any person in lawful possession of a |
---|
404 | 412 | | handgun license or any person in lawful pos session of a firearm, |
---|
405 | 413 | | machete, blackjack, loaded cane, hand chain or metal knuckles from |
---|
406 | 414 | | possession of a firearm, machete, blackjack, load ed cane, hand chain |
---|
407 | 415 | | or metal knuckles in places described in paragraphs 1, 2 and 3 of |
---|
408 | 416 | | this subsection. Nothing contained in any provision of t his |
---|
409 | 417 | | subsection shall be construed to limit the authority of any college , |
---|
410 | 418 | | university or technology center school i n this state from taking |
---|

443 | 452 | | 2. District judges, associate district judges and special |
---|
444 | 453 | | district judges, who a re in possession of a valid handgun license |
---|
445 | 454 | | issued pursuant to the provisions of the Oklahoma Se lf-Defense Act |
---|
446 | 455 | | and whose names appear on a list maintained by the Administrative |
---|
447 | 456 | | Director of the Courts, when acting in the course and scope of |
---|
448 | 457 | | employment within the courthouses of t his state; |
---|
449 | 458 | | 3. Private investigators with a firearms authorization when |
---|
450 | 459 | | acting in the course and scope of employment ; |
---|
451 | 460 | | 4. Elected officials of a county, who are in possession of a |
---|
452 | 461 | | valid handgun license issued pursuant to the provision s of the |
---|
453 | 462 | | Oklahoma Self-Defense Act, may carry a concealed handgun when acting |
---|
454 | 463 | | in the performance of his or her duties within the courthous es of |
---|
455 | 464 | | the county in which he or she was elected . The provisions of this |
---|
456 | 465 | | paragraph shall not allow the elected county official to carry th e |
---|
457 | 466 | | handgun into a courtroom; |
---|
458 | 467 | | 5. The sheriff of any county may authorize cert ain employees of |
---|
459 | 468 | | the county, who possess a valid handgun license issued pursuant to |
---|
460 | 469 | | the provisions of the Oklahoma Self -Defense Act, to carry a |

502 | 512 | | I. For the purposes of this section, "motor vehicle" means any |
