5455 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5556 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1277, is
5657 amended to read as follows:
5758 Section 1277. A. It shall be unlawful for any person,
5859 including a person in possession of a valid handgun license iss ued
5960 pursuant to the provisions of the Oklahoma Self -Defense Act, to
6061 carry any concealed or unconceale d firearm into any of the follo wing
6162 places:
6263 1. Any structure, building, or office space which is owned or
6364 leased by a city, town, county, state or federal governmental
6465 authority for the purpose of conducting business with the p ublic;

9193 2. Any courthouse, courtroom, prison, jail, deten tion facility
9294 or any facility used to process, hold or house arrested persons,
9395 prisoners or persons alleged delinquent or adju dicated delinquent,
9496 except as provided in Section 21 of Title 57 of the O klahoma
9597 Statutes;
9698 3. Any public or private elementary o r public or private
9799 secondary school, except as provided in subsections C and D of th is
98100 section;
99101 4. Any publicly owned or oper ated sports arena or venue during
100102 a professional sporting event, unless a llowed by the event holder;
101103 5. Any place where gambli ng is authorized by law, unless
102104 allowed by the property owner;
103105 6. Any other place spec ifically prohibited by law ; and
104106 7. Any property set aside by a county, city, town, public trust
105107 with a county, city or town as a beneficiary, or state governmental
106108 authority for an event that is secured with minimum -security
107109 provisions. For purposes of this paragraph, a minimum-security
108110 provision consists of a location that is secured utilizing the
109111 following:
110112 a. a metallic-style security fence that is at least eight
111113 (8) feet in height that encompasses the property and
112114 is secured in such a way as to deter unauthorized

140143 b. controlled access points staffed by a uniformed,
141144 commissioned peace officer, and
142145 c. a metal detector whereby persons walk or otherwise
143146 travel with their property through or by the metal
144147 detector.
145148 B. It shall be lawful for a person t o carry a concealed or
146149 unconcealed firearm on the following properties:
147150 1. Any property set aside for the use or parking of any
148151 vehicle, whether attended or una ttended, by a city, town, county,
149152 state or federal governmental authority;
150153 2. Any property set aside for the use or parking of any
151154 vehicle, whether attended or unattended, which is open to the
152155 public, or by any entity engaged in gambling authorized by la w;
153156 3. Any property adjacent to a structure, building or office
154157 space in which concealed or unco ncealed weapons are prohibited by
155158 the provisions of this section;
156159 4. Any property designated by statute, ordinance, resolution,
157160 policy, or use by a city, town, county or state governmental
158161 authority as a street, plaza, sidewalk, alley, park, recreational
159162 area, wildlife refuge, wildlife management area or fairgrounds;
160163 provided, nothing in this paragraph shall be construed to authorize
161164 any entry by a person in possession of a concealed or unconceale d
162165 firearm into any structure, building , office space or event which is

189193 specifically prohibited by the provisions of subsection A of this
190194 section;
191195 5. Any property set aside by a public or private elementary or
192196 secondary school for the use or parking of an y vehicle, whether
193197 attended or unattended; provided, however, the firearm shall be
194198 stored and hidden fr om view in a locked motor vehicle when the motor
195199 vehicle is left unattended on school property ; and
196200 6. Any public property set aside temporarily by a co unty, city,
197201 town, public trust with a coun ty, city or town as a beneficiary, or
198202 state governmental auth ority for the holder of an event permit that
199203 is without minimum-security provisions, as such term is defined in
200204 paragraph 7 of subsection A of this secti on; provided, the carry of
201205 firearms within said permitted event area shall be limited to
202206 concealed carry of a handgun unless otherwise authorized by the
203207 holder of the event permit .
204208 Nothing contained in any provision of this subsection or
205209 subsection C of this section shall be construed to authoriz e or
206210 allow any person in control of any place described in sub section A
207211 of this section to establish any policy or rule that has the effect
208212 of prohibiting any person in lawful possession of a handgun license
209213 or otherwise in lawful possession of a firearm f rom carrying or
210214 possessing the firearm on the property describ ed in this subsection.
211215 C. A concealed or unconcealed weapon may be carried onto
212216 private school property or in any school bus or vehicle used by any

239244 private school for transportation of student s or teachers by a
240245 person who is licensed pursuant to the Oklah oma Self-Defense Act,
241246 provided a policy has been adopted by the governing entity of the
242247 private school that authorizes the carrying and possession of a
243248 weapon on private school property or in a ny school bus or vehi cle
244249 used by a private school . Except for acts of gross negligence or
245250 willful or wanton misconduct, a governing entity of a private school
246251 that adopts a policy which authorizes the possession of a weapon on
247252 private school property, a s chool bus or vehicle used by the private
248253 school shall not be subject to liability for any injuries arising
249254 from the adoption of the policy . The provisions of this subsection
250255 shall not apply to claims pursuant to the Administrative Workers '
251256 Compensation Act.
252257 D. Notwithstanding paragraph 3 of subsection A of this sect ion,
253258 a board of education of a school district may adopt a policy
254259 pursuant to Section 5 -149.2 of Title 70 of the Oklahoma Statutes to
255260 authorize the carrying of a handgun onto school property b y school
256261 personnel specifically designated by the board of educa tion,
257262 provided such personnel either:
258263 1. Possess a valid armed security guard license as provided for
259264 in Section 1750.1 et seq. of Title 59 of the Oklah oma Statutes; or
260265 2. Hold a valid reserve peace officer certi fication as provided
261266 for in Section 3311 o f Title 70 of the Oklahoma Statutes.

288294 Nothing in this subsection shall be construed to restrict authority
289295 granted elsewhere in law to carry firearms.
290296 E. Notwithstanding the provisions of s ubsection A of this
291297 section, on any property designated by statute, ordinance,
292298 resolution, policy, or use by a municipality as a municipal zoo or
293299 park, of any size that is owned, leased, operated or managed by:
294300 1. A public trust created pursuant to the provisions of Section
295301 176 of Title 60 of the Oklahoma Statutes; or
296302 2. A nonprofit entity,
297303 an individual shall be allowed to carry a concealed handgun but not
298304 openly carry a handgun on the property ; provided, however, an
299305 individual may openly carry a handgun or other firearm on the
300306 property with permission from the public tr ust or nonprofit entity .
301307 F. Any person violating the provisions of paragraph 2 or 3 of
302308 subsection A of this section s hall, upon conviction, be guilt y of a
303309 misdemeanor punishable by a fine not to exceed Two Hundred Fifty
304310 Dollars ($250.00). A person violating any other provision of
305311 subsection A of this section may be denied entrance onto the
306312 property or removed from the p roperty. If the person refuses to
307313 leave the property and a peace officer is summoned, the perso n may
308314 be issued a citation for an amount n ot to exceed Two Hundred Fifty
309315 Dollars ($250.00).
310316 G. No person in possession of a valid handgun license issued
311317 pursuant to the provisions of the Ok lahoma Self-Defense Act or who

338345 is carrying or in possession of a f irearm as otherwise permitted by
339346 law or who is carrying or in possession of a machete, blackjack,
340347 loaded cane, hand chain or metal knuckles shall be authorized to
341348 carry the firearm, machete, blackjack, loaded cane, hand chain or
342349 metal knuckles into or upon any college, university or technology
343350 center school property, except as provided in this subsection . For
344351 purposes of this subsection, the following property s hall not be
345352 construed to be college, university or technology center school
346353 property:
347354 1. Any property set aside for the use or parking of any motor
348355 vehicle, whether attended or unattended, provided the firearm,
349356 machete, blackjack, loaded cane, hand chain or metal knuckles are
350357 carried or stored as required by law and the firearm, machete,
351358 blackjack, loaded cane, hand chain or metal knuckles are not removed
352359 from the motor vehicle without the prior consent of the college or
353360 university president or technology center school administrator w hile
354361 the vehicle is on any college, university or technology center
355362 school property;
356363 2. Any property authori zed for possession or use of firearms,
357364 machetes, blackjacks, loaded canes, hand chains or metal knuckles by
358365 college, university or technology cent er school policy; and
359366 3. Any property authorized by the written con sent of the
360367 college or university presiden t or technology center school
361368 administrator, provided the written consent is carried with the

388396 firearm, machete, blackj ack, loaded cane, hand chai n or metal
389397 knuckles and the valid handgun license while on college, u niversity
390398 or technology center school prop erty.
391399 The college, university or technology center school may notify
392400 the Oklahoma State Bureau of Investigation within ten (10) days of a
393401 violation of any provision of this subsection by a licensee . Upon
394402 receipt of a written notification of violation, the Bureau shall
395403 give a reasonable notice to the licensee and hold a hearing . At the
396404 hearing, upon a determination that the licensee has violated any
397405 provision of this subsection, the licensee may be subject to an
398406 administrative fine of Two Hundred Fifty Dol lars ($250.00) and may
399407 have the handgun license suspended for three (3) months.
400408 Nothing contained in any provision of this subsection shall be
401409 construed to authorize or allow any college, university or
402410 technology center school to establish any policy or ru le that has
403411 the effect of prohibiting any person in lawful possession of a
404412 handgun license or any person in lawful pos session of a firearm,
405413 machete, blackjack, loaded cane, hand chain or metal knuckles from
406414 possession of a firearm, machete, blackjack, load ed cane, hand chain
407415 or metal knuckles in places described in paragraphs 1, 2 and 3 of
408416 this subsection. Nothing contained in any provision of t his
409417 subsection shall be construed to limit the authority of any college ,
410418 university or technology center school i n this state from taking

437446 administrative action against any student for any violation of any
438447 provision of this subsecti on.
439448 H. The provisions of this section shall not apply to the
440449 following:
441450 1. Any peace officer or any person authorized by law to carry a
442451 firearm in the course of employment;
443452 2. District judges, associate district judges and special
444453 district judges, who a re in possession of a valid handgun license
445454 issued pursuant to the provisions of the Oklahoma Se lf-Defense Act
446455 and whose names appear on a list maintained by the Administrative
447456 Director of the Courts, when acting in the course and scope of
448457 employment within the courthouses of t his state;
449458 3. Private investigators with a firearms authorization when
450459 acting in the course and scope of employment ;
451460 4. Elected officials of a county, who are in possession of a
452461 valid handgun license issued pursuant to the provision s of the
453462 Oklahoma Self-Defense Act, may carry a concealed handgun when acting
454463 in the performance of his or her duties within the courthous es of
455464 the county in which he or she was elected . The provisions of this
456465 paragraph shall not allow the elected county official to carry th e
457466 handgun into a courtroom;
458467 5. The sheriff of any county may authorize cert ain employees of
459468 the county, who possess a valid handgun license issued pursuant to
460469 the provisions of the Oklahoma Self -Defense Act, to carry a

487497 concealed handgun when acting in the course and scope of employment
488498 within the courthouse in the county in which the person is employed .
489499 Nothing in the Oklahoma Self-Defense Act shall prohibit the sheriff
490500 from requiring additional instruction or training befor e granting
491501 authorization to carry a concealed handgun within the courthouse .
492502 The provisions of this paragr aph and of paragraph 6 of this
493503 subsection shall not allow the county employee to carry the handgun
494504 into a courtroom, sheriff 's office, adult or juvenile jail or any
495505 other prisoner detention area; and
496506 6. The board of county commissioners of any county may
497507 authorize certain employees of the county, who possess a valid
498508 handgun license issued pursuant to the provisions of the Oklahoma
499509 Self-Defense Act, to carry a co ncealed handgun when acting in the
500510 course and scope of employment on county annex facilities or grounds
501511 surrounding the county courthouse.
502512 I. For the purposes of this section, "motor vehicle" means any
503513 automobile, truck, minivan, sports utility vehicle , or motorcycle,
504514 as defined in Section 1 -135 of Title 47 of the Oklahoma Statutes,
505515 equipped with a locked accessory container within or affix ed to the
506516 motorcycle.
507517 SECTION 2. This act shall become effective November 1, 2023.
