4040 An Act relating to crimes and punishments; amending
4141 21 O.S. 2021, Section 1321.4, which relates to the
4242 Oklahoma Riot Control and Prevention Act; removing
4343 ability of Governor to restrict c ertain activities
4444 during state of emergency; and providing an effective

5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1321.4, is
5454 amended to read as follows:
5555 Section 1321.4 A. The Governor during the existence of a state
5656 of emergency, by proclamation, may, in the area described by the
5757 proclamation, which proclamation shall not cover any part or portion
5858 of the state not affected by public disorder, disaster, or riot at
5959 the time the proclamation is issued, prohibit:
6060 1. Any person being on the public streets , or in the public
6161 parks or at any other public place during the hours declared by the
6262 Governor to be a period of curfew;

8989 2. A designated number of persons, as designated by the
9090 Governor, from assembling or gathering on the public streets, parks,
9191 or other open areas of this state, either public or private;
9292 3. The manufacture, transfer, use, possession or transportation
9393 of a Molotov cocktail or any other devic e, instrument or object
9494 designed to explode or produce uncontained combustion;
9595 4. 3. The transporting, possessing or using of gasoline,
9696 kerosene, or combustible, flammable, or explosive liquids or
9797 materials in a glass or uncapped container of any kind exc ept in
9898 connection with the normal operation of motor vehicles, normal home
9999 use or legitimate commercial use; and
100100 5. The sale, purchase or dispensing of alcoholic beverages;
101101 6. The sale, purchase or dispensing of other commodities or
102102 goods, as the Governo r reasonably believes should be prohibited to
103103 help preserve and maintain life, health, property or the public
104104 peace;
105105 7. 4. The use of certain streets, highways or public ways by
106106 the public; and
107107 8. Such other activities as the Governor reasonably believes
108108 should be prohibited to help preserve and maintain life, health,
109109 property or the public peace .
110110 B. Notwithstanding this section or any other law of this state,
111111 neither the Governor nor any official of a municipal or state entity
112112 shall prohibit or suspend the sale, ownership, possession,

139139 transportation, carrying, transfer and storage of firearms,
140140 ammunition and ammunition accessories during a declared state of
141141 emergency, that are otherwis e legal under state law.
142142 C. In imposing the restrictions provided for by the Oklahoma
143143 Riot Control and Prevention Act, the Governor may impose them for
144144 such times, upon such conditions, with such exceptions and in such
145145 areas of this state the Governor fro m time to time deems necessary.
146146 D. Any individual aggrieved by a viol ation of subsection B of
147147 this section may seek relief in an action at law or in equity for
148148 redress against any person who subjects such individual or causes
149149 such individual to be subject ed to an action prohibited by
150150 subsection B of this section. In additi on to any other remedy at
151151 law or in equity, an individual aggrieved by the seizure or
152152 confiscation of a firearm or ammunition in violation of subsection B
153153 of this section may bring an ac tion for the return of such firearm
154154 or ammunition in the district cour t of the county in which that
155155 individual resides or in which such firearm or ammunition is
156156 located. In any action or proceeding to enforce the provisions of
157157 this section, the court shal l award the prevailing plaintiff costs
158158 and reasonable attorney fees.
159159 SECTION 2. This act shall become effective November 1, 2023.
