5454 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5555 SECTION 1. AMENDATORY 70 O.S. 2021, Section 18 -109.5, is
5656 amended to read as follows:
5757 Section 18-109.5 A. As used in Section 18 -201.1 of this title:
5858 1. "Visual impairment" means an impairment in vision that, even
5959 with correction, adversely affects a child 's educational
6060 performance. This includes both partial sight and blindne ss;
6161 2. "Specific learning disability " means a disorder in one or
6262 more of the basic psy chological processes involved in understanding
6363 or in using language, spoken or written, that may manifest itself in
6464 the imperfect ability to listen, think, speak, read, write, spell or

9393 dyslexia and developmental aphasia. The term does not include
9494 learning problems that are primarily the result o f visual, hearing
9595 or motor disabilities, of intellectual disability, of emotional
9696 disturbance or of environmental, c ultural or economic disadvantage;
9797 3. "Deafness" means a hearing impairment that is so severe that
9898 the child is impaired in processing lingu istic information through
9999 hearing, with or without amplification, that adversely affect s a
100100 child's educational performance;
101101 4. "Economically disadvantaged " means all children who qualify
102102 for free or reduced lunches;
103103 5. "Intellectual disability " means significantly subaverage
104104 general intellectual functioning, existing concurrently with
105105 deficits in adaptive behavior and manifested during the development
106106 period, that adversely affects a child 's educational performance;
107107 6. "Emotional disturbance " means a condition exhibiting one or
108108 more of the following characteristics over a long period of ti me and
109109 to a marked degree tha t adversely affects a child 's educational
110110 performance:
111111 a. an inability to learn which cannot be explained by
112112 intellectual, sensory or health factors,
113113 b. an inability to build or maintain satisfactory
114114 interpersonal relationships with peers and teachers,

147147 The term includes children who are schizophrenic. The term does not
148148 include children who are socially maladjusted, unless it is
149149 determined that they are seriously em otionally disturbed;
150150 7. "Gifted" means identified students as outlined in Section
151151 1210.301 of this title;
152152 8. "Hearing impairment" means an impairment in hearing, whether
153153 permanent or fluctuating, that adversely affects a child 's
154154 educational performance b ut that is not included under the
155155 definition of "deafness";
156156 9. "Multiple disabilities " means concomitant impairment s, such
157157 as intellectual disability – blindness or intellectual disability –
158158 orthopedic impairment, the combination of which causes such seve re
159159 educational needs that they cannot be accommodated in special
160160 education programs sol ely for one of the impairment s. The term does
161161 not include deaf-blindness;
162162 10. "Orthopedic impairment " means a severe orthopedic
163163 impairment that adversely affects a chi ld's educational performance.
164164 The term includes impairments caused by a congenital ano maly,

191191 impairments caused by d isease such as poliomyelitis and bone
192192 tuberculosis, and impairments from other causes such as cerebral
193193 palsy, amputations and fractures or b urns that cause contractures;
194194 11. "Other health impairment " means having limited stren gth,
195195 vitality or alertness, i ncluding a heightened alertness to
196196 environmental stimuli, that results in limited alertness with
197197 respect to the educational environment that adversely affects a
198198 child's educational performance and is due to chronic or acute
199199 health problems such as asthma, attention deficit disorder or
200200 attention deficit hyperactivity disorder, diabetes, epilepsy, a
201201 heart condition, hemophilia, lead poisoning, l eukemia, nephritis,
202202 rheumatic fever, sickle cell anemia and Tourette syndrome;
203203 12. "Speech or language impairment " means a communication
204204 disorder, such as stuttering, impaired articulation, a language
205205 impairment, or a voice impairment, that adversely affe cts a child's
206206 educational performance;
207207 13. "Deaf-blindness" means concomitant hearing and visual
208208 impairments, the combination of which causes such severe
209209 communication and other developmental and educational problems that
210210 they cannot be accommodated in sp ecial education programs solely for
211211 children with deafness or children with blindness;
212212 14. "Autism" means a developmental disability significantly
213213 affecting verbal and nonverbal communication and social interaction,
214214 generally evident before age three (3), that adversely affects a

242242 associated with autism are e ngagement in repetitive activities and
243243 stereotyped movements, resistance to environmental change or change
244244 in daily routines, and unusual re sponses to sensory experiences.
245245 Autism does not apply if a child 's educational perform ance is
246246 adversely affected pr imarily because the child has an emotional
247247 disturbance, as defined in this subsection;
248248 15. "Traumatic brain injury " means an acquired injur y to the
249249 brain caused by an external physical force, resulting in total or
250250 partial functional disability or psychoso cial impairment, or both,
251251 that adversely affects a child 's educational performance. Traumatic
252252 brain injury applies to open or closed head i njuries resulting in
253253 impairments in one or more areas such as cognition; language;
254254 memory; attention; reasoning; abs tract thinking; judgment; problem -
255255 solving; sensory, perceptual, and motor abilities; psychosocial
256256 behavior; physical functions; information processing; and speech.
257257 Traumatic brain injury does not apply to brain injuries that a re
258258 congenital or degenerative or to brain injuries induced by birth
259259 trauma;
260260 16. "Bilingual English language learner" means those students :
261261 a. who have limited English speaking abilities or who
262262 come from homes where English is not the dominant
263263 language as reported on the current year application

291291 (1) were not born in the United States or whose
292292 native language is a language other than English,
293293 (2) are Native American or Alaska Natives, or a
294294 native resident of the outlying areas, and who
295295 come from an environment where a language other
296296 than English has had a significant impact on the
297297 student's level of English language proficiency,
298298 or
299299 (3) are migratory, whose native lang uage is a
300300 language other than English, and who come from an
301301 environment where a language other than Eng lish
302302 is dominant, and
303303 b. whose difficulties in speaking, reading, writing , or
304304 understanding the English language may be sufficient
305305 to deny the student:
306306 (1) the ability to meet the state 's proficient level
307307 of achievement on state assessments,
308308 (2) the ability to successfully achieve in classrooms
309309 where the language of instruction is English, or
310310 (3) the opportunity to participate fully in society .
311311 Any school district receiving funds for a student who is categorized
312312 as an English language learner shall reevaluate the student annually
313313 using assessments required by federal law to confirm the stud ent

340340 continues to meet the definition of English language learner as
341341 provided in this paragraph;
342342 17. "Special Education Summer Program " means those summer
343343 school programs which school districts may provide for children who
344344 are severely or profoundly multiple -handicapped if their
345345 individualized education program states the need for a continuing
346346 educational experience to prevent loss of educational achievement or
347347 basic life skills. Any school district receiving funds for such
348348 special education summer programs shall provide services as provided
349349 in Section 13-101 of this title; and
350350 18. "Optional Extended School Year Program " means the program
351351 defined in Section 1-109.1 of this title.
352352 B. The State Board of Education is hereby authorized t o modify
353353 and redefine by rule the definitions set out in this section
354354 whenever such modification is required to receive federal assistance
355355 therefor.
356356 SECTION 2. AMENDATORY 70 O.S. 2021, Section 18 -201.1, is
357357 amended to read as follows:
358358 Section 18-201.1 A. Beginning with the 2020 -21 school year,
359359 and each school year thereafter, t he weighted membership of a school
360360 district for calculation of Fo undation Aid purposes pursuant to
361361 paragraph 1 of subsection D of Section 18 -200.1 of this title shall
362362 be the sum of the weighted pupil grade level calculation, the
363363 weighted pupil category cal culation, the weighted district

390390 calculation and the weighted teac her experience and degree
391391 calculation. The weighted membership of a school district for
392392 calculation of Salary Incentive Aid purposes pursuant to paragraph 3
393393 of subsection D of Section 18 -200.1 of this title shall be the sum
394394 of the weighted pupil grade lev el calculation, the weighted pupil
395395 category calculation, the weighted district calculation and the
396396 weighted teacher experience and degree calculation.
397397 B. Beginning with the 2022 -2023 school year, the weighted
398398 calculations provided for in subsection A of t his section shall be
399399 based on the higher weighted average daily membership of the first
400400 nine (9) weeks of the current school year or the preceding school
401401 year of a school district, unless oth erwise specified. The higher
402402 of the two (2) weighted average dai ly memberships shall be used
403403 consistently in all of the calculations; however, the weighted
404404 calculation for a statewide virtual charter school experiencing a
405405 significant decline in membership shall be based on the first nine
406406 (9) weeks of the current school year for the statewide virtual
407407 charter school. For purposes of this subsection, "significant
408408 decline in membership " means equal to or greater than a fifteen
409409 percent (15%) decrease in averag e daily membership from the
410410 preceding school year to the average daily membership of the first
411411 nine (9) weeks of the current school year . The average daily
412412 membership data used for all calculations in paragraphs 1, 2, 3 and
413413 4 of this subsection shall be t he same as used in the calculation of

441441 subsection A of this section shall be determined as follows:
442442 1. The weighted pupil grade level calculation shall be
443443 determined by taking the highest av erage daily membership and
444444 assigning weights to the pupils accord ing to grade attended as
445445 follows:

459459 calculation for a school district . Determination of the pupils
460460 eligible for the early childhood program weight shall be pursuant to
461461 the provisions of Section 1 -114 of this title. The pupils eligible
462462 for the out-of-home placement pupil weight shall be students who are
463463 not residents of the school district in which they are receiving

490490 education pursuant to the provisions of subsection D of Section 1 -
491491 113 of this title. Such weight may be claimed by the district
492492 providing educational services to such student for the days that
493493 student is enrolled in that district . If claimed, the out-of-home
494494 placement weight shall be in lieu of the pupil grade level and any
495495 pupil category weights for that student . Provided, if a student
496496 resides in a juvenile detention center that is restricted to less
497497 than twelve (12) beds, the out -of-home placement pupil weight for
498498 such students shall be calculated as follows: for a center with six
499499 (6) beds - 3.0; for a center with eight (8) beds - 2.3 and for a
500500 center with ten (10) beds - 1.80.
501501 2. The weighted pupil category calculation shall be determined
502502 by assigning a weight to the pupil category as follows:

550550 Except as otherwise provided, multiply the number of pupils approve d
551551 in the school year with the highest average daily membership in each
552552 category by the weight assigned to such category and add the totals
553553 together to determine the weighted pupil category calculation for a
554554 school district. For the 1997-98 school year and subsequent school
555555 years, the number to be multiplied by the weight assigned to the
556556 gifted category in subparagraph g of this paragraph shall be the
557557 lesser of (1) the sum of the number of students who score d in the
558558 top three percent (3%) on any national st andardized test of
559559 intellectual ability plus the number of students identified as
560560 gifted pursuant to subparagraphs a through d of paragraph 1 of
561561 Section 1210.301 of this title, or (2) the sum of the number of
562562 students who scored in the top three percent (3 %) on any national
563563 standardized test of intellectual ability plus eight percent (8%) of

591591 first nine (9) weeks of the school year.
592592 3. The weighted district calculation shall be determined by
593593 determining the calculations for each school district for both the
594594 small school district formula and the district sparsity - isolation
595595 formula, applying whichever is the greater of the calculations of
596596 the two formulas and then applying the restrictions pur suant to
597597 subparagraph c of this paragraph.
598598 a. Small school district formula : 529 minus the average
599599 daily membership divided by 529 times .2 time s total
600600 average daily membership.
601601 The small school district f ormula calculation shall app ly
602602 only to school districts whose highest average daily
603603 membership is less than 529 pupils . School districts which
604604 are consolidated or annexed after July 1, 2003, pur suant to
605605 the Oklahoma School Voluntary Consolidation and Anne xation
606606 Act shall have the we ighted district size c alculation for
607607 the three (3) school years following the fiscal year in
608608 which such consolidation occurred calculated to be the sum
609609 of the individual consolidated districts computed as if the
610610 consolidation had not taken place. Thereafter, any such
611611 district which is consolidated pursuant to the Oklahoma
612612 School Voluntary Consolidation and Annexation Act shall not
613613 qualify for the weighted district calc ulation unless the

641641 the provisions of subparagraph c of this paragraph, the
642642 resulting number shall be counted as additional students
643643 for the purpose of calculating State Aid.
644644 b. District sparsity - isolation formula:
645645 The district sparsity - isolation formula calculation shall
646646 apply only to school districts:
647647 (1) whose total area in square miles is greater than
648648 the average number of square miles for all school
649649 districts in this state; and
650650 (2) whose areal density is less than one -fourth (1/4)
651651 of the state average areal density. Areal
652652 density shall be determine d by dividing the
653653 school district's average daily membership by the
654654 school district's total area in square miles.
655655 The district sparsity - isolation formula calculation shall
656656 be calculated as follows:
657657 The school district student cost f actor multiplied by
658658 the school district area factor . The resulting
659659 product shall be multiplied by the school district 's
660660 average daily membership . Subject to the provisions
661661 of subparagraph c of this paragraph, the resulting
662662 number shall be counted as addi tional students for th e
663663 purpose of calculating State Aid.

742742 The school district area cost factor shall be calculated as
743743 follows:
744744 Subtract the state average distri ct area from the
745745 district area, then divide the remainder by the state
746746 average district area;
747747 however, the district area cost factor shall not exceed one
748748 (1.0).
749749 The State Board of Education shall define geog raphical barriers
750750 whose location in a school dist rict would inhibit the district from
751751 consolidation or annexation . The Board shall make available an
752752 application process, review applications, and for districts the
753753 Board deems necessary allow additional squ are miles to be used for
754754 the purposes of calculat ions used for the weig hted district sparsity
755755 - isolation formula. Provided, that the additional square miles
756756 allowed for geographical barriers shall not exceed thirty percent
757757 (30%) of the district 's actual size.
758758 c. State Aid funds which a district is calc ulated to
759759 receive as a result of the weighted district
760760 calculation shall be restricted as follows:
761761 If, after the weighted district calculation is
762762 applied, the district 's projected per pupil
763763 revenue exceeds one hundred fifty perc ent (150%)

791791 then the district's State Aid shall be reduced by
792792 an amount that will restrict the district 's
793793 projected per pupil revenue to one hundr ed fifty
794794 percent (150%) of the project ed state average per
795795 pupil revenue. Provided, in applying the
796796 restriction provided in this division, the
797797 district's State Aid shall not be reduced by an
798798 amount greater than by the amount of State Aid
799799 which was generated by the weighted district
800800 calculation.
801801 The July calculation of the projected per pupil
802802 revenue shall be deter mined by dividing the district 's
803803 preceding year's average daily membership (ADM) as
804804 weighted by the pupil grade level, the pupil category,
805805 the district and the teacher experience deg ree index
806806 calculations for projected State Aid into the
807807 district's projected total revenues including
808808 projected funds for the State Aid Formula for the
809809 preceding year, net assessed valuation for the
810810 preceding calendar y ear times thirty-nine (39) mills,
811811 county revenues excluding t he county four-mills
812812 revenues for the second preceding year, other state
813813 appropriations for the preceding year and the

843843 The December calculation of the projected per pupil
844844 revenue shall be determined by dividing the higher of
845845 the district's first nine (9) weeks of the current
846846 school year or the preceding school year 's average

850850 projected State Aid into the district 's projected
851851 total revenues including funds for the December
852852 calculation of the current year State Aid Formul a, net
853853 assessed valuation for the current calendar ye ar times
854854 thirty-nine (39) mills, county revenues excluding the
855855 county four-mills revenue for the preceding year,
856856 other state appropriations for the preceding year and
857857 the collections for the preceding ye ar of state
858858 apportionment, motor vehicle revenue, gro ss production
859859 tax and R.E.A. tax.
860860 The district's projected total revenues for each
861861 calculation shall exclude the following collections
862862 for the second preceding year: federal revenue,
863863 insurance loss payments, reimbursements, reco very of

893893 4. The weighted teacher experience and degree calcu lation shall
894894 be determined in acco rdance with the teacher exp erience and degree
895895 index. The State Department of Education shall determine an index
896896 for each state teacher by using data supplied in the school
897897 district's teacher personnel reports of the prece ding year and
898898 utilizing the index as follows:

913913 calculation provided in paragraph 1 of thi s subsection and the

943943 SECTION 3. This act shall beco me effective July 1, 2023.
944944 SECTION 4. It being immediately necessary for the preservation
945945 of the public peace, health or safety, an emergency is hereby
946946 declared to exist, by reason whereof thi s act shall take effect and
947947 be in full force from and after its passage and approval.
