29	57		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

31	58		SECTION 1. AMENDATORY 26 O.S. 2021, Section 7-139, as
32	59		amended by Section 1, Chapter 194, O.S.L. 2 022 (26 O.S. Supp. 2022,
33	60		Section 7-139), is amended to read as follows:
34		-
35	61		Section 7-139. A. This act shall be known and may be cited as
36	62		the "Prohibit the Private Funding of Elections Act".

38	63		B. As used in this section:

40	64		1. "Person" means any individual, proprietorship, firm,
41	65		partnership, joint venture, syndicate, labor u nion, business trust,
42	66		company, association, committee, corporation, whether or not

43	94		operated for profit, or any other organization or group of persons
44	95		acting in concert, or any othe r nongovernmental third-party entity;

47	97		2. "Public funds" means funds derived from taxes, fees,
48	98		including candidate filing fees, and other sources of public revenue
49	99		lawfully appropriated o r expended by Congress, the Legislature, or
50	100		any other governmental entity, or funds from an entity that is
51	101		authorized to pay for an election pursuant to state law.

53	102		C. 1. All costs and expenses of conducting and administrating
54	103		elections shall be paid for with public funds ; provided nothing in
55	104		this section shall apply to fra nchise elections described in
56	105		Sections 5(a) and 5(b) of Article XVIII of the Oklahoma
57	106		Constitution.

59	107		2. No government official or election official shall solicit,
60	108		take, or otherwise accept from any pe rson, any contribution,
61	109		donation, or anything else of value for purposes of conducting or
62	110		administrating any election pursuant to the provisions of Title 26
63	111		of the Oklahoma Statutes; provided, donations this title.

65	112		3. No person shall offer or provide any contribution, donation,
66	113		or anything else of value for purposes of conducting or
67	114		administrating any election pursuant to the provisions of this
68	115		title.

70	116		D. 1. For the purposes of this section, the following shall
71	117		not be considered a contribution, donation, or thing of value:

74	146		or in-person absentee voting site at no charge or at a
75	147		below-market cost,

77	148		b. persons who volunteer their labor as precinct
78	149		officials, absentee voting board members, or as
79	150		election workers,

81	151		c. persons who volunteer their labor to assist the county
82	152		election board or the State Election Board during
83	153		candidate filing, on Election Day, during in-person
84	154		absentee voting, or at other times ,

86	155		d. food or beverage items of nominal value provided to
87	156		precinct officials, abse ntee voting board members, or
88	157		election officials,

90	158		e. items of nominal value including, but not limited to,
91		-	pens, sanitizer and clean ing supplies, or ENR. H. B. NO. 2682 Page 3

	159	+	pens, sanitizer and cleaning supplies, or
93	160		f. airing or publication of public service announcements
94	161		or press releases issued by the State Election Boa rd
95	162		or a county election board.

97	163		2. Donations not directly related to the administration of
98	164		elections, may be accepted by the Secretary of the State Election
99	165		Board or secretary of the county election board only upon written
100	166		approval by the Governor and written notification sent to the
101	167		Speaker of the Oklahoma House of Representatives and President Pro
102	168		Tempore of the Oklahoma State Senate.

106	197		E. A willful and intentional violation of the this act shal l be
107	198		punishable as follows:
108		-
109	199		1. A first violation of this act shall constitute a misdemeanor
110	200		and, upon conviction, be punishable by a fine not to exceed Five
111	201		Thousand Dollars ($5,000.00).
112		-
113	202		2. A second violation of this act shall constitute a
114	203		misdemeanor and, upon conviction, be punishable by a fine not to
115	204		exceed Ten Thousand Dollars ($10,000.00).

117	205		3. A third or any subsequent violation of this act shall
118	206		constitute a felony and, upon conviction, be punishable by a fine
119	207		not to exceed Fifty Thousand Dollars ($50,000.00), or by
120	208		imprisonment in the custody of the Department of Corrections for a
121	209		term of not less than two (2) years nor more than five (5) years, or
122	210		by both such fine and imprisonment.

124	211		SECTION 2. This act shall become effective November 1, 2023.
