1545 An Act relating to elections; amending 26 O.S. 2021,

1848 which relates to the Prohibit the Private Funding of
1949 Elections Act; prohibiting the contribution,

2957 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3158 SECTION 1. AMENDATORY 26 O.S. 2021, Section 7-139, as
3259 amended by Section 1, Chapter 194, O.S.L. 2 022 (26 O.S. Supp. 2022,
3360 Section 7-139), is amended to read as follows:

3561 Section 7-139. A. This act shall be known and may be cited as
3662 the "Prohibit the Private Funding of Elections Act".

3863 B. As used in this section:

4064 1. "Person" means any individual, proprietorship, firm,
4165 partnership, joint venture, syndicate, labor u nion, business trust,
4266 company, association, committee, corporation, whether or not

4394 operated for profit, or any other organization or group of persons
4495 acting in concert, or any othe r nongovernmental third-party entity;

4797 2. "Public funds" means funds derived from taxes, fees,
4898 including candidate filing fees, and other sources of public revenue
4999 lawfully appropriated o r expended by Congress, the Legislature, or
50100 any other governmental entity, or funds from an entity that is
51101 authorized to pay for an election pursuant to state law.

53102 C. 1. All costs and expenses of conducting and administrating
54103 elections shall be paid for with public funds ; provided nothing in
55104 this section shall apply to fra nchise elections described in
56105 Sections 5(a) and 5(b) of Article XVIII of the Oklahoma
57106 Constitution.

59107 2. No government official or election official shall solicit,
60108 take, or otherwise accept from any pe rson, any contribution,
61109 donation, or anything else of value for purposes of conducting or
62110 administrating any election pursuant to the provisions of Title 26
63111 of the Oklahoma Statutes; provided, donations this title.

65112 3. No person shall offer or provide any contribution, donation,
66113 or anything else of value for purposes of conducting or
67114 administrating any election pursuant to the provisions of this
68115 title.

70116 D. 1. For the purposes of this section, the following shall
71117 not be considered a contribution, donation, or thing of value:

74146 or in-person absentee voting site at no charge or at a

77148 b. persons who volunteer their labor as precinct
78149 officials, absentee voting board members, or as

81151 c. persons who volunteer their labor to assist the county
82152 election board or the State Election Board during
83153 candidate filing, on Election Day, during in-person
84154 absentee voting, or at other times ,

86155 d. food or beverage items of nominal value provided to
87156 precinct officials, abse ntee voting board members, or
88157 election officials,

90158 e. items of nominal value including, but not limited to,
91-pens, sanitizer and clean ing supplies, or ENR. H. B. NO. 2682 Page 3

159+pens, sanitizer and cleaning supplies, or
93160 f. airing or publication of public service announcements
94161 or press releases issued by the State Election Boa rd
95162 or a county election board.

97163 2. Donations not directly related to the administration of
98164 elections, may be accepted by the Secretary of the State Election
99165 Board or secretary of the county election board only upon written
100166 approval by the Governor and written notification sent to the
101167 Speaker of the Oklahoma House of Representatives and President Pro
102168 Tempore of the Oklahoma State Senate.

106197 E. A willful and intentional violation of the this act shal l be
107198 punishable as follows:

109199 1. A first violation of this act shall constitute a misdemeanor
110200 and, upon conviction, be punishable by a fine not to exceed Five
111201 Thousand Dollars ($5,000.00).

113202 2. A second violation of this act shall constitute a
114203 misdemeanor and, upon conviction, be punishable by a fine not to
115204 exceed Ten Thousand Dollars ($10,000.00).

117205 3. A third or any subsequent violation of this act shall
118206 constitute a felony and, upon conviction, be punishable by a fine
119207 not to exceed Fifty Thousand Dollars ($50,000.00), or by
120208 imprisonment in the custody of the Department of Corrections for a
121209 term of not less than two (2) years nor more than five (5) years, or
122210 by both such fine and imprisonment.

124211 SECTION 2. This act shall become effective November 1, 2023.
