5454 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5555 SECTION 1. AMENDATORY 56 O.S. 2021, Section 604, is
5656 amended to read as follows:
5757 Section 604. The Director of the Department of Human Services
5858 shall, within the constraints of funding appropriated to the
5959 Department, maintain a Family Support Program for children with
6060 severe developmental disabilities who reside in their family homes
6161 in accordance with the following criteria:
6262 1. The family member resides with the family;
6363 2. The family resides in the State of Oklahoma;

9090 3. The gross adjusted income of the family for the year
9191 immediately preceding the date of application for the assistance did
9292 not exceed Forty-five Thousand Dollars ($45,000.00) Sixty-five
9393 Thousand Dollars ($6 5,000.00);
9494 4. The family is headed by a biological parent, adoptive
9595 parent, or legal guardian of the eligi ble family member; provided,
9696 however, that if the eligi ble family member lives with an adoptive
9797 parent or parents who already receive adoption subsidy from any
9898 source on behalf of the applicant, the family cannot receive family
9999 support assistance authorize d by this section; and
100100 5. The family or family member does not receive Medicaid Home
101101 and Community-based Waiver Services.
102102 SECTION 2. AMENDATORY 56 O.S. 2021, Section 606, is
103103 amended to read as follows:
104104 Section 606. If an application for family support assistance
105105 pursuant to the Oklahoma Family Suppor t Act is approved by the
106106 Department of Human Services and Developmental Disabilities Services
107107 Division:
108108 1. A family support assistance pa yment shall be paid to the
109109 parent or legal guardian on behalf of a family member and shall be
110110 considered a benefit to the family member;
111111 2. The family support assistance payment shall be used to meet
112112 the special needs of the family associated with the fam ily member.
113113 Except as otherwise provided in the Oklahoma Family Support Act,

140140 this assistance payment is intended to c omplement, not to supplant,
141141 public assistance or other social service benefits based on economic
142142 need, available through governmental prog rams;
143143 3. The amount of the family support assistance payment shall be
144144 a maximum of Four Hundred Dollars ($400.00) Eight Hundred Forty-nine
145145 Dollars and Sixty-Four Cents ($849.64) per month. Increases to this
146146 amount shall be determined annually by legislative appropriation.
147147 In addition, the paren t or legal guardian of a family member who is
148148 in an out-of-home placement at the time of application may receive a
149149 one-time, lump-sum advance payment of twice the monthly family
150150 support assistance amount for the purpose of meeting the special
151151 needs of the family to prepare for the placement or return of the
152152 family member to in-home care.
153153 The amount of the family support assistanc e payment for the
154154 first eligible child shall be Five Hundred Twenty -seven Dollars and
155155 Seventy-Five Cents ($527.75).
156156 4. The parent or legal guardian who receives a family support
157157 assistance payment shall re port, in writing, at least the following
158158 information to the Department:
159159 a. not less than annually, a sta tement and any supporting
160160 documentation requested by the Department that the
161161 family support assistance payment was used to meet the
162162 special needs of the family,

189189 b. immediately, if the parent or legal guardian requests
190190 termination of the family support assi stance,
191191 c. immediately, upon the occurrence of any event listed
192192 in Section 7 607 of this act title.
193193 SECTION 3. This act shall become ef fective November 1, 2023.
