40	40	An Act relating to poor persons; amending 56 O.S.
41	41	2021, Sections 604 and 606, which relate to the
42	42	Family Support Program ; modifying eligibility
43	43	requirements; modifying maximum payment amount;
44	44	providing payment amount for first eligible child;

54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. AMENDATORY 56 O.S. 2021, Section 604, is
56	56	amended to read as follows:
57	57	Section 604. The Director of the Department of Human Services
58	58	shall, within the constraints of funding appropriated to the
59	59	Department, maintain a Family Support Program for children with
60	60	severe developmental disabilities who reside in their family homes
61	61	in accordance with the following criteria:
62	62	1. The family member resides with the family;
63	63	2. The family resides in the State of Oklahoma;

90	90	3. The gross adjusted income of the family for the year
91	91	immediately preceding the date of application for the assistance did
92	92	not exceed Forty-five Thousand Dollars ($45,000.00) Sixty-five
93	93	Thousand Dollars ($6 5,000.00);
94	94	4. The family is headed by a biological parent, adoptive
95	95	parent, or legal guardian of the eligi ble family member; provided,
96	96	however, that if the eligi ble family member lives with an adoptive
97	97	parent or parents who already receive adoption subsidy from any
98	98	source on behalf of the applicant, the family cannot receive family
99	99	support assistance authorize d by this section; and
100	100	5. The family or family member does not receive Medicaid Home
101	101	and Community-based Waiver Services.
102	102	SECTION 2. AMENDATORY 56 O.S. 2021, Section 606, is
103	103	amended to read as follows:
104	104	Section 606. If an application for family support assistance
105	105	pursuant to the Oklahoma Family Suppor t Act is approved by the
106	106	Department of Human Services and Developmental Disabilities Services
107	107	Division:
108	108	1. A family support assistance pa yment shall be paid to the
109	109	parent or legal guardian on behalf of a family member and shall be
110	110	considered a benefit to the family member;
111	111	2. The family support assistance payment shall be used to meet
112	112	the special needs of the family associated with the fam ily member.
113	113	Except as otherwise provided in the Oklahoma Family Support Act,

140	140	this assistance payment is intended to c omplement, not to supplant,
141	141	public assistance or other social service benefits based on economic
142	142	need, available through governmental prog rams;
143	143	3. The amount of the family support assistance payment shall be
144	144	a maximum of Four Hundred Dollars ($400.00) Eight Hundred Forty-nine
145	145	Dollars and Sixty-Four Cents ($849.64) per month. Increases to this
146	146	amount shall be determined annually by legislative appropriation.
147	147	In addition, the paren t or legal guardian of a family member who is
148	148	in an out-of-home placement at the time of application may receive a
149	149	one-time, lump-sum advance payment of twice the monthly family
150	150	support assistance amount for the purpose of meeting the special
151	151	needs of the family to prepare for the placement or return of the
152	152	family member to in-home care.
153	153	The amount of the family support assistanc e payment for the
154	154	first eligible child shall be Five Hundred Twenty -seven Dollars and
155	155	Seventy-Five Cents ($527.75).
156	156	4. The parent or legal guardian who receives a family support
157	157	assistance payment shall re port, in writing, at least the following
158	158	information to the Department:
159	159	a. not less than annually, a sta tement and any supporting
160	160	documentation requested by the Department that the
161	161	family support assistance payment was used to meet the
162	162	special needs of the family,

190	190	termination of the family support assi stance,
191	191	c. immediately, upon the occurrence of any event listed
192	192	in Section 7 607 of this act title.
193	193	SECTION 3. This act shall become ef fective November 1, 2023.
