4040 An Act relating to crimes and punishments; amending
4141 21 O.S. 2021, Sections 1040.75 and 1040.76, which
4242 relate to the display of material s harmful to minors;
4343 adding definition; making certain acts unlawful; and
4444 providing an effective date.

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1040.75, is
5252 amended to read as follows:
5353 Section 1040.75 As used in Sections 1040.75 through 1040 .77 of
5454 this title:
5555 1. "Minor" means any unmarried person under the age of eighteen
5656 (18) years;
5757 2. "Harmful to minors" means:
5858 a. that quality of any description, exhibition,
5959 presentation or representation, in whatever form, of
6060 nudity, sexual conduct, sexu al excitement, or
6161 sadomasochistic abuse when the material or

8888 performance, taken as a whole, has the following
8989 characteristics:
9090 (1) the average person eighteen (18) years of age or
9191 older applying contemporary community standards
9292 would find that the material or performance has a
9393 predominant tendency to appeal to a prurient
9494 interest in sex to minors, and
9595 (2) the average person eighteen (18) years of age or
9696 older applying contemporary c ommunity standards
9797 would find that the material or performance
9898 depicts or describes nudity, sexual conduct,
9999 sexual excitement or sadomasochistic abuse in a
100100 manner that is patently offensive to prevailing
101101 standards in the adult community with respect to
102102 what is suitable for minors, and
103103 (3) the material or performance lacks serious
104104 literary, scientific, medical, artistic, or
105105 political value for minors , or
106106 b. any description, exhibition, presentation or
107107 representation, in whatever form, of inappropriate
108108 violence;
109109 3. "Inappropriate violence " means any description or
110110 representation, in an interactive video game or computer software,

137137 of violence which, taken as a whole, has the following
138138 characteristics:
139139 a. the average person eighteen (18) years of age or older
140140 applying contemporary community standards would find
141141 that the interactive vid eo game or computer software
142142 is patently offensive to prevailing standards in the
143143 adult community with respect to what is suitable for
144144 minors, and
145145 b. the interactive video game or computer software lacks
146146 serious literary, scientific, medical, artistic, or
147147 political value for minors based on, but not limited
148148 to, the following criteria:
149149 (1) is glamorized or gratuitous,
150150 (2) is graphic violence used to shock or stimulate,
151151 (3) is graphic violence that is not contextually
152152 relevant to the material,
153153 (4) is so pervasive that it serves as the thread
154154 holding the plot of the material together,
155155 (5) trivializes the serious nature of realistic
156156 violence,
157157 (6) does not demonstrate the consequences or effects
158158 of realistic violence,
159159 (7) uses brutal weapons designed to inflict t he
160160 maximum amount of pain and damage,

187187 (8) endorses or glorifies torture or excessive
188188 weaponry, or
189189 (9) depicts lead characters who resort to violence
190190 freely;
191191 4. "Nudity" means the:
192192 a. showing of the human male or female genitals, pubic
193193 area, or buttocks with less than a full opaque
194194 covering,
195195 b. showing of the female breast with less than a full
196196 opaque covering of any portion of the female breast
197197 below the top of the nipple, or
198198 c. depiction of covered male genitals in a discernibly
199199 turgid state;
200200 5. "Sexual conduct" means acts of masturbation, homosexuality,
201201 sexual intercourse, or physical contact with a person 's clothed or
202202 unclothed genitals, pubic area, buttocks, or, if such person be a
203203 female, breast;
204204 6. "Sexual excitement" means the condition of human m ale or
205205 female genitals when in a state of sexual stimulation or arousal;
206206 7. "Sadomasochistic abuse " means flagellation or torture by or
207207 upon a person clothed or naked or the condit ion of being fettered,
208208 bound or otherwise physically restrained on the part of one so
209209 clothed or naked;

236236 8. "Material" means any book, magazine, newspaper, pamphlet,
237237 poster, print, picture, figure, image, description, motion picture
238238 film, record, recording tape, CD-ROM disk, Magnetic Disk Memory,
239239 Magnetic Tape Memory, video tape, computer software or video game;
240240 9. "CD-ROM" means a compact disk with read only memory which
241241 has the capacity to store audio, video and written materials and may
242242 be used by computer to play or display materials harmful to minors;
243243 10. "Magnetic Disk Memory" means a memory system that stores
244244 and retrieves binary data on record -like metal or plastic disks
245245 coated with a magnetic material, including but not limited to floppy
246246 diskettes;
247247 11. "Magnetic Tape Memory " means a memory system that stores
248248 and retrieves binary data on magnetic recording tape;
249249 12. "Performance" means any motion picture, film, video tape,
250250 played record, phonograph or tape, preview, trailer, play, show,
251251 skit, dance, or other exhibition performed or presented to or before
252252 an audience of one or more, with or without consideration;
253253 13. "Drag performance" means a performance in which a performer
254254 exhibits a gender identity that is different from the gender
255255 assigned to the performer at birth using clothing, makeup, or other
256256 physical markers and sings, lip syncs, dances, or otherwise performs
257257 before an audience for entertainment ;

284284 14. "Knowingly" means having general knowledge of, or reason to
285285 know, or a belief or ground for belief which warrants further
286286 inspection or inquiry of both:
287287 a. the character and content of any material or
288288 performance which is reasonably susceptible of
289289 examination by the defendant, and
290290 b. the age of the minor. However, an honest mistake,
291291 shall constitute an excuse from liability pursuant to
292292 this act if the defendant mad e a reasonable bona fide
293293 attempt to ascertain the true age of such minor;
294294 14. 15. "Person" means any individual, partnership,
295295 association, corporation, or other legal entity of any kind; and
296296 15. 16. "A reasonable bona fide attempt " means an attempt to
297297 ascertain the true age of the minor by requiring production of a
298298 driver license, marriage license, birth certificate or other
299299 governmental or educational identification card or paper and not
300300 relying solely on the oral allegations or apparent a ge of the minor.
301301 SECTION 2. AMENDATORY 21 O.S. 2021, Section 1040.76, is
302302 amended to read as follows:
303303 Section 1040.76. A. No person, including but not limited to
304304 any persons having custody, control or supervision of any commercial
305305 establishment, shall knowingly:
306306 1. Display material which is harmful to minors in such a way
307307 that minors, as a part of the invited general public, will be

334334 exposed to view such material. Provid ed, however, a person shall be
335335 deemed not to have "displayed" material harmful to m inors if the
336336 material is kept behind devices comm only known as "blinder racks" so
337337 that the lower two-thirds (2/3) of the material is not exposed to
338338 view;
339339 2. Sell, furnish, present, distribute, allow to view, or
340340 otherwise disseminate to a minor, with or wi thout consideration, any
341341 material which is harmfu l to minors; or
342342 3. Present to a minor or participate in presenting to a minor,
343343 with or without consideration, any performan ce which is harmful to a
344344 minor.
345345 B. No person including, but not limited to, any person having
346346 custody, control or supervision of a commercial establishment or
347347 having custody, control or supervisions of any public property,
348348 shall knowingly present to a minor or participate in presenting to a
349349 minor, with or without consideration, any dra g performance.
350350 SECTION 3. This act shall become effective November 1, 2023.
