50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. AMENDATORY 21 O.S. 2021, Section 1040.75, is
52	52	amended to read as follows:
53	53	Section 1040.75 As used in Sections 1040.75 through 1040 .77 of
54	54	this title:
55	55	1. "Minor" means any unmarried person under the age of eighteen
56	56	(18) years;
57	57	2. "Harmful to minors" means:
58	58	a. that quality of any description, exhibition,
59	59	presentation or representation, in whatever form, of
60	60	nudity, sexual conduct, sexu al excitement, or
61	61	sadomasochistic abuse when the material or

89	89	characteristics:
90	90	(1) the average person eighteen (18) years of age or
91	91	older applying contemporary community standards
92	92	would find that the material or performance has a
93	93	predominant tendency to appeal to a prurient
94	94	interest in sex to minors, and
95	95	(2) the average person eighteen (18) years of age or
96	96	older applying contemporary c ommunity standards
97	97	would find that the material or performance
98	98	depicts or describes nudity, sexual conduct,
99	99	sexual excitement or sadomasochistic abuse in a
100	100	manner that is patently offensive to prevailing
101	101	standards in the adult community with respect to
102	102	what is suitable for minors, and
103	103	(3) the material or performance lacks serious
104	104	literary, scientific, medical, artistic, or
105	105	political value for minors , or
106	106	b. any description, exhibition, presentation or
107	107	representation, in whatever form, of inappropriate
108	108	violence;
109	109	3. "Inappropriate violence " means any description or
110	110	representation, in an interactive video game or computer software,

139	139	a. the average person eighteen (18) years of age or older
140	140	applying contemporary community standards would find
141	141	that the interactive vid eo game or computer software
142	142	is patently offensive to prevailing standards in the
143	143	adult community with respect to what is suitable for
144	144	minors, and
145	145	b. the interactive video game or computer software lacks
146	146	serious literary, scientific, medical, artistic, or
147	147	political value for minors based on, but not limited
148	148	to, the following criteria:
149	149	(1) is glamorized or gratuitous,
150	150	(2) is graphic violence used to shock or stimulate,
151	151	(3) is graphic violence that is not contextually
152	152	relevant to the material,
153	153	(4) is so pervasive that it serves as the thread
154	154	holding the plot of the material together,
155	155	(5) trivializes the serious nature of realistic
156	156	violence,
157	157	(6) does not demonstrate the consequences or effects
158	158	of realistic violence,
159	159	(7) uses brutal weapons designed to inflict t he
160	160	maximum amount of pain and damage,

189	189	(9) depicts lead characters who resort to violence

191	191	4. "Nudity" means the:
192	192	a. showing of the human male or female genitals, pubic
193	193	area, or buttocks with less than a full opaque
194	194	covering,
195	195	b. showing of the female breast with less than a full
196	196	opaque covering of any portion of the female breast
197	197	below the top of the nipple, or
198	198	c. depiction of covered male genitals in a discernibly
199	199	turgid state;
200	200	5. "Sexual conduct" means acts of masturbation, homosexuality,
201	201	sexual intercourse, or physical contact with a person 's clothed or
202	202	unclothed genitals, pubic area, buttocks, or, if such person be a
203	203	female, breast;
204	204	6. "Sexual excitement" means the condition of human m ale or
205	205	female genitals when in a state of sexual stimulation or arousal;
206	206	7. "Sadomasochistic abuse " means flagellation or torture by or
207	207	upon a person clothed or naked or the condit ion of being fettered,
208	208	bound or otherwise physically restrained on the part of one so
209	209	clothed or naked;

236	236	8. "Material" means any book, magazine, newspaper, pamphlet,
237	237	poster, print, picture, figure, image, description, motion picture
238	238	film, record, recording tape, CD-ROM disk, Magnetic Disk Memory,
239	239	Magnetic Tape Memory, video tape, computer software or video game;
240	240	9. "CD-ROM" means a compact disk with read only memory which
241	241	has the capacity to store audio, video and written materials and may
242	242	be used by computer to play or display materials harmful to minors;
243	243	10. "Magnetic Disk Memory" means a memory system that stores
244	244	and retrieves binary data on record -like metal or plastic disks
245	245	coated with a magnetic material, including but not limited to floppy
246	246	diskettes;
247	247	11. "Magnetic Tape Memory " means a memory system that stores
248	248	and retrieves binary data on magnetic recording tape;
249	249	12. "Performance" means any motion picture, film, video tape,
250	250	played record, phonograph or tape, preview, trailer, play, show,
251	251	skit, dance, or other exhibition performed or presented to or before
252	252	an audience of one or more, with or without consideration;
253	253	13. "Drag performance" means a performance in which a performer
254	254	exhibits a gender identity that is different from the gender
255	255	assigned to the performer at birth using clothing, makeup, or other
256	256	physical markers and sings, lip syncs, dances, or otherwise performs
257	257	before an audience for entertainment ;

284	284	14. "Knowingly" means having general knowledge of, or reason to
285	285	know, or a belief or ground for belief which warrants further
286	286	inspection or inquiry of both:
287	287	a. the character and content of any material or
288	288	performance which is reasonably susceptible of
289	289	examination by the defendant, and
290	290	b. the age of the minor. However, an honest mistake,
291	291	shall constitute an excuse from liability pursuant to
292	292	this act if the defendant mad e a reasonable bona fide
293	293	attempt to ascertain the true age of such minor;
294	294	14. 15. "Person" means any individual, partnership,
295	295	association, corporation, or other legal entity of any kind; and
296	296	15. 16. "A reasonable bona fide attempt " means an attempt to
297	297	ascertain the true age of the minor by requiring production of a
298	298	driver license, marriage license, birth certificate or other
299	299	governmental or educational identification card or paper and not
300	300	relying solely on the oral allegations or apparent a ge of the minor.
301	301	SECTION 2. AMENDATORY 21 O.S. 2021, Section 1040.76, is
302	302	amended to read as follows:
303	303	Section 1040.76. A. No person, including but not limited to
304	304	any persons having custody, control or supervision of any commercial
305	305	establishment, shall knowingly:
306	306	1. Display material which is harmful to minors in such a way
307	307	that minors, as a part of the invited general public, will be

334	334	exposed to view such material. Provid ed, however, a person shall be
335	335	deemed not to have "displayed" material harmful to m inors if the
336	336	material is kept behind devices comm only known as "blinder racks" so
337	337	that the lower two-thirds (2/3) of the material is not exposed to
338	338	view;
339	339	2. Sell, furnish, present, distribute, allow to view, or
340	340	otherwise disseminate to a minor, with or wi thout consideration, any
341	341	material which is harmfu l to minors; or
342	342	3. Present to a minor or participate in presenting to a minor,
343	343	with or without consideration, any performan ce which is harmful to a
344	344	minor.
345	345	B. No person including, but not limited to, any person having
346	346	custody, control or supervision of a commercial establishment or
347	347	having custody, control or supervisions of any public property,
348	348	shall knowingly present to a minor or participate in presenting to a
349	349	minor, with or without consideration, any dra g performance.
350	350	SECTION 3. This act shall become effective November 1, 2023.
