3355 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3556 SECTION 1. NEW LAW A new section of law to be codified
3657 in the Oklahoma Statutes as Secti on 7320 of Title 63, unless there
3758 is created a duplication in numbering, reads as follows:

3959 For the purpose of prohibiting step the rapy requirements for
4060 certain prescription drugs to treat advanced metastatic cancer and

64105 1. Fails to successfully respond to a differe nt drug; or

66106 2. Proves a history of failure of a different dr ug.

68107 B. This section applies only to a drug, the use of which is:

70108 1. Consistent with best practices for the treatment of advanced
71109 metastatic cancer or an associated condition;

73110 2. Supported by peer-reviewed, evidence-based literature; and

75111 3. Approved by the United States Food and Drug Administration.

77112 SECTION 3. This act shall become effective November 1, 2023.
