33	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

35	56		SECTION 1. NEW LAW A new section of law to be codified
36	57		in the Oklahoma Statutes as Secti on 7320 of Title 63, unless there
37	58		is created a duplication in numbering, reads as follows:

39	59		For the purpose of prohibiting step the rapy requirements for
40	60		certain prescription drugs to treat advanced metastatic cancer and
41	61		associated conditions.

	63	+	1. "Associated conditions" means the symptoms or side effects
	64	+	associated with advanced metastatic cancer or its treatm ent and

45		-	1. "Associated conditions" means the symptoms or side effects
46		-	associated with advanced metastatic cancer or its treatm ent and ENR. H. B. NO. 2748 Page 2
47	92		which, in the judgment of the health care practitioner, will further
48		-	jeopardize the health of a patient if left untreated; and

50	94		2. "Advanced metastatic cancer" means cancer that has spre ad
51	95		from the primary or original site of the cancer to nearby tissu es,
52	96		lymph nodes, or other areas or parts of the body.

54	97		SECTION 2. NEW LAW A new section of law to be co dified
55	98		in the Oklahoma Statutes as Section 7321 of Title 63, unless there
56	99		is created a duplication in numbering, reads as follows:

58	100		A. A health benefit plan that provides coverage for advanced
59	101		metastatic cancer and associated conditions may not require, be fore
60	102		the health benefit plan provides coverage of a prescriptio n drug
61	103		approved by the United States Food and Drug Administration, that the
62	104		enrollee:

64	105		1. Fails to successfully respond to a differe nt drug; or
65		-
66	106		2. Proves a history of failure of a different dr ug.

68	107		B. This section applies only to a drug, the use of which is:
69		-
70	108		1. Consistent with best practices for the treatment of advanced
71	109		metastatic cancer or an associated condition;

73	110		2. Supported by peer-reviewed, evidence-based literature; and

75	111		3. Approved by the United States Food and Drug Administration.

77	112		SECTION 3. This act shall become effective November 1, 2023.
