5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. AMENDATORY 47 O.S. 2021, Section 1104, as
5454 amended by Section 1, Chapter 363, O.S.L. 2022 (47 O.S. Supp. 2022,
5555 Section 1104), is amended to read as follows:
5656 Section 1104. A. Unless otherwise provided by law, all fees,
5757 taxes and penalties collected or received purs uant to the Oklahoma
5858 Vehicle License and Registration Act or Section 1 -101 et seq. of
5959 this title shall be apportioned and distribute d monthly by the
6060 Oklahoma Tax Commission in accordance with this section .
6161 B. 1. The following percentages of the monies r eferred to in
6262 subsection A of this section shall be apportioned to the various
6363 school districts in accordance with paragraph 2 of thi s subsection:

142142 2. The monies apportione d pursuant to subparagraphs a through e
143143 of paragraph 1 of this subsection shall be app ortioned to the
144144 various school districts so that each district shall receive an
145145 amount based upon th e proportion that each district 's average daily
146146 attendance bears to th e total average daily attendance of those
147147 districts entitled to receive funds pursuant to this section as
148148 certified by the State Department of Education.
149149 Each district's allocation of funds shall be remitted to the
150150 county treasurer of the county wherein th e administrative
151151 headquarters of the dist rict are located.
152152 No district shall be elig ible for the funds herein provided
153153 unless the district makes an ad valorem tax levy of fifteen (15)
154154 mills and maintains nine (9) years of ins truction and pursuant to
155155 the rules of the State Board of Education, is a uthorized to maintain
156156 ten (10) years of ins truction.
157157 C. The following percentages of the monies referred to in
158158 subsection A of this section shal l be remitted to the State
159159 Treasurer to be credited to the General Rev enue Fund of the State
160160 Treasury:
161161 1. From October 1, 2000, until June 30, 2001, fo rty-five and
162162 ninety-seven one-hundredths percent (45.97%);

339339 2. The monies apportioned pu rsuant to subparagraphs a through e
340340 of paragraph 1 of this subsection shall be apportioned as follows:
341341 forty percent (40%) of such sum shall be distributed to the various
342342 counties in that proportion which the county road mileage of each
343343 county bears to the entire state road mileage as certified by the
344344 Transportation Commission and the remaining sixty percent (60%) of
345345 such sum shall be distributed to the various counties on the basis
346346 which the population and area of each county bears to the total
347347 population and area of the state . The population shall be as shown
348348 by the last Federal Census or the most recent annual est imate
349349 provided by the United States Bureau of the Census. The funds shall
350350 be used for the purpose of constructing and maintaining county
351351 highways; provided, however, the county treasurer may deposit so
352352 much of the funds in the sinking fund as may be neces sary for the
353353 retirement of interest and annual accrual of indebtedne ss created by
354354 the issuance of county or township bonds for road purposes . Such
355355 deposits to the sinking fund shall not exceed forty percent (40%) of
356356 the funds allocated to a county pursuan t to this paragraph.
357357 F. 1. The following percentages of the monies referred to in
358358 subsection A of this section shall be remitted to the count y
359359 treasurers of the respective counties and by them deposited in a
360360 separate special revenue fund to be used by th e county commissioners
361361 in accordance with paragraph 2 of this subsec tion:

398398 hundredths percent (2.59%), but in no event shall the
399399 amount apportioned in any fiscal year pursuant to this
400400 subparagraph exceed the total amount apportioned for
401401 the fiscal year ending on June 30, 2015 . Any amounts
402402 in excess of such limitati on shall be placed to the
403403 credit of the General Revenue Fund, and
404404 e. for the year beginning July 1, 2019, and all
405405 subsequent years, two and fif ty-nine one-hundredths
406406 percent (2.59%), but in no event shall the amount
407407 apportioned in any fiscal year pursuant to this
408408 subparagraph exceed the total amount apportioned for
409409 the fiscal year ending on June 30, 2015. Any amounts
410410 in excess of such limitation shall be placed to the
411411 credit of the Rebuilding Oklahoma Access and Driver

440440 2. The monies apportioned purs uant to subparagraphs a through e
441441 of paragraph 1 of this subsection shall b e used for the primary
442442 purpose of matching federal funds for the constructio n of federal
443443 aid projects on county r oads, or constructing and maintaining county
444444 or township highways an d permanent bridges of such counties. The
445445 distribution of monies apportion ed by this paragraph shall be made
446446 upon the basis of the current formula bas ed upon road mileage, area
447447 and population as related to county road improvement and maintenance
448448 costs. Provided, however, the Department of Transportation may
449449 update the formula f actors from time to time as necessary to account
450450 for changing conditions.
451451 G. 1. The following percentages of th e monies referred to in
452452 subsection A of this section shall be transm itted by the Tax
453453 Commission to the various counties as set forth in paragra ph 2 of
454454 this subsection:
455455 a. from October 1, 2000, until June 30, 2001, three and
456456 fifty-five one-hundredths percent (3.55%),
457457 b. for the year beginning July 1, 2001, and ending June
458458 30, 2002, three and fifty-nine one-hundredths percent

501501 subparagraph exceed the total amou nt apportioned for
502502 the fiscal year ending on June 30, 2015 . Any amounts
503503 in excess of such limitation shall be pl aced to the
504504 credit of the Rebuilding Oklahoma Access and Driver
505505 Safety Fund created in Section 1521 of Title 69 of the
506506 Oklahoma Statutes.
507507 2. The monies apportioned pursuant to subparagraphs a through e
508508 of paragraph 1 of this subsection shall be transmitte d to the
509509 various counties on the basis of a formula to be developed by the

537537 currently used for the distribution of County Bridge Program Funds,
538538 but also taking into consideration the effec t of terrain and traffic
539539 volume as related to county road improvemen t and maintenance costs.
540540 Provided, however, the Department of Transportati on may update the
541541 formula factors from time to time as necessary to account for
542542 changing conditions. The funds shall be transmitted to th e various
543543 county treasurers to be deposited in the county highway fund of
544544 their respective counties.
545545 H. 1. The following percentages of the monies referred to in
546546 subsection A of this section s hall be apportioned to the various
547547 counties as set forth in pa ragraph 2 of this subsection:
548548 a. from October 1, 2000, until June 30, 2001, eighty-one
549549 one-hundredths percent (0.81%),
550550 b. for the year beginning July 1, 2001, and ending June
551551 30, 2002, eighty-two one-hundredths percent (0.82%),
552552 c. for the year beginning Ju ly 1, 2002, through the year
553553 ending on June 30, 2015, eighty-three one-hundredths
554554 percent (0.83%),
555555 d. for the year beginning July 1, 2015, through the year
556556 ending on June 30, 2019, eighty -three one-hundredths
557557 percent (0.83%), but in no event shall the amou nt
558558 apportioned in any fiscal year pursuant to this

599599 2. The monies apportioned pursuant to su bparagraphs a through e
600600 of paragraph 1 of this subsection shall be apportioned to the
601601 various counties based upon the proportion that each county 's
602602 population bears to the total state population .
603603 Each county's allocation of funds shall be remitted to the
604604 various county treasurers to be deposited in the general fund of the
605605 county and used for the support of county governme nt.
606606 I. 1. The following percentages of the monies referred to in
607607 subsection A of this section shall be a pportioned to the various
608608 cities and incorporated towns as set forth in paragraph 2 of this

657657 year ending on June 30, 2015 . Any amounts in excess

688688 2. The monies apportioned pursuant to subparagraphs a through e
689689 of paragraph 1 of this subsection shall be apportioned to the
690690 various cities and incorporated towns based upon the p roportion that
691691 each city or incorporated town's population bears to the total
692692 population of all cities and incorporated towns in the state . Such
693693 funds shall be remitted to the var ious county treasurers for
694694 allocation to the various cities and incorporated towns. All such
695695 funds shall be used for the construction, ma intenance, repair,
696696 improvement and lighting of streets and alleys. Provided, however,
697697 the governing board of any city or town may, with the approval of
698698 the county excise board, transfer any sur plus funds to the general
699699 revenue fund of such city or town wh enever an emergency requires
700700 such a transfer.
701701 J. The following percentages of the monies referred to in
702702 subsection A of this section shall be remitted to the State
703703 Treasurer to be credited to t he Oklahoma Law Enforcement Retirement
704704 Fund:
705705 1. From October 1, 2000, until June 30, 2001, one and twenty-
706706 two one-hundredths percent (1.22%);
707707 2. For the year beginning July 1, 20 01, and ending June 30,
708708 2002, one and twenty -three one-hundredths percent (1 .23%); and

735735 3. For the year beginning July 1, 2002, and all su bsequent
736736 years, one and twenty-four one-hundredths percent (1.24%).
737737 K. Three one-hundredths of one percent (3/100 of 1%) of the
738738 monies referred to in subsection A of this section shall be remit ted
739739 to the State Treasurer to be credited to the Wildlife Cons ervation
740740 Fund. Seventy-five percent (75%) of the funds shall be used for
741741 fish habitat restoration and twenty -five percent (25%) of the funds
742742 shall be used in the fish hatchery system for fish p roduction.
743743 L. 1. For the year beginning July 1, 2007, and en ding June 30,
744744 2008, five percent (5%) of monies referred to in subsection A of
745745 this section shall be remitted to the S tate Treasurer to be credited
746746 to the County Improvements for Roads and Bridg es Fund as created in
747747 Section 507 of Title 69 of the Oklahoma Statutes.
748748 2. For the year beginning July 1, 2008, and ending June 30,
749749 2009, ten percent (10%) of monies referred to i n subsection A of
750750 this section shall be remitted to the State Treasurer to b e credited
751751 to the County Improvements for Roads and Bridges Fu nd as created in

795795 6. For the year beginning July 1, 2014, twenty percent (20%) of
796796 monies referred to in subsection A of this section shall be remitted
797797 to the State Treasurer to be credited to the County Improvement s for
798798 Roads and Bridges Fund as created in Section 507 of Title 69 of the
799799 Oklahoma Statutes.
800800 7. For the year beginning July 1, 2015, through t he year ending
801801 on June 30, 2019, twenty percent (20%) of monies referred to in
802802 subsection A of this section shall be remitted to the State
803803 Treasurer to be credited to the County Improvements for Roads and
804804 Bridges Fund as created in Section 507 of Title 69 of the Oklahoma
805805 Statutes, but in no event shall the total amount apportioned in any
806806 fiscal year pursuant to this paragraph exceed One Hund red Twenty

836836 8. a. Except as provided in subparagraph b of t his
837837 paragraph, for the year beginning July 1, 2019, and
838838 all subsequent years, twenty percent (20%) of monies
839839 referred to in subsection A of thi s section shall be
840840 remitted to the State Treasurer to be credited to the
841841 County Improvements for Roads and Bridge s Fund as
842842 created in Section 507 of Title 69 of the Oklahoma
843843 Statutes, but in no event shall the total amount
844844 apportioned in any fiscal year pu rsuant to this
845845 paragraph exceed the fiscal year limitation s provided
846846 in subparagraph c of this paragraph. Any amounts in
847847 excess of the fiscal year limitations provided in
848848 subparagraph c of this paragraph shall be placed to
849849 the credit of the Rebuilding Oklahoma A ccess and
850850 Driver Safety Fund created in Section 1521 of Title 69
851851 of the Oklahoma Statutes,
852852 b. (1) for the fiscal year beginning July 1, 2021,
853853 through the fiscal year ending June 30, 2026, the
854854 Oklahoma Tax Commission shall re mit twenty-five
855855 percent (25%) of the monthly allocati on,
856856 otherwise scheduled to be credited to the County
857857 Improvements for Roads and Bridges Fund, to the

887887 (a) one-third (1/3) of such funds shall be

891891 (b) one-third (1/3) of such funds shall be
892892 distributed to the various cou nties in the
893893 proportion which the certified county road
894894 miles of each county bear to the total sum
895895 of county road miles in the state, and
896896 (c) one-third (1/3) of such funds shall be
897897 distributed to the various counties in the
898898 proportion which the total replacement cost
899899 for obsolete or deficient bridges accordi ng
900900 to the most recent ODOT yearly Bridge
901901 Summary Report for County Bridges for each
902902 county bears to the total amount of such
903903 cost for all such county bridges in the

905905 (2) for the fiscal year beg inning July 1, 2026, and

10021002 M. Twenty-four and eighty-four one-hundredths percent (24.84%)
10031003 of the monies referred to in subsect ion A of this section shall be

10331033 N. Monies allocated to counties by this section may be
10341034 estimated by the county excise board in the budget for the county as
10351035 anticipated revenue to the extent of ninety percent (90 %) of the
10361036 previous year's income from such source; provided, not more than
10371037 fifteen percent (15%) ca n be encumbered during any month.
10381038 O. Notwithstanding any other provisio ns of this section, for
10391039 the fiscal year beginning July 1, 2003, the first One Hundred
10401040 Thousand Dollars ($100,000.00) of the monies collected or r eceived
10411041 by the Tax Commission pursuant to the registration of motorcycles
10421042 and mopeds in this state shall be pla ced to the credit of the
10431043 Oklahoma Tax Commission Revolving Fund.
10441044 SECTION 2. This act shall become effective November 1, 2023.
